Can I Dispute Student Loans? How to File, Timeline, and Appeals

To dispute a student loan, file a written challenge with both the credit bureau showing the error and the loan servicer that reported it, attach proof of what the correct information should be, and give them 30 days to investigate under the Fair Credit Reporting Act.1Office of the Law Revision Counsel. 15 USC 1681i – Procedure in Case of Disputed Accuracy The process works for federal and private loans alike, though your escalation options change depending on which type you hold.

When You Actually Have a Dispute

A dispute needs a factual mismatch between your records and what the servicer or credit bureau is reporting. Disagreement with a policy or frustration with a balance you owe is not a dispute. The situations that hold up are concrete:

  • Payments you made that were never credited, or that were applied to the wrong loan.
  • A delinquent or default status reported while you were in an approved deferment, forbearance, or income-driven repayment plan.
  • A loan you never took out, likely from identity theft. The FCRA gives you a specific right to have fraudulent accounts removed.2Office of the Law Revision Counsel. 15 USC 1681 – Congressional Findings and Statement of Purpose
  • A loan still reported as active after it was discharged through bankruptcy, forgiveness, or a closed-school discharge.
  • An interest rate that doesn’t match your promissory note or the statutory rate.
  • The same loan showing up twice, often under different servicer names after a transfer.

“I think my balance is too high” won’t move anyone. “I paid $500 on March 15 and my balance didn’t drop” will.

Where to File

There are two separate tracks, and most borrowers do best filing on both at once.

With the Credit Bureaus

If the error appears on your credit report, dispute it with each of the three major bureaus that shows it. Each runs an online portal:3Consumer Financial Protection Bureau. How Do I Dispute an Error on My Credit Report

  • Equifax: equifax.com/personal/credit-report-services/credit-dispute/
  • Experian: experian.com/disputes/main.html
  • TransUnion: dispute.transunion.com

The bureau is required to forward your dispute to the servicer that supplied the data. The servicer investigates and reports back. This path is the fastest way to get a bad entry fixed on your credit file.

With the Servicer

You also have the right to dispute directly with the servicer under the FCRA’s furnisher rules. The servicer must investigate, review your evidence, and, if it finds the information was inaccurate, notify every credit bureau it reported to.4Office of the Law Revision Counsel. 15 USC 1681s-2 – Responsibilities of Furnishers of Information to Consumer Reporting Agencies This is the right path for problems that go beyond the credit report itself, like a payment credited to the wrong account or a billing error inside your servicer portal.

Filing both ways creates parallel obligations and a paper trail on two fronts. For a serious error, do both.

What to Gather Before You File

The strength of your dispute is the strength of your evidence. Pull your credit report from each bureau at annualcreditreport.com and mark the specific line item you’re challenging. Then collect:

  • The full account number for each loan in question.
  • Bank statements, cancelled checks, or electronic payment confirmations showing the date and amount of every payment you claim was misapplied or missed.
  • Letters, emails, or portal messages confirming any deferment, forbearance, or repayment plan status you’re relying on.
  • Your original promissory note, if the interest rate is what you’re disputing.
  • An identity theft report from IdentityTheft.gov and the resulting affidavit, if a loan on your report isn’t yours.3Consumer Financial Protection Bureau. How Do I Dispute an Error on My Credit Report

Send copies, never originals, and keep a full duplicate set of whatever you submit. Your dispute letter should state your name, address, the account number, a clear description of the error, and the correction you want. The CFPB recommends attaching a copy of the portion of your credit report where the disputed item appears.3Consumer Financial Protection Bureau. How Do I Dispute an Error on My Credit Report

How to Submit So the Clock Starts

Use a method that gives you proof of delivery. Credit bureau portals issue a confirmation number immediately. For servicers you have three practical options:

  • Certified mail with return receipt. Still the most reliable method for servicer disputes because the return receipt documents the exact date they received it.
  • The servicer’s online portal. Most have a document upload feature. Screenshot the confirmation page and save the reference number.
  • The CFPB complaint portal at consumerfinance.gov/complaint, which forwards your complaint to the company and tracks the response.5Consumer Financial Protection Bureau. Submit a Complaint

Write down the date you submitted. Every deadline that follows runs from the date the other side received your dispute.

The Investigation Timeline

A credit reporting agency generally has 30 days to investigate and respond. That window extends to 45 days if you submit additional information during the first 30-day period.1Office of the Law Revision Counsel. 15 USC 1681i – Procedure in Case of Disputed Accuracy A servicer you dispute directly is held to the same investigation timeline.4Office of the Law Revision Counsel. 15 USC 1681s-2 – Responsibilities of Furnishers of Information to Consumer Reporting Agencies

During the investigation, the bureau or servicer reviews your evidence, checks its own records, and decides whether the reported information is accurate. If it finds an error, it must notify every credit bureau that received the wrong data and correct the record. If the result goes against you, you’ll get written notice explaining the outcome, along with an updated credit report if anything changed.

Complaints filed through the CFPB portal typically draw a company response within 15 days. More complex cases can take up to 60 days for a final answer.6Consumer Financial Protection Bureau. Learn How the Complaint Process Works

If Your Dispute Gets Denied or Ignored

First-round denials are common. You have real escalation options.

File a CFPB Complaint

If you haven’t already, submit a complaint at consumerfinance.gov/complaint or call (855) 411-2372. The CFPB handles both federal and private student loan complaints and forwards them to the company with tracking.7Consumer Financial Protection Bureau. Federal Student Aid Ombudsman

For federal loans specifically, the Federal Student Aid Ombudsman Group acts as a neutral mediator after standard dispute channels have failed. Congress authorized the office under 20 U.S.C. ยง 1018 to receive and informally resolve borrower complaints involving federal servicers, guaranty agencies, and the Department of Education.8Office of the Law Revision Counsel. 20 USC 1018 – Performance-Based Organization for Delivery of Federal Student Financial Assistance

The Ombudsman is designed as a last resort, so you’ll need to show you’ve already tried to resolve the issue with the servicer. Be ready to identify the problem, say what resolution you want, describe the steps you’ve already taken, and provide documentation.9FSA Partner Connect. Office of the Ombudsman FSA The office is reachable at 800-433-3243 and online through studentaid.gov/feedback-center/.

Suing Under the FCRA

If a credit bureau or servicer willfully ignores your dispute or breaks the FCRA’s investigation rules, you can sue in state or federal court. For willful noncompliance, the statute allows actual damages or statutory damages of $100 to $1,000 per violation, plus punitive damages and attorney’s fees at the court’s discretion.10Office of the Law Revision Counsel. 15 USC 1681n – Civil Liability for Willful Noncompliance The threat of an FCRA suit frequently prompts a second look at a disputed account. Consumer credit attorneys often take these cases on contingency.

Loans You Shouldn’t Owe at All

Not every problem is a reporting error. If your position is that the loan itself shouldn’t exist, two separate programs apply.

Borrower Defense to Repayment

Borrower defense is a federal discharge claim based on school misconduct, not a credit dispute. If approved, some or all of your federal Direct Loans can be wiped out entirely.11Federal Student Aid. Borrower Defense Loan Discharge Under the 2023 regulations, qualifying misconduct includes:

  • Substantial misrepresentation about programs, job placement rates, salaries, or credit transferability that influenced your decision to enroll or borrow.
  • Substantial omission of information a reasonable person would have wanted before enrolling.
  • Breach of the enrollment agreement.
  • Aggressive or deceptive recruitment, including pressure to enroll on the spot or the use of fake job listings to collect contact information.
  • A court judgment finding the school violated the law in connection with your loan or education.

Submit the application online at studentaid.gov/borrower-defense or mail the completed form to the Department of Education.12Federal Student Aid. Borrower Defense to Repayment Application You’ll describe the misconduct, explain how it affected your decision, and estimate the financial harm. Pull together marketing materials, your enrollment agreement, and emails from admissions showing what the school promised against what it delivered.

Closed School Discharge

If your school closed before you finished, your federal loans for that enrollment may be fully discharged. You must have been enrolled when the school closed or have withdrawn no more than 180 days before, and you must not have completed the program at another school through a teach-out agreement.13eCFR. 34 CFR 685.214 – Closed School Discharge The Department sometimes grants automatic discharges without an application, so check your studentaid.gov account before you file.

If the Loan Is Private

Private student loans aren’t overseen by the Department of Education, so the Ombudsman and borrower defense routes don’t apply. The FCRA does, which means the credit bureau dispute path above works the same. For billing errors and account-level problems, the CFPB is your primary federal resource.7Consumer Financial Protection Bureau. Where Can I File a Financial Aid or Student Loan Complaint Read your loan agreement before planning litigation; many private loans contain arbitration clauses that limit your right to sue.

Why Delay Costs You

Letting an error sit is not a neutral choice. A loan incorrectly reported as delinquent or in default drags your credit score down, which flows through to mortgages, auto loans, and rental applications. Borrowers with defaulted federal loans face administrative wage garnishment of up to 15% of disposable pay, and the government can seize tax refunds, federal salary payments, and Social Security benefits through the Treasury Offset Program.14Bureau of the Fiscal Service. Treasury Offset Program Frequently Asked Questions for Debtors

Before referring a debt to the Treasury Offset Program, the agency must send you a letter explaining the debt, the amount owed, and your right to review the information and arrange repayment.14Bureau of the Fiscal Service. Treasury Offset Program Frequently Asked Questions for Debtors If that letter arrives and the loan data behind it is wrong, dispute immediately. Recovering money already seized from a tax refund takes far longer than preventing the seizure in the first place.

As of early 2026, the Department of Education has delayed the restart of involuntary collection actions including wage garnishment and Treasury offset. The timeline for when these resume remains uncertain. Borrowers in default should not assume the pause continues indefinitely.
