Can I Buy Gold With My SEP IRA: Custodians, Storage, and Taxes

Yes, you can buy gold with a SEP IRA, but only gold that meets federal purity rules, purchased through a self-directed custodian, and stored with an approved trustee. Ordinary brokerage SEP IRAs don’t hold physical metal, so the account itself has to be structured for alternative assets before any purchase can happen. Get the type of gold, the custody, or the storage wrong and the IRS can treat the whole thing as a taxable distribution.

What Gold Qualifies

Federal tax law treats most metals and coins as collectibles, and when an IRA buys a collectible the purchase price is treated as a distribution: income tax on the full amount, plus a 10% early withdrawal penalty if you’re under 59½.1Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts

Gold gets an exception under 26 U.S.C. § 408(m)(3), and it works two ways.

The first route is by name. The statute lists gold coins described in 31 U.S.C. § 5112(a), which brings in the American Gold Eagle. The Eagle is 22-karat (.9167 fine), below the general bullion threshold, but Congress wrote it into the exception explicitly. American Gold Buffalo coins, at 24-karat, qualify as well.

The second route is fineness. Any gold bar or round is eligible if its purity equals or exceeds the minimum that a regulated futures contract market requires for delivery. For gold, COMEX sets that floor at .995. The bullion must also sit in the physical possession of an IRA trustee.1Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts Foreign coins like the Canadian Maple Leaf and Australian Kangaroo are 99.99% fine and clear the bar easily.

What does not qualify: rare numismatic coins, gold jewelry, and anything whose value depends on rarity or craftsmanship rather than metal content. The same section of the code also lets a SEP IRA hold silver, platinum, and palladium bullion at their own fineness floors, and certain state-issued coins.1Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts

You Need a Self-Directed Custodian

Most banks and brokerages don’t hold physical metal. To buy gold with SEP IRA money, you open a self-directed IRA with a custodian set up to administer alternative assets. That custodian handles the paperwork, reports the account’s fair market value to the IRS on Form 5498, and executes buy and sell instructions you give them.2Internal Revenue Service. About Form 5498 – IRA Contribution Information

Self-directed custodians are passive. They will not advise you on whether gold belongs in your portfolio or vet the dealer you choose. Their job is compliance and execution. You are responsible for the investment decision and for confirming the metal you buy is eligible.

What the Account Costs

Fees run higher than a conventional IRA because alternative assets need extra administration. Expect a one-time setup fee, commonly $50 to $250; an annual administrative fee of roughly $75 to $300; and transaction fees each time you buy or sell metal. Some custodians charge flat annual fees; others use a percentage of assets under custody. Ask for a full fee schedule before opening the account.

How the Purchase Actually Works

Buying gold inside the IRA has more moving parts than buying stock, and every step has to line up.

  • Choose a dealer and get a written invoice. The invoice should list the specific product, weight, and price. Dealers charge a premium over spot. A CFTC customer advisory notes bullion premiums typically run 5% to 10% above spot, though this varies by product.3Commodity Futures Trading Commission. Customer Advisory – Beware of Gold and Silver Schemes
  • Submit a Direction of Investment form. This written instruction tells your custodian to send a specific dollar amount from the SEP IRA to the dealer. The form must match the dealer’s invoice exactly.
  • The custodian wires the funds. Once the form is approved and cash is confirmed, the custodian sends payment directly to the dealer. The money never leaves the tax-advantaged shell, so no distribution occurs.
  • The dealer ships to a depository. The metal goes to an IRS-approved depository, not to you. The depository verifies the shipment and issues a receipt to the custodian.

Gold prices move throughout the day, so a dealer quote can expire before the custodian’s wire arrives. Accurate paperwork on the first submission avoids a repriced order or a canceled trade.

Where the Gold Has to Live

The statute is explicit: IRA-eligible bullion must remain in the physical possession of a trustee.1Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts That means a bank or IRS-approved nonbank trustee running a secure depository. Not your home safe. Not a personal safe deposit box.

Taking the gold home is treated as a distribution of the full value. You owe ordinary income tax on that amount plus a 10% penalty if you’re under 59½.4Office of the Law Revision Counsel. 26 USC 72 – Annuities; Certain Proceeds of Endowment and Life Insurance Contracts

Depositories offer segregated storage, where your specific bars and coins sit in their own compartment, and commingled storage, where metal of the same type is pooled and ownership tracked by record. Segregated storage costs more. Reputable depositories carry insurance covering the full value of stored metals and undergo independent third-party audits. Confirm coverage amounts and audit frequency before you commit; your custodian can supply the details.

Transactions That Will Void the Account

Under 26 U.S.C. § 4975, a prohibited transaction is any dealing between your IRA and a “disqualified person,” which includes you, your spouse, your parents, your children, their spouses, and your grandchildren.5Office of the Law Revision Counsel. 26 USC 4975 – Tax on Prohibited Transactions In a gold IRA, that rules out:

  • Buying gold from a family member and putting it in the IRA
  • Selling IRA gold to yourself or a relative
  • Pledging IRA gold as collateral for a personal loan
  • Storing IRA gold at your home, which is both a deemed distribution and a prohibited transaction
  • Personally performing services for the IRA, such as arranging security for the metal

If the IRS finds a prohibited transaction, it can disqualify the entire IRA, treating the full value as a distribution in the year the violation occurred. Under SECURE Act 2.0, the fallout is limited to the specific IRA involved rather than every IRA you hold.

Funding the Account

Before you buy anything, the account needs cash. For 2026, employer contributions to a SEP IRA cannot exceed the lesser of 25% of the employee’s compensation or $72,000.6Internal Revenue Service. SEP Contribution Limits Including Grandfathered SARSEPs For the self-employed, “compensation” means net self-employment income after deducting the employer-equivalent portion of self-employment tax.

The contribution deadline is the due date for filing your federal income tax return, including extensions. Miss the deadline without an extension on file and you lose the deduction for that year.7Internal Revenue Service. Retirement Plans FAQs Regarding SEPs

You can also fund the self-directed SEP IRA by moving money from another retirement account. A direct trustee-to-trustee transfer has no annual frequency limit. A 60-day rollover, where the money passes through your hands, is limited to one per 12-month period across all your IRAs. Exceed that and the second rollover is treated as a taxable distribution.8Internal Revenue Service. Rollovers of Retirement Plan and IRA Distributions

Taxes When You Take the Gold Out

Gold held outside a retirement account is taxed as a collectible, with long-term capital gains capped at 28%. Gold inside a SEP IRA follows ordinary IRA rules. Contributions are deductible going in, growth is tax-deferred, and distributions in retirement are taxed as ordinary income at your bracket at the time. For 2026, federal ordinary income rates run from 10% to 37%.

Withdrawals before age 59½ face a 10% additional tax on top of regular income tax, with limited exceptions for disability, certain medical expenses, and other scenarios in 26 U.S.C. § 72(t).4Office of the Law Revision Counsel. 26 USC 72 – Annuities; Certain Proceeds of Endowment and Life Insurance Contracts

Required Minimum Distributions

SEP IRAs follow the same RMD rules as traditional IRAs. Withdrawals must begin by April 1 of the year after you turn 73.9Internal Revenue Service. Retirement Topics – Required Minimum Distributions The amount is the account’s December 31 value from the prior year divided by the IRS life expectancy factor for your age.

Physical gold creates a wrinkle stocks don’t. You can’t sell a fraction of a bar. Owners generally satisfy the RMD one of two ways: the custodian liquidates enough metal to cover the RMD and distributes cash, or the custodian delivers specific coins or bars to you as an in-kind distribution. In an in-kind distribution, the fair market value on the date the metal leaves the IRA is your taxable distribution; if you later sell for more, the gain above that value is taxed at the collectibles rate of up to 28%.

In-kind distributions take longer to process. Contact the custodian at least 60 days before the RMD deadline. A missed or insufficient RMD triggers a 25% penalty on the shortfall.
