An H4 visa holder can get an SSN only after receiving an Employment Authorization Document (EAD) from USCIS. No EAD, no Social Security number. And the EAD itself is limited: only H4 spouses of H-1B workers qualify, and only when the H-1B spouse’s green card process has reached a specific stage. H4 children and H4 spouses whose partners have not hit that stage cannot obtain an SSN and should look at an ITIN instead for tax filing.
Who Qualifies for an SSN on an H4 Visa
The Social Security Administration issues SSNs to noncitizens with work authorization in the United States.1Social Security Administration. An H4 spouse qualifies for the EAD when the H-1B spouse meets one of two conditions:
- The H-1B worker is the principal beneficiary of an approved Form I-140 (Immigrant Petition for Alien Workers), or
- The H-1B worker has been granted an extension of H-1B status beyond the six-year limit under the American Competitiveness in the Twenty-first Century Act (AC21).
H4 children under 21 are not eligible for an EAD under these rules and therefore cannot obtain an SSN. Dependents of H-2A, H-2B, and H-3 workers are also excluded.3U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses
Requesting the SSN on Form I-765
The cleanest way to get the number is to request it on the EAD application itself. Form I-765 includes a section that asks SSA to assign you an SSN and mail the card automatically once USCIS approves your work authorization. If you check the box, the card typically arrives within seven to ten business days of the EAD. If it doesn’t, contact your local SSA office.5Social Security Administration. How Long Will It Take To Get a Social Security Card This path avoids a separate in-person visit and the extra verification wait that comes with it.
Applying at a Social Security Office After You Have Your EAD
If you didn’t request the SSN on Form I-765, you can apply in person after the EAD is approved. Anyone 12 or older applying for an original SSN must appear for an in-person interview.6Social Security Administration. 20 CFR 422.107 – Evidence Requirements
Bring:

- An unexpired foreign passport as proof of identity
- Your Form I-94 (Arrival/Departure Record) as proof of immigration status
- Your EAD card (Form I-766) as proof of work authorization
Documents must be originals or copies certified by the issuing agency. Photocopies and notarized copies are not accepted.8Social Security Administration. If the card hasn’t arrived within two to three weeks, call SSA to check.
What the Card Will Look Like
The card you receive is not the unrestricted version issued to citizens and permanent residents. It carries the annotation “VALID FOR WORK ONLY WITH DHS AUTHORIZATION,” which ties your ability to work to your immigration status.9Social Security Administration. Your Social Security Number and Card
The number itself is permanent. If your EAD later lapses, you cannot legally work, but the SSN stays assigned to you and continues to function for non-employment purposes such as tax filing. If your status later changes, for example to lawful permanent resident, you can bring updated documents to SSA and receive a replacement card without the work restriction under the same number.10Congress.gov. A Rule Change That Affects Renewals
Effective October 30, 2025, an interim final rule eliminated automatic EAD extensions for H4 holders. Under the prior policy, a timely renewal filing kept your work authorization going while USCIS decided the application. Now, once your EAD expires you must stop working until the new card is issued.11U.S. Citizenship and Immigration Services. Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization H4 holders who filed renewals before that date may still receive extensions of up to 540 days under the old rule. Premium processing isn’t available for H4 EADs, and processing averages about five months, so file the renewal well before expiration.
The H4 EAD program itself is intact. In October 2025 the Supreme Court declined to hear Save Jobs USA v. DHS, leaving a D.C. Circuit ruling that upheld DHS’s authority to create the category. No rulemaking to rescind the program has been published as of early 2026.
If You Can’t Get an EAD: ITIN and the Denial Letter
Many H4 dependents will never qualify for an EAD, either because they are children or because the H-1B spouse’s green card process hasn’t reached the required stage. Without an EAD, you cannot get an SSN. For tax purposes, you apply for an Individual Taxpayer Identification Number (ITIN) using Form W-7.12Internal Revenue Service. In most cases the W-7 must be filed with a federal tax return, unless you qualify for a specific exception. Identity documentation is required; a certified copy of your passport typically satisfies this. You can mail the application, apply in person at an IRS Taxpayer Assistance Center, or use an IRS-authorized Certifying Acceptance Agent to avoid mailing your original passport. Processing runs roughly seven to eleven weeks. An ITIN is for tax compliance only. It is not work authorization. Some banks and credit card issuers will accept it in place of an SSN, which helps with building a financial record while you wait for EAD eligibility.
For a state driver’s license or ID, many states require either an SSN or proof that you aren’t eligible for one. If you’re an H4 dependent without work authorization, you can visit an SSA office with your passport and I-94 and ask for a denial letter (Form SSA-L676), which SSA issues while you wait. It confirms you aren’t eligible for an SSN and does not affect your ability to apply later if you obtain an EAD.13U.S. Department of State. What the SSN Actually Does
With a valid EAD and SSN, you can work for any U.S. employer in any occupation. The EAD isn’t tied to a specific job or company.14USAGov. Work in the U.S. With a Work Permit (EAD) Your employer uses the SSN to report wages and withhold federal income tax, Social Security, and Medicare. Outside employment, an SSN simplifies interactions with banks, credit card companies, landlords, and utilities. It is not, however, an immigration benefit. Having one does not extend your visa, change your nonimmigrant status, or move you toward permanent residence.
