A Registered Behavior Technician generally cannot be classified as an independent contractor. The BACB supervision rules that keep an RBT credential valid require a level of oversight, direction, and control that meets the IRS and Department of Labor definitions of an employer-employee relationship. Agencies that pay RBTs on a 1099 basis face back taxes, wage claims, and professional discipline, and the technicians themselves shoulder tax burdens they should not be carrying.
Why BACB Supervision Forces Employee Status
The credential itself builds in the control that federal law treats as employment. An RBT must receive supervision for at least 5% of the hours they spend delivering behavior-analytic services each calendar month.1BACB. Registered Behavior Technician Handbook That supervisor, who must hold a BCBA or BCaBA certification, has to directly observe the RBT working with a client, in real time, at least once per month.2Behavior Analyst Certification Board. RBT Ongoing Supervision Fact Sheet
The supervisor is responsible for all work the RBT performs.3Behavior Analyst Certification Board. RBT Ethics Code 2.0 An RBT cannot modify a client’s treatment plan, pick their own clinical methods, or practice at all without a designated supervisor on record. All clinical data goes through the supervisor for review, and both parties have to keep documentation of supervised hours in case of an audit.4Behavior Analyst Certification Board. Supervision Checklist for RBTs If that supervision structure breaks down, the RBT loses the credential and the supervisor faces BACB discipline.
That chain of command is what makes contractor classification collapse. A true independent contractor controls how the work gets done. An RBT, by design, does not.
How the IRS Sees the Relationship
The IRS says you are an independent contractor only if the person paying you controls the result of your work but not what you do or how you do it.5Internal Revenue Service. Independent Contractor Defined The agency weighs three categories of evidence: behavioral control (does the company direct what the worker does and how), financial control (who provides tools, how the worker gets paid, whether the worker can take a loss), and the type of relationship (ongoing versus project-based, whether the work is core to the business).6Internal Revenue Service. Independent Contractor (Self-Employed) or Employee?
Every one of those categories cuts the same direction for an RBT. Behavioral control is baked into the credential: a supervisor directs the work, reviews the data, observes sessions live, and approves clinical decisions. Financial control usually sits with the agency, which handles billing, provides materials, assigns caseloads, and takes the profit-or-loss risk. And ABA therapy delivered by an RBT is the core service the agency sells, on an ongoing basis with no defined end date.
Written contracts labeling someone a “contractor” carry little weight if the day-to-day reality looks like employment. What matters is the legal right to control the details, and having that authority is enough even if the company doesn’t exercise it constantly.5Internal Revenue Service. The Department of Labor Reaches the Same Conclusion
The Department of Labor applies a separate six-factor “economic reality test” under the Fair Labor Standards Act, looking at the opportunity for profit or loss, the worker’s own investment, permanence, the degree of control, how integral the work is to the business, and the skill and initiative involved.7U.S. Department of Labor. Frequently Asked Questions – Final Rule: Employee or Independent Contractor Classification Under the FLSA No single factor decides the outcome. For an RBT, they mostly point one way. The technician is paid a set rate, invests little of their own capital, works on an indefinite basis, follows supervised protocols, and delivers the agency’s core service. Fail this test and you are owed minimum wage and overtime regardless of what your paperwork says.
Some agencies try to soften the picture by giving technicians scheduling flexibility or letting them take shifts at multiple agencies. That does not fix the core problem. As long as a supervisor must approve clinical decisions and observe service delivery, behavioral control is satisfied.
State ABC Tests Make It Even Harder
Roughly two-thirds of states use some version of the ABC test for worker classification under their own unemployment insurance or wage laws. The ABC test presumes a worker is an employee unless the hiring entity proves all three prongs, and the middle prong requires that the worker perform services outside the usual course of the hiring entity’s business. An RBT delivering ABA therapy for a company that sells ABA therapy fails that prong on its face. Agencies operating in ABC-test states have essentially no path to legitimate contractor classification for their RBTs.
What Misclassification Costs
Agency Tax Liability
When the IRS reclassifies a 1099 worker as an employee, the employer owes the taxes it should have been paying, starting with the employer’s 7.65% share of Social Security and Medicare (6.2% for Social Security plus 1.45% for Medicare).8Internal Revenue Service. Topic No. 751, Social Security and Medicare Withholding Rates A failure-to-pay penalty of 0.5% per month runs on the unpaid balance, up to 25%, with interest on top.9Internal Revenue Service. Topic No. 653, IRS Notices and Bills, Penalties and Interest Charges Reduced-rate relief exists under 26 U.S.C. ยง 3509 for unintentional misclassification, and Section 530 of the Revenue Act of 1978 can eliminate liability entirely, but the “reasonable basis” prong is hard to satisfy when BACB rules so clearly describe an employment relationship.10Internal Revenue Service. Worker Reclassification – Section 530 Relief
Wage and Hour Claims
The Department of Labor can independently pursue unpaid overtime and minimum wage under the FLSA.11U.S. Department of Labor. Overtime Pay The FLSA also allows liquidated damages equal to the unpaid wages, which effectively doubles the back-pay bill. State labor agencies can add their own penalties on top.
Credential Risk
The BACB publishes reportable sanctions on its public disciplinary registry, including suspensions and revocations.12BACB. BACB Disciplinary Actions A supervisor who allows an RBT to practice inside a structure that violates BACB ethics standards can lose their own certification. That record follows both the technician and the supervisor long after the tax bill is paid.
What to Do If You’re Working as a 1099 RBT Right Now
Handle the Tax Side
Whether you were classified correctly or not, if you’re getting a 1099 today, the tax obligations are yours to manage. That means the full 15.3% self-employment tax: 12.4% for Social Security on earnings up to $184,500 in 2026, plus 2.9% for Medicare with no income cap.13IRS. Publication 15-A (2026) – Employers Supplemental Tax Guide As a W-2 employee, your employer would cover half.
You also owe quarterly estimated payments. For 2026, the due dates are April 15, June 15, September 15, and January 15, 2027, and you can skip the January payment if you file your full return and pay the balance by February 1, 2027.14Internal Revenue Service. 2026 Form 1040-ES Missing these triggers separate penalties.
Track Deductions
Contractors can offset the tax hit with deductions that W-2 employees cannot claim. The ones that actually apply to RBTs include mileage between client sites at 72.5 cents per mile in 2026,15Internal Revenue Service. 2026 Standard Mileage Rates professional liability insurance premiums, continuing education needed to keep your certification, cell phone and internet costs used for work, and any therapy materials you buy yourself. Keep receipts and a mileage log from the first day. Rebuilding records at tax time rarely goes well.
Challenge the Classification
If you think you should be a W-2 employee, you have two federal options. File IRS Form SS-8 to ask the IRS for a formal worker-status determination; both workers and hiring firms can submit it.16Internal Revenue Service. About Form SS-8, Determination of Worker Status for Purposes of Federal Employment Taxes and Income Tax Withholding If you have already been paying self-employment tax on wages that should have had normal withholding, file Form 8919 with your return so you pay only the employee’s share of Social Security and Medicare.17Internal Revenue Service. About Form 8919, Uncollected Social Security and Medicare Tax on Wages
For unpaid overtime or minimum wage issues, file a complaint with the Department of Labor’s Wage and Hour Division online or at 1-866-487-9243. The complaint goes to the nearest field office, which contacts you within two business days to decide whether to investigate.18Worker.gov. Filing a Complaint With the U.S. Department of Labors Wage and Hour Division If the investigation finds you’re owed back wages, you receive a check for the amount.
Retaliation for asserting your rights under tax or labor law is separately illegal. That said, challenging your employer’s classification while you still work there is uncomfortable in practice, and many RBTs wait until they’ve moved to a new position before filing.
