Can an Employer Withhold a W-2? Steps, IRS Help, and Form 4852

No, an employer cannot withhold a W-2. Federal law requires every employer that paid you wages to furnish a completed W-2 by January 31 of the following year, and no dispute over returned equipment, unpaid advances, or how you left the job changes that obligation.1Office of the Law Revision Counsel. 26 U.S. Code 6051 – Receipts for Employees If yours hasn’t arrived, you have ways to force the issue and still file your taxes on time.

What the Law Requires

Under 26 U.S.C. ยง 6051, any employer that withheld income tax, Social Security tax, or Medicare tax from your paycheck must give you a written statement showing your total wages, tips, and the taxes withheld for the calendar year.1Office of the Law Revision Counsel. 26 U.S. Code 6051 – Receipts for Employees That statement is the W-2, and the deadline is January 31. When the 31st falls on a weekend or holiday, the deadline moves to the next business day.2Internal Revenue Service. General Instructions for Forms W-2 and W-3 (2026)

If you left the job partway through the year, the employer can issue the W-2 any time after your last day but still no later than January 31. If you request the form in writing after leaving, the employer has 30 days from your request or 30 days from your final paycheck, whichever is later, to deliver it.2Internal Revenue Service. The W-2 obligation stands apart from anything else between you and the employer. Owing on a company credit card, keeping a laptop, walking off a shift โ€” none of it gives an employer the right to hold your W-2 as leverage. The IRS treats W-2 delivery as a standalone tax-reporting duty, not a bargaining chip.

First Steps When Your W-2 Is Late

Start with payroll or HR. The most common cause of a missing W-2 is a wrong mailing address on file, and a phone call or email usually fixes it within days. Ask them to confirm your address, reissue the form, and tell you how they’re sending it.

Many employers use third-party payroll services like ADP, Paychex, or Gusto that post W-2s to an online portal. Even if you’ve left the company, your login may still work, so check any portal you used while employed. If you can’t log in, HR is the only one who can help; the payroll provider typically won’t release the form directly to you.3Internal Revenue Service. If You Don’t Get a W-2 or Your W-2 Is Wrong

One thing that surprises people: employers are allowed to charge a fee for a duplicate W-2.2Internal Revenue Service. General Instructions for Forms W-2 and W-3 (2026) The original furnished by the deadline must be free; the fee only applies to replacements.

Call the IRS After the End of February

If you’ve contacted your employer and still have no W-2 by the end of February, call the IRS at 800-829-1040.3Internal Revenue Service. If You Don’t Get a W-2 or Your W-2 Is Wrong The IRS will contact your employer and request the missing form. They’ll also send you Form 4852, a substitute W-2 you can use if the real one never arrives.

Have this ready before you call:

  • Your name, address, Social Security number, and phone number
  • Your employer’s name, address, and phone number
  • The dates you worked there
  • An estimate of your wages and the federal income tax withheld, pulled from your final pay stub5Internal Revenue Service. Form 4852, Substitute for Form W-2, Wage and Tax Statement

Use an IRS Wage and Income Transcript

Most people don’t know about this one. The IRS Wage and Income Transcript shows the W-2 data your employer reported to the Social Security Administration, including wages and federal tax withheld. It’s available for the past ten tax years, though data for the most recent year may not be complete until the employer actually files.6Internal Revenue Service. Topic No. 159, How to Get a Wage and Income Transcript

You can request the transcript online through your IRS account at irs.gov or by mailing Form 4506-T. Mail requests are usually processed within 10 business days.7Internal Revenue Service. Transcript or Copy of Form W-2 The transcript doesn’t include state or local tax figures, but it gives you solid federal numbers to put on Form 4852.

File on Time With Form 4852

A missing W-2 does not extend your filing deadline. Your return is still due April 15.8Internal Revenue Service. When to File If the form hasn’t arrived in time, file using Form 4852 as a substitute W-2.5Internal Revenue Service. Form 4852, Substitute for Form W-2, Wage and Tax Statement

On Form 4852 you’ll estimate your total wages and the federal, state, and local taxes withheld. The form also asks you to explain how you arrived at the numbers โ€” pay stubs, bank records, a wage transcript โ€” and what you did to try to get the real W-2. Your final pay stub for the year is the single most useful document, so hold onto it.

Attach the completed Form 4852 to your return in place of the W-2. If the real W-2 later shows up with different numbers, file an amended return on Form 1040-X and include a copy of the W-2.9Internal Revenue Service. Check Your Social Security Earnings Record

A missing W-2 can cause damage that outlasts tax season. Your employer is supposed to report your earnings to the Social Security Administration, and those reported wages determine your future benefits. If the employer never files the W-2 with the SSA, those earnings may never show up on your record.

Once your return is handled, check your earnings record through your my Social Security account at ssa.gov. If wages from the year in question are missing or wrong, file Form SSA-7008, Request for Correction of Earnings Record.11Social Security Administration. Request for Correction of Earnings Record Submit whatever evidence you have: pay stubs, bank deposits, or a copy of the Form 4852 you filed with the IRS. Missing wage credits can permanently reduce your retirement benefits if you don’t catch them.

Penalties the Employer Faces

The IRS imposes per-form penalties on employers who fail to deliver W-2s on time, and the amount climbs the longer the employer waits. • Corrected within 30 days of the deadline: $60 per form
  • Corrected after 30 days but by August 1: $130 per form
  • Not corrected by August 1: $340 per form
  • Intentional disregard: $680 per form, with no annual maximum

Large employers face an annual cap of over $4 million for unintentional failures, and small businesses (those averaging $5 million or less in gross receipts) face lower caps. When the IRS finds an employer deliberately ignored the requirement, there is no cap at all.13Office of the Law Revision Counsel. 26 USC 6722 – Failure to Furnish Correct Payee Statements An employer holding your W-2 to pressure you falls in the intentional-disregard tier, and at $680 per form with no ceiling, the math gets ugly fast for any employer doing this to multiple workers. When you call the IRS, that’s the risk the agency raises with the employer on your behalf.
