An eligible employee generally cannot opt out of a SEP IRA. The employer funds every dollar of the contribution, and federal tax law requires the plan to cover every qualifying worker, so the IRS has no mechanism for you to refuse. If you decline to open an account, your employer can open one in your name and deposit the money anyway. The upside is that once the contribution lands, the balance is 100% yours and you can move it or withdraw it on the usual IRA terms.
Are You Actually an Eligible Employee
The rule only bites if you meet all three federal eligibility tests. For 2026, you qualify if you are at least 21, have worked for the employer in at least three of the last five years, and earned at least $800 in compensation during the year.1Internal Revenue Service. 2026 Amounts Relating to Retirement Plans and IRAs The statutory floor is $450, adjusted for inflation in $50 increments.2Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts
Two groups can be excluded even if they meet those tests: employees covered by a collective bargaining agreement whose retirement benefits were negotiated in good faith, and nonresident aliens with no U.S.-source income from the employer.3Internal Revenue Service. SEP Plan Fix-It Guide – Eligible Employees Were Excluded From Participating Everyone else who meets the three tests must be covered. Part-time workers, seasonal staff, and employees who leave or die during the year are all in.4U.S. Department of Labor. SEP Retirement Plans For Small Businesses
Why Your Employer Cannot Just Leave You Out
When an employer contributes to a SEP for anyone, they must contribute the same percentage of compensation for every eligible employee. An owner who puts in 10% of their own pay has to put in 10% of your pay too. The employer cannot pick and choose based on job title, performance, or your personal preference.2Office of the Law Revision Counsel. 26 USC 408 – Individual Retirement Accounts
Skipping even one eligible worker puts the plan’s tax-deductible status at risk. That is why employers rarely honor opt-out requests, even sympathetic ones. Their exposure is real, and yours is not their problem to solve.
What If You Refuse to Open the Account
Refusing the paperwork does not end the matter. The IRS lets an employer establish a SEP IRA on behalf of any employee who is “unable or unwilling” to open one themselves. The employer picks the financial institution, opens the account in your name, and makes the deposit. Your signature is not required.5Internal Revenue Service. Retirement Plans FAQs Regarding SEPs
There is one narrow scenario in the IRS model plan document, Form 5305-SEP. If the employer does not require SEP participation as a condition of employment, an employee may elect not to participate. The form itself warns that doing so “could cause adverse tax consequences for the participating employees” and may prohibit all other employees from participating.6Internal Revenue Service. Form 5305-SEP (Rev. 12-2004) – Information for the Employee In other words, your refusal could disqualify the plan for your coworkers. Most employers head this off by making SEP participation a condition of employment, which closes the escape hatch entirely.
Can You Take the Money as Wages Instead
No. SEP contributions must be deposited directly into a traditional IRA held by a trustee or custodian for the employee’s benefit.6Internal Revenue Service. Form 5305-SEP (Rev. 12-2004) – Information for the Employee The employer cannot redirect the money as extra salary, and employees cannot make salary-reduction contributions of their own. The dollars only flow one direction: employer into IRA.7Internal Revenue Service. Simplified Employee Pension Plan (SEP)
What You Can Do Once the Money Lands
The picture improves the moment the deposit clears. SEP contributions are 100% vested immediately, with no waiting period or vesting schedule.7Internal Revenue Service. Simplified Employee Pension Plan (SEP) Your employer deposits the money; you pick the investments.
You can also move it. SEP funds can be rolled into a traditional IRA at any time with no tax impact, which is useful if you want broader investment choices than the employer’s custodian offers. You can also convert the balance to a Roth IRA, though a Roth conversion adds the converted amount to your taxable income for that year in exchange for tax-free growth going forward.8Internal Revenue Service. If you actually want the cash, you can withdraw it. Before age 59½, withdrawals are taxed as ordinary income and hit with a 10% early withdrawal penalty unless you qualify for an exception.9Internal Revenue Service. Retirement Topics – Exceptions to Tax on Early Distributions That penalty makes withdrawal an expensive way to escape the account, but it is available. After 59½, only ordinary income tax applies.
How This Affects Your Own IRA Contributions
Getting SEP contributions from your employer does not shrink the amount you can put into your own traditional or Roth IRA. You can fund both. But SEP participation counts as being covered by a workplace retirement plan, which affects whether your traditional IRA contributions are deductible.5Internal Revenue Service. Retirement Plans FAQs Regarding SEPs
For 2026, the deduction phase-out ranges when you are covered by a workplace plan are:
- Single filers: $81,000 to $91,000
- Married filing jointly, you are the covered spouse: $129,000 to $149,000
- Married filing jointly, only your spouse is covered: $242,000 to $252,000
- Married filing separately: $0 to $10,000
Above the top of your range, you cannot deduct traditional IRA contributions at all, though you can still make nondeductible contributions or fund a Roth IRA if you are within Roth income limits.10Internal Revenue Service. 401(k) Limit Increases to $24,500 for 2026, IRA Limit Increases to $7,500
One wrinkle: if your custodian lets you make personal contributions directly into the SEP IRA account, those dollars count against your annual IRA limit and reduce what you can add to a separate Roth or traditional IRA. Employer SEP contributions do not.
