Can a Casino Keep Your Winnings If You Owe Taxes?

A casino cannot keep your winnings if you owe taxes based on its own judgment or a hunch about your tax history. What it can do, and in some cases must do, is two separate things: withhold a flat percentage of certain large payouts and send it to the IRS as a prepayment on the tax owed on those winnings, and comply with a formal Notice of Levy if the IRS has served one on the casino to collect a debt you already owe. Those are different mechanisms with different triggers, and mixing them up is how people end up thinking the cashier made a personal call about their back taxes.

The Automatic 24% Withholding Is Not Debt Collection

When you hit a qualifying jackpot, the casino withholds 24% of the gross payout and sends it to the IRS. This happens when the winnings are $5,000 or more and the payout is at least 300 times the wager.1eCFR. 26 CFR 31.3402(q)-1 – Extension of Withholding to Certain Gambling Winnings On a $10,000 qualifying jackpot, you walk away with $7,600 and the IRS gets $2,400. Your W-2G shows the total win and the amount withheld, and that $2,400 is credited against your tax bill when you file. If your effective rate turns out lower than 24%, the excess comes back as a refund.2Internal Revenue Service. Backup Withholding

This withholding has nothing to do with any pre-existing tax debt. It is the tax on the new winnings, prepaid. A cashier does not pull up your IRS account, see a balance from three years ago, and decide to keep more. There is no database of “people who owe taxes” that casinos check at the window for this purpose.

A second kind of automatic withholding, backup withholding, applies if you fail to give the casino a valid Social Security Number. In that case the casino withholds 24% on reportable winnings even when the usual $5,000 threshold is not met.3Internal Revenue Service. Topic No. 307, Backup Withholding Again, this is about collecting tax on the current winnings when the IRS cannot identify the taxpayer, not about enforcing an old debt. Giving your correct SSN avoids it.

And whether or not any form is filed, every dollar of gambling winnings is taxable income you are expected to report on your Form 1040. The IRS raised the W-2G reporting floor to $2,000 for most games starting in 2026, but the self-reporting obligation applies even to wins the casino never documents.4Internal Revenue Service. When the IRS Can Actually Seize Your Jackpot

The only way the government reaches into your winnings to pay off an old tax debt is through a Notice of Levy served directly on the casino.5Internal Revenue Service. Levy A levy is a legal seizure order. Once the casino has one in hand that identifies you and the amount, it is legally required to hand over the specified sum before paying you the rest.

The IRS cannot jump straight to a levy. Federal law requires a specific sequence first:6Office of the Law Revision Counsel. 26 USC 6331 – Levy and Distraint

  • The IRS assesses the tax and sends a Notice and Demand for Payment, giving you at least 10 days to pay.
  • If you do not pay, the IRS must send a written notice of its intent to levy at least 30 days before any seizure, delivered in person, left at your home or business, or sent by certified mail.
  • You receive a Final Notice of Intent to Levy that lays out your right to a Collection Due Process hearing, your appeal options, and alternatives such as an installment agreement.

Only after this plays out, and only when you have ignored the notices or failed to resolve the debt, can the IRS actually serve the casino. The one shortcut: if the IRS determines collection is in jeopardy, for instance because you are about to leave the country, it can skip the 30-day waiting period.

So the realistic answer to “can the casino keep my winnings because I owe taxes” is no, unless the IRS has already run through its notice process on an existing debt and sent a levy to that specific casino. If you have been receiving IRS notices and ignoring them, this is the point at which they catch up to you at the cage. If you have not received any such notices, a cashier is not going to invent one.

State tax agencies can serve their own levies for unpaid state income taxes, following a parallel process under state law.

What You Can Do If a Levy Hits at the Cage

Before a levy ever happens, the Final Notice of Intent to Levy gives you 30 days to request a Collection Due Process hearing with the IRS Independent Office of Appeals. At that hearing you can dispute the amount owed, propose a payment plan, or argue the levy is inappropriate. The IRS cannot proceed with the seizure while the hearing is pending.7Internal Revenue Service. Collection Due Process (CDP) FAQs This is the window where most problems get solved, which is why ignoring IRS mail is so costly.

If the levy has already happened and you believe it was wrong, say the debt was already paid, the amount was incorrect, or the IRS seized the wrong person’s property, you can file a wrongful levy claim. If the IRS still holds the money, there is no deadline to file. If the money has already been applied to your account, you have two years from the date of the levy.8Internal Revenue Service. Filing a Wrongful Levy Claim A successful claim means the IRS returns the money or credits you an equivalent amount.

State Interception for Child Support and Other Debts

Taxes are not the only reason winnings get diverted at the cashier. Many states require casinos to check a registry of people who owe past-due child support before paying out large jackpots. The trigger is typically the same as the W-2G reporting threshold, so a win that generates tax paperwork also gets screened. If your name comes up, the casino withholds the amount owed, up to the full jackpot, and sends it to the child support agency.

Some states extend this interception to other debts, including unpaid state taxes, defaulted student loans, and court-ordered restitution. The details vary. The pattern does not: the casino checks your name at payout and diverts the funds before you receive them. Unlike an IRS levy, which requires a specific seizure order served on that casino, these state programs work automatically through database matching. So while a casino will not freelance about your federal tax debt, state programs can and do intercept winnings at the window for a defined list of obligations.

A Note for Nonresidents

If you are not a U.S. resident, the structure is different. Casinos withhold a flat 30% on gambling winnings paid to foreign nationals, on the gross amount with no deduction for the wager.9Internal Revenue Service.
