The C09P EAD category means you’re holding a “combo card” — a single document that works as both your employment authorization and your advance parole travel permission while your green card application is pending. The “C09” portion points to the federal regulation covering people with a pending Form I-485 adjustment of status application, and the “P” signals that the card also lets you leave and reenter the United States. Who Qualifies for a C09P Combo Card
Eligibility comes from a single regulation, 8 CFR 274a.12(c)(9), which authorizes employment for anyone with a filed and pending Form I-485.1eCFR. 8 CFR 274a.12 – Classes of Aliens Authorized to Accept Employment Without an active I-485, you cannot receive this category designation. The underlying adjustment application must also meet INA 245(a): the applicant must have been inspected and either admitted or paroled into the United States.2U.S. Citizenship and Immigration Services. The “P” is what separates the combo card from a plain work permit. To get it, you have to file both Form I-765 (employment authorization) and Form I-131 (travel document) — either together with your I-485 or later, while the I-485 is pending.3U.S. Citizenship and Immigration Services. The card lives and dies with the I-485. If the adjustment application is denied or withdrawn, the work and travel authorization end. As of December 2025, newly issued combo cards under this category have a maximum validity of 18 months, down from the previous five-year maximum.4U.S. Citizenship and Immigration Services. How to File for the Combo Card
Forms and Supporting Documents
The package centers on two forms: Form I-765 and Form I-131.5U.S. Citizenship and Immigration Services. Standard supporting documents include:
- Your I-797C receipt notice for the pending I-485, showing the adjustment application is active.
- A government-issued photo ID, typically the biographical page of your passport or a previously issued EAD.
- Two passport-style photos meeting federal specifications for size, background, and facial positioning.
Any document not in English needs a full English translation with a signed certification from the translator confirming accuracy and completeness, along with contact information.
Filing Fees
Each form carries its own fee. The I-131 advance parole component, filed with a pending I-485, is $630 by paper or $580 online.7U.S. Citizenship and Immigration Services. Where to File
The correct mailing address depends on your eligibility category and where you live. USCIS uses a lockbox chart that routes filings to either its Phoenix or Dallas facility.9U.S. Citizenship and Immigration Services. The I-131 advance parole component for pending I-485 applicants can be filed online, but the I-765 under (c)(9) is not currently listed among the categories available for online submission.11U.S. Citizenship and Immigration Services. After You File
USCIS will issue a Form I-797C, Notice of Action, as your filing receipt.12U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action The receipt number lets you check case status online, and the received date fixes your place in the processing queue. USCIS may schedule a biometrics appointment at an Application Support Center, or it may reuse biometrics already captured for your I-485.
Once background checks clear and both applications are approved, the physical card arrives by mail. It displays “C09P” in the category field and includes a notation identifying it as an I-512 Advance Parole document. That single card authorizes you to work for any U.S. employer and to reenter the country after international travel for the duration of its validity.
Renewal and the End of the Automatic Extension
The rules changed in late 2025, and the date matters.
For I-765 renewals filed before October 30, 2025, a timely-filed renewal triggered an automatic extension of work authorization for up to 540 days past the card’s expiration or until USCIS decided the renewal.13U.S. Citizenship and Immigration Services. When an employer checks the category code on the expiring EAD against the receipt notice, they should disregard the “P” — the underlying C09 category is what governs extension eligibility.
For renewals filed on or after October 30, 2025, the automatic extension is gone.14Federal Register. File as early as USCIS rules allow. Waiting until the final months before expiration now creates a real risk of a gap. Traveling on the Advance Parole Side
The travel authorization built into a C09P card is powerful, and it carries risks that can cost you the entire adjustment case.
Never Travel Before the Card Is in Your Hand
If you leave the United States while the I-485 is pending but before advance parole is approved, USCIS will treat the I-485 as abandoned and deny it. You lose the filing fees, and you may not be able to return. Do not book international travel until the physical combo card or a separate approved advance parole document is in your possession.
Certain Visa Holders Have Another Option
Applicants who hold valid H-1B, H-4, L-1, or L-2 status can generally travel and reenter using that visa without needing advance parole, as long as they maintained status and return in the same classification. This is a meaningful carve-out for employment-based applicants. In other visa categories, advance parole is your only safe route out.
Advance Parole Is Not a Guaranteed Entry
Advance parole allows you to request entry at the border. Customs and Border Protection makes the final admissibility call at the port of entry, and issues with admissibility can result in denied entry even with a valid combo card.
Prior Unlawful Presence
People who accrued unlawful presence before filing the I-485 sometimes worry that leaving will trigger the three- or ten-year inadmissibility bars under INA 212(a)(9)(B). Under the BIA decision in Matter of Arrabally and Yerrabelly, departing on an approved advance parole document does not trigger those bars on return.15U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility Other admissibility grounds may still apply. If you have any history of unlawful presence, get legal advice before flying.
You Return as a Parolee, Not as Admitted
When you reenter on advance parole, you come back as a “parolee” rather than as someone who has been “admitted.” Under INA 245(a), both categories can adjust status, so this usually doesn’t block the green card.2U.S. Citizenship and Immigration Services. Chapter 2 – Eligibility Requirements It can matter if the I-485 is later denied or if removal proceedings begin, because a parolee is treated as an arriving alien. For most C09P holders the distinction never comes up; for those with complicated histories, it does.
Requesting a Social Security Number With the Application
Form I-765 has an optional section to request a Social Security number at the same time. If you don’t already have an SSN, checking that box means USCIS forwards your name, date of birth, parents’ names, country of birth, and sex to the SSA after the EAD is approved.16Social Security Administration. If it doesn’t, contact your local Social Security field office. Having the number in hand before starting a new job makes tax withholding and I-9 onboarding easier.
