The rules aren’t federal criminal law, but many municipalities adopt them as local code, and building outside the spec creates real liability exposure if a driver is hurt.
Post Size and Material
The FHWA, drawing on AASHTO’s “A Guide for Erecting Mailboxes on Highways,” sets a maximum wood post of 4 by 4 inches square or 4 inches in diameter. Metal supports must be standard-weight steel or aluminum pipe between 1.5 and 2 inches in diameter.1Federal Highway Administration. A 6 by 6 timber, a 3-inch pipe, a concrete post, or an improvised support like a concrete-filled milk can all turn the mailbox into a fixed obstacle, and the FHWA flags each of these as potentially dangerous.2United States Postal Service. Burial Depth and Concrete
Bury the post no more than 24 inches deep.3United States Postal Service. Mailbox Guidelines That’s enough to keep the post plumb against wind and daily use while still letting it shear off at ground level in a crash. Drive it 30 or 36 inches down and you’ve built a rigid lever that resists breakaway.
Concrete is where good installations go wrong. A thin collar of concrete near the surface, used to hold the post plumb while the soil settles, is generally acceptable. Encasing the full buried length in concrete is not. Neither is a large poured footing or a deadman anchor. The FHWA groups concrete posts with heavy metal pipes as examples of supports to avoid entirely.2United States Postal Service. Mailbox Supports Backfilling with tamped soil, or soil with a bit of gravel, gives you the grip you need without the crash risk.
Height, Setback, and Offset From the Road
USPS sets the position of the mailbox itself. The bottom of the box (or the mail slot on a locked design) must sit 41 to 45 inches above the road surface, and the door needs to be 6 to 8 inches behind the front face of the curb or the road edge.3United States Postal Service. On faster roads, the FHWA recommends a larger offset from the travel lane: 6 feet on roads at or below 40 mph, and 8 feet on roads above 40 mph, measured from the edge of the traveled way to the front of the mailbox.1Federal Highway Administration. WFL Standard W646-1 – Mailbox Turnout That offset is separate from the USPS curb setback. Your local transportation office may enforce a specific number, so check before you dig.
How the Mailbox Attaches to the Post
The mailbox must be securely fastened to the post so it doesn’t fly loose in a crash and become a projectile that could hit a windshield.2United States Postal Service. For pipe supports, an anti-twist plate keeps the box from rotating during normal use while still letting the assembly yield to crash forces. Anti-twist plates are made for pipe, not for wood. Use hardware sized to hold the mailbox steady through wind, snow load, and carrier handling, and no heavier.
Commercial breakaway kits go further with slip-base assemblies: flanged bases, shear bolts, and release bushings that separate at a set force. Any such system used on a public road should meet the safety criteria in the AASHTO Manual for Assessing Safety Hardware (MASH) or the older NCHRP Report 350.1Federal Highway Administration. Two or More Boxes on One Support
Shared supports follow the same breakaway rules. FHWA standard drawings show approved configurations using shelf platforms, clamp brackets, adapter plates, and support frames mounted on compliant posts.1Federal Highway Administration. For a cluster of four or more boxes, ask your local transportation office whether a dedicated turnout with an engineered support frame is required.
Call 811 Before You Dig
Call 811 or visit call811.com to have underground utilities marked before you excavate. The U.S. Department of Transportation identifies this as the single most important step in excavation safety and puts the success rate at 99 percent for callers avoiding a strike on buried lines.4U.S. Department of Transportation. Federal pipeline safety rules removed the old homeowner exemption. The Pipeline and Hazardous Materials Safety Administration found that homeowners digging without notifying 811 pose a significant damage risk to underground pipelines.5Federal Register. A 24-inch hole is more than deep enough to hit a shallow gas line.
Installing the Post
Confirm the location with your local post office first. Carrier routing dictates which side of the road the box belongs on and how it sits relative to your driveway, and USPS recommends contacting the office before installation.6United States Postal Service. USPS-STD-7B01 – Mailboxes, City Curbside Ask your local transportation department or public works office about permit and setback rules that go beyond the federal defaults. Some municipalities require a right-of-way encroachment permit for anything placed in the public right-of-way.
After the 811 markings come back, dig no deeper than 24 inches at the approved spot. Set the post plumb and check it with a level. Backfill in tamped layers of soil, or soil and gravel. If you use any concrete, keep it to a shallow collar near the surface.
Mount the mailbox with hardware appropriate to the post. Include an anti-twist plate on pipe supports. Tighten enough to hold the box firmly through daily use. Measure from the road surface to the bottom of the box and confirm 41 to 45 inches, with the door 6 to 8 inches behind the curb face.3United States Postal Service. What Happens if You Ignore the Rules
The FHWA guidelines are recommendations, not federal criminal law, and USPS says outright that it does not regulate support construction beyond carrier safety.2United States Postal Service. Mailbox Supports Local ordinances are the piece that bites: many jurisdictions adopt the FHWA and USPS standards as enforceable code, and violations bring fines and orders to remove or rebuild the installation.
Civil liability is the other exposure. Whether a homeowner owes a duty of care to a driver who leaves the road and hits a mailbox varies by state, and some courts have limited the duty to hazards affecting ordinary travel on the road surface. A homeowner who deliberately built an unusually fortified support faces a harder argument. Building to the FHWA spec costs no more than building outside it and removes the argument that you created a foreseeable hazard in the right-of-way. State highway agencies are separately directed by FHWA policy to incorporate breakaway support structures into their roadside safety policies for new construction and reconstruction,8Federal Highway Administration.
