Bedroom Tax Exemptions Over 60: State Pension Age and Disability

Being over 60 does not, by itself, exempt you from the bedroom tax. The bedroom tax exemptions over 60 that people often ask about only start once you reach your personal State Pension age, which for anyone born after 5 April 1960 is somewhere between 66 and 67. Until then, a spare bedroom in your social housing reduces your Housing Benefit or Universal Credit housing element by 14% for one spare room, or 25% for two or more. That said, several other exemptions can lift the deduction at any age, and it is worth checking each one before assuming you have to pay.

State Pension Age Is the Real Threshold

The bedroom tax only applies to tenants of working age. A separate set of Housing Benefit rules covers people who have reached the qualifying age for State Pension Credit, and those rules contain no spare room deduction.1Legislation.gov.uk. The Housing Benefit (Persons Who Have Attained the Qualifying Age for State Pension Credit) Regulations 2006 Once you (and your partner, if you have one) reach State Pension age, the bedroom tax stops applying.

State Pension age is no longer a flat 66. For people born between 6 April 1960 and 5 March 1961, it rises in monthly increments from 66 years and one month up to 66 years and 11 months. Anyone born after 5 March 1961 has a State Pension age of 67.2GOV.UK. State Pension Age Timetable You can check your exact date on the GOV.UK State Pension age calculator. The gap between turning 60 and reaching that date can be six or seven years, and the bedroom tax applies for every one of them.

Mixed-Age Couples Are Not Exempt

If one partner has reached State Pension age but the other has not, the couple is treated as working age for benefit purposes. The bedroom tax still applies. The exemption only covers households where both members of a couple have passed State Pension age.3GOV.UK. Universal Credit if Youre a Mixed Age Couple and Get Migration Notice Letters

Mixed-age couples being moved onto Universal Credit through migration notices carry the spare room deduction across when Housing Benefit ends. Narrow transitional protections exist for couples who have claimed Housing Benefit continuously as a mixed-age couple since 14 May 2019, but only if you claim by the deadline in your migration notice.3GOV.UK. Disability and Overnight Care Exemptions

Several disability-related situations entitle a household to extra bedrooms that do not count as spare, at any age. These are built into the size criteria, not discretionary awards.

There is no exemption for storage of medical equipment. If you need a room for a dialysis machine, oxygen equipment, or mobility aids, the regulations do not treat that room as occupied. The route in that situation is a discretionary financial help application to your council, and awards are not guaranteed.

Household and Service Exemptions

Some household changes and service commitments preserve a bedroom that would otherwise be counted as spare.

  • Foster carers. Approved foster carers are allowed one extra bedroom between placements, for up to 52 weeks from the end of the last placement. Newly approved carers who have not yet had a child placed with them get 52 weeks from the date of approval.5GOV.UK. Local Authorities and Advisers – Removal of the Spare Room Subsidy
  • Armed forces and reserves. A bedroom used by someone serving in the armed forces or reserves does not count as spare, provided they intend to return home.5GOV.UK. Local Authorities and Advisers – Removal of the Spare Room Subsidy
  • Students at university. A child away at university who intends to return home during holidays can still be counted as occupying a bedroom. Students in their second or third year who have signed a private tenancy elsewhere may not qualify.
  • Bereavement. When someone in your household dies, a bereavement run-on protects your benefit for up to three months, during which the bedroom tax does not apply. A further exemption from the spare room deduction can continue for up to 52 weeks from the date of death.

Property Types That Sit Outside the Rules

Certain kinds of housing are exempt regardless of who lives there or how many spare rooms exist.

Supported and Exempt Accommodation

If your landlord is a not-for-profit organisation that provides you with care, support, or supervision, your home is classified as exempt accommodation. This covers most sheltered housing schemes for older people and specialist housing for people with disabilities or mental health needs. The spare room rules do not apply.6GOV.UK. Housing Benefit Guidance for Supported Housing Claims

Shared Ownership and Temporary Accommodation

If you bought your home under a shared ownership scheme and pay part rent, part mortgage, the bedroom tax does not apply. Families placed in temporary accommodation by a council because of homelessness are also outside the rules.

Sanctuary Schemes for Domestic Abuse Survivors

Since October 2021, properties fitted with additional security measures under a sanctuary scheme are exempt from the spare room deduction. Three conditions apply: the security was installed because of domestic abuse against someone in the household, the abuser does not live at the property, and you provide written evidence from someone in an official capacity such as a police officer, social worker, or healthcare professional.7GOV.UK. A8/2021 – Domestic Abuse Support (Relevant Accommodation) and Housing Benefit and Universal Credit (Sanctuary Schemes) (Amendment) Regulations 2021

How Bedrooms Are Counted

Before worrying about exemptions, check whether you actually have a spare bedroom under the rules. You are allowed one bedroom for each of the following:

  • An adult couple, married or unmarried, sharing one room.
  • Any other adult aged 16 or over, each getting their own room.
  • Two children under 10, expected to share regardless of sex.
  • Two children of the same sex under 16, expected to share.
  • Any other child who does not fit the sharing categories.

If your home has more bedrooms than this formula produces, the extras count as spare and the deduction applies.5GOV.UK. Local Authorities and Advisers – Removal of the Spare Room Subsidy

When a Room Should Not Count as a Bedroom

Not every room labelled a bedroom by your landlord qualifies as one. A room too small to fit a single bed, or one used as a passageway to reach another room, may not count. If your tenancy agreement does not describe the room as a bedroom, that helps your case. Contact your landlord first; if they refuse to change the designation, raise it with your council. There is no fixed minimum size in the regulations, but councils have accepted challenges on rooms clearly not usable for sleeping.

Taking In a Lodger

If you claim Housing Benefit, taking in a lodger means the room they occupy stops being spare, which can eliminate or reduce the deduction. Under Universal Credit, the room still counts as spare even with a lodger in it. The lodger’s rent counts as income under both.

Challenging a Decision and Getting Financial Help

If you believe the bedroom tax has been applied incorrectly, you can challenge the decision. For Housing Benefit, ask your local council to look at the decision again. For Universal Credit, request a mandatory reconsideration through your online journal or by calling the helpline. You normally need to request this within one month of the decision date.

If the reconsideration does not go your way, you can appeal to an independent tribunal. The appeal is free, and you can present your case in person or on paper. Tribunals regularly overturn bedroom tax decisions where room size is disputed or a disability exemption has been refused.

For financial help while a challenge is ongoing, the route depends on where you live. In Scotland, discretionary housing payments are fully funded to cover the shortfall for every affected tenant, and the Scottish government has said it intends to abolish the bedroom tax entirely once it uses its devolved powers over housing costs in Universal Credit. In Wales, discretionary housing payments are available through local councils on a case-by-case basis.8GOV.UK. Applying for a Discretionary Housing Payment In England, discretionary housing payments have been replaced; tenants apply to their local council through the Crisis and Resilience Fund, with £25 million per year ring-fenced for disabled people living in significantly adapted accommodation.5GOV.UK. Whatever the route, gather evidence of your financial hardship, any medical needs, and why your current home is essential before you apply. These decisions are discretionary, and the strength of your evidence matters.
