Bank of America Double-Billing Class Action: Claims and Case Status

A proposed class action filed in November 2025, Sdoucos v. Bank of America, N.A., is the Bank of America double-billing class action now moving through federal court in Chicago. It alleges that when credit card customers enroll in autopay and choose the “Statement Balance” option, the bank’s system debits the full statement amount on the scheduled autopay date even if the customer has already paid the balance manually earlier in the cycle.1ClassAction.org. What the Lawsuit Says Happened

The named plaintiff, Nicholas Sdoucos, says he paid his credit card balance of $2,044.88 on October 21, 2025, bringing the account to zero. On November 10, 2025, Bank of America’s autopay still pulled another $2,044.88 from his linked Charles Schwab deposit account, matching the original statement balance as if the earlier payment had never posted.1ClassAction.org. Sdoucos v. Bank of America Complaint

When he called to stop the pending withdrawal, a bank representative allegedly told him Bank of America had implemented “new software which was not recognizing manual payments” and was “fielding calls from many Bank of America customers who were experiencing the same issue.”2ClassAction.org. Class Action Lawsuit Claims Bank of America Fails to Update Card Payments, Double-Charges Cardholders According to the complaint, the representative said nothing could be done to halt the automated second payment once scheduled. Affected customers are reportedly told to let the withdrawal go through and then pursue a refund, with no guarantee the money comes back.3Top Class Actions. A central point in the complaint is the wording Bank of America uses to describe the autopay choice: “This option will pay your statement in full.” The suit argues a reasonable customer reads that as a promise to settle whatever remains on the statement, not to debit a fixed dollar amount regardless of payments already made.1ClassAction.org. Who the Proposed Class Covers

Sdoucos is asking the court to certify a class of Bank of America credit card customers who meet all of the following conditions during the applicable statute of limitations period:

The complaint seeks class certification, damages, attorney fees, and a jury trial.3Top Class Actions. BofA Class Action Alleges Bank Double Bills Credit Card Customers No class has been certified yet, so there is nothing to claim and no settlement fund at this stage.

The Legal Claims

Because Bank of America’s cardholder agreement is governed by North Carolina law, the complaint brings four counts:

  • Violation of the North Carolina Unfair and Deceptive Trade Practices Act, alleging the double-debiting is oppressive and inconsistent with how competitors handle the same situation.
  • Violation of the North Carolina Debt Collection Act, alleging the bank uses “unconscionable means” to collect by charging for amounts already paid.
  • Breach of the implied covenant of good faith and fair dealing, based on the bank’s representation that payments are allocated to posted balances while it continues to debit the full statement amount even when the remaining balance is zero.
  • Unjust enrichment, based on the bank retaining funds in excess of what was owed and refusing to pay interest on those amounts.1ClassAction.org. Sdoucos v. Bank of America Complaint

How Other Card Issuers Handle Mid-Cycle Payments

The complaint argues Bank of America’s practice is “out of step with industry norms” and names Capital One, Chase, Wells Fargo, and Citi as competitors that handle autopay differently.1ClassAction.org. Sdoucos v. Bank of America Complaint Capital One, for example, tells cardholders that a manual payment made before autopay processes “will reduce the amount of your upcoming automatic payment.”4Capital One. How to Set Up AutoPay A customer who paid in full early under that approach would see the autopay adjusted down to zero rather than triggered for the original statement amount.

Where the Case Stands

Sdoucos filed on November 11, 2025, in the U.S. District Court for the Northern District of Illinois (Case No. 1:25-cv-13845).5Law360. Sdoucos v. Bank of America, N.A. As of mid-2026, there are no publicly reported updates regarding settlement discussions, an amended complaint, or a motion for class certification. The case remains in its early stages.3Top Class Actions. BofA Class Action Alleges Bank Double Bills Credit Card Customers

One boundary worth flagging: a separate 2024 case, Ruozzi v. Bank of America, N.A. (Case No. 1:24-cv-03783), targets a different autopay problem. It alleges the bank’s “Account Balance” option failed to withdraw the full amount due, leaving customers with interest charges they thought they had avoided.6ClassAction.org. Bank of America Facing Class Action Over Allegedly Deceptive Automatic Credit Card Payment Options If your issue was underpayment rather than a duplicate charge, that is the case to watch, not Sdoucos. As of early 2026, Ruozzi remained a proposed class action, and there is no indication it has been consolidated with the Sdoucos litigation.
