The Bakery and Confectionery Union and Industry International Pension Fund received approximately $3.4 billion in Special Financial Assistance from the Pension Benefit Guaranty Corporation in July 2024, a federal rescue that is projected to let the plan pay full benefits without reduction through 2051.1Pension Benefit Guaranty Corporation. Why the Fund Was in Trouble
The plan was classified as being in “critical status” starting in 2012 and dropped further to “critical and declining” status in 2015.3U.S. Department of Labor. Notice of Critical Status – Bakery and Confectionery Union and Industry International Pension Fund At the start of the 2023 plan year, the fund held $3.42 billion in assets against $7.29 billion in liabilities — a funded ratio of just 47%. By January 2023, only 14,664 active employees were paying in, supporting 55,895 retirees already drawing benefits and another 31,473 people with rights to future benefits.4BC Trust Funds. The sharpest single blow was the collapse of Hostess Brands. The fund expelled Hostess in December 2011 after the company fell more than 120 days behind on contributions and assessed it roughly $920 million in withdrawal liability.6Bloomberg Law. Court Denies Fund Priority Treatment of Pension Debt in Hostess Bankruptcy Hostess filed for Chapter 11 the following month, listing the fund as its largest unsecured creditor with a claim of $944 million.7American Bankruptcy Institute. Union Pension Health Funds Top Hostess Creditor List A federal court held that because the expulsion happened before the bankruptcy filing, the claim was general unsecured debt rather than a priority administrative expense, and the fund recovered little or nothing.
Without intervention, the fund was projected to run out of money by 2030. Insolvency would have forced benefit cuts of roughly 45%, reducing payments to the bare minimum the PBGC guarantees.1Pension Benefit Guaranty Corporation. What the 2024 Federal Rescue Changed
The American Rescue Plan Act of 2021 created the Special Financial Assistance program, which lets the PBGC make one-time grants to severely underfunded multiemployer plans designed to keep them solvent through 2051.8Pension Benefit Guaranty Corporation. The grant comes with conditions. The SFA money must be kept segregated from other plan assets and spent only on benefits and administrative expenses, and it must be invested in categories permitted by PBGC regulations — mostly investment-grade fixed income, with up to a third allowed in return-seeking assets such as publicly traded stocks.8Pension Benefit Guaranty Corporation. The fund’s zone status has improved from “critical and declining” back to “critical.” On March 31, 2025, the plan actuary certified it will remain in critical status through the plan year ending in 2051.3U.S. Department of Labor. Benefit Rules Still in Effect From the Rehabilitation Plan
The trustees adopted a rehabilitation plan on November 7, 2012, and most recently updated it in December 2024.9BC Trust Funds. Pension Fund Amended and Restated Rehabilitation Plan Several benefit changes it made still shape what you can collect and how:
- Lump-sum payments of $5,000 or more have not been available since April 30, 2012.
- Eligibility for early retirement and disability pensions requires 15 years of pension credit, raised from the previous 10-year threshold.
- The Social Security option, the 10-year certain option, and various subsidized joint-and-survivor forms were eliminated or restricted.
- Under the default schedule, benefit increases that took effect after January 1, 2007 are cancelled.
Contribution rate increases that employers had been making under the preferred schedule (5% per year compounded) and default schedule (10% per year) were suspended effective December 31, 2020, though any increases already in place before then remain.9BC Trust Funds. Golden 80 and Golden 90 Benefits
If you were counting on the fund’s Golden 80 or Golden 90 early retirement benefits — the tiers that let workers retire with full, unreduced pensions once their age plus service totaled 80 or 90 — the news is favorable. On July 1, 2010, the trustees amended the plan to require participants to be actively employed when they hit the qualifying total, which would have cut off former workers who had left covered employment but expected to grow into eligibility.10FindLaw. Chambers v. Bakery and Confectionery Union and Industry International Pension Fund
The Second Circuit struck that change down. In Chambers v. Bakery and Confectionery Union and Industry International Pension Fund, 750 F.3d 214 (2d Cir. 2014), the court held that the Golden 80 and Golden 90 benefits were “retirement-type subsidies” protected by ERISA’s anti-cutback rule and could not be stripped from workers who had already left their jobs.11Justia. Chambers v. Bakery and Confectionery Union, 750 F.3d 214 A related class action in the Northern District of California, Reyes v. Bakery and Confectionery Union and Industry International Pension Fund, settled in December 2017. Under that settlement, approved by Judge Jon S. Tigar, the fund was permanently barred from enforcing a nearly identical 2012 amendment against future claims and agreed to pay class members 37% of the benefits they would have received during May 2012 through May 2016.12vLex.
