BAH-Differential (BAH-DIFF): Rates, Eligibility, and Filing

BAH-DIFF, the Basic Allowance for Housing Differential, is a flat monthly payment for service members who live in government-assigned single-type quarters and pay child support for a child living elsewhere. In 2026 it ranges from about $159 to $466 per month depending on pay grade, and the amount does not vary by duty location. It exists because members housed in barracks or aboard ships receive no regular housing allowance, yet still owe support for their children.

Who Qualifies

Three conditions must all be true. You must be assigned to single-type government quarters (barracks, shipboard berthing, or similar unaccompanied housing). You must have at least one qualifying dependent child, biological, adopted, or stepchild. And your monthly child support payment must equal or exceed the BAH-DIFF rate for your pay grade.1Office of the Law Revision Counsel. 37 USC 403 – Basic Allowance for Housing

That third condition is where most claims fall apart. If your court-ordered support is even a dollar below your grade’s BAH-DIFF rate, you receive nothing. The allowance is not prorated. It is all or nothing.

A member who already receives standard BAH at the with-dependents rate does not qualify for BAH-DIFF. The differential is specifically for members who would otherwise receive no housing allowance, or only BAH-Partial, because the government houses them.1Office of the Law Revision Counsel. 37 USC 403 – Basic Allowance for Housing

Your child generally qualifies as a dependent until age 21. An unmarried child between 21 and 23 still counts if enrolled full-time at a college or university and you provide more than half of their financial support.2United States Marine Corps. Dual-Military Parents

When two service members share a child and one pays support to the other, federal law caps the combined housing allowances so the government does not pay double. The total BAH paid to both members cannot exceed what each would have received independently.1Office of the Law Revision Counsel. 37 USC 403 – Basic Allowance for Housing If the non-custodial member wants to claim the child for housing allowance purposes, both members must sign and notarize an agreement stating the non-custodial parent will pay support at or above the BAH-DIFF rate and the custodial parent will allow the child to be claimed for housing purposes.3Department of Defense. Your child support obligation must meet or exceed the rate for your current grade, not the grade you held when the court order was issued.

Why the Rates Look Uneven

BAH-DIFF uses a formula anchored to December 31, 1997, pay tables. For each grade, the base is the difference between the old Basic Allowance for Quarters (BAQ) with-dependents rate and the BAQ without-dependents rate on that date.1Office of the Law Revision Counsel. 37 USC 403 – Basic Allowance for Housing Each January, that figure rises by the same average percentage as the annual basic pay raise.3Department of Defense. That’s why an E-1 receives more than an E-3, and why a W-5 receives less than a W-2. The numbers reflect a pay structure from nearly three decades ago, not today’s rank hierarchy. It also explains why BAH-DIFF has no connection to local housing markets: a member at Fort Liberty gets the same rate as one at Joint Base Pearl Harbor-Hickam.

Rate Increases and Arrears

When BAH-DIFF rates rise at the start of a new year, you have 60 days to bring your support payments up to the new rate or lose the entitlement.3Department of Defense. Falling behind creates a separate problem. Payments toward arrears can count toward your support obligation, but only for the calendar year you actually make them, and only up to that year’s required amount. A lump sum in 2026 will not retroactively cover a gap from 2024 unless there was an active 2026 obligation the payment satisfied.3Department of Defense. One narrow exception: if the delay was caused by military mission requirements or actions by outside agencies beyond your control, as determined by your service branch’s regulations, late payments may count toward the period when support was originally owed.3Department of Defense. What to File

Each branch has its own dependency certification form. The Army uses DA Form 5960; the Marine Corps uses NAVMC Form 10922; the Air Force and Navy use their own equivalents. Your Personnel Office or Finance Office will tell you which one applies.

Along with the form, expect to submit:

  • A certified birth certificate for each child claimed as a dependent.
  • The court-ordered child support agreement showing the monthly amount and schedule.
  • Proof you are actually paying, such as bank records or payroll deductions.

If no court order exists, a written voluntary support agreement may be accepted, but it has to spell out the monthly amount and payment schedule and be signed by both parties and notarized. Property settlements and lump-sum payments in lieu of ongoing support only count for the specific periods the agreement covers.3Department of Defense. Once approved, payments typically appear on your Leave and Earnings Statement within one or two pay cycles. If nothing shows up after that, follow up with your admin office rather than waiting.

When BAH-DIFF Ends

Several changes terminate the entitlement:

  • Moving out of government quarters into private housing. You would typically transition to standard BAH instead.
  • Your child aging out at 21, or at 23 if they were a full-time student you primarily supported.2United States Marine Corps. MCO P1751.3F – Dependency Determination and Basic Allowance for Housing Manual
  • A court modification that reduces your support below the BAH-DIFF rate.
  • The underlying support obligation ending for any reason, including emancipation, adoption by another parent, or expiration of the order.

Report these changes to your Personnel Office promptly. Continuing to collect BAH-DIFF after a qualifying event ends results in recoupment of the overpayment.

What Happens If You Don’t Actually Pay

Collecting BAH-DIFF while failing to pay support carries real consequences. A member who does not support the dependent on whose behalf the allowance is paid loses the entitlement entirely, and the military will recoup every dollar of BAH-DIFF paid during the period of non-support. Forfeiting BAH-DIFF does not release you from the underlying support order. It remains enforceable. If a non-support complaint reaches your command, your branch may require proof that payments are current before any housing allowance continues.3Department of Defense. Tax Treatment

Like standard BAH, BAH-DIFF is excluded from federal gross income. It is not subject to federal or state income tax, and Social Security and Medicare taxes do not apply. The full amount for your pay grade is what you receive. On your Leave and Earnings Statement it appears in the entitlements section alongside other non-taxable allowances, not in the taxable pay block.
