Automatic visa revalidation lets most nonimmigrant visa holders re-enter the United States on an expired visa stamp after a trip of 30 days or less to Canada, Mexico, or, for some categories, adjacent Caribbean islands. The rule sits in 22 CFR 41.112(d) and 8 CFR 214.1(b), and it saves you from booking a consular appointment every time you leave the country briefly. It is also easy to lose. A single side trip to the wrong country, or one visa application filed while you are abroad, and the benefit is gone.
To qualify, every one of the following must be true:
- You have maintained your nonimmigrant status and intend to resume the same activity (same employer, same school, same program) when you return.
- Your I-94 admission period or approved extension is still current on the day you seek readmission.
- You are re-entering within 30 days of your departure. There is no grace period.
- You did not apply for a new nonimmigrant visa at any U.S. consulate during the trip.
- Your passport is unexpired.
Miss any one, and you need a valid visa stamp to come back.1eCFR. 22 CFR 41.112 – Validity of Visa
Where You Can Actually Go
For most nonimmigrant categories (H-1B, L-1, O-1, and similar), qualifying travel means Canada and Mexico only. F-1 students and J-1 exchange visitors also get adjacent islands in the Caribbean, a category that federal law defines to include places like the Bahamas, Bermuda, Jamaica, the Dominican Republic, and the Windward and Leeward Islands, among others.2Office of the Law Revision Counsel. 8 USC 1101 – Definitions Cuba is always excluded, even for F and J holders.1eCFR. 22 CFR 41.112 – Validity of Visa
M visa holders (vocational and technical students) get the narrowest version of the benefit: Canada or Mexico only. A trip to the Bahamas on an M visa is a trip that requires a fresh visa stamp to return.3U.S. Department of State. Automatic Revalidation
Any detour outside the approved list, including a connecting flight through a non-qualifying country, breaks the rule. If your itinerary touches somewhere it shouldn’t, plan on getting a new visa before coming home.3U.S. Department of State. Automatic Revalidation
Who Cannot Use It
Nationals of countries the State Department has designated as state sponsors of terrorism are excluded. The Department’s revalidation guidance names Iran, Syria, and Sudan;3U.S. Department of State. Automatic Revalidation Cuba and North Korea also appear on the broader state sponsors list.4U.S. Department of State. State Sponsors of Terrorism If you are a national of any of these countries, you need a valid, unexpired visa to enter the United States, regardless of trip length.
You are also out if you fell out of status before leaving, or if your authorized admission period expired while you were abroad. Automatic revalidation only applies to travelers still inside a valid admission window.1eCFR. 22 CFR 41.112 – Validity of Visa
The Visa Application Trap
This is where careful travelers get stuck. If you file a new nonimmigrant visa application at a U.S. consulate while you are in Canada, Mexico, or an adjacent island, automatic revalidation ends the moment you apply. Pending, approved, denied, withdrawn: none of it matters. The application itself is disqualifying.3U.S. Department of State. Automatic Revalidation
The worst version of this: you apply hoping to renew while you’re nearby, get denied or hit with administrative processing, and now you cannot return on the old expired stamp either. Your only way back is a new visa, on the consulate’s timeline, which can run weeks or months.3U.S. Department of State. Automatic Revalidation If the trip is short, come home first. Renew the stamp on a separate trip you can afford to extend.
What to Carry
Bring all of it, and check it before you leave.
Passport. Must be unexpired at re-entry. CBP’s general expectation is validity for six months beyond your intended stay, though the United States has bilateral agreements with many countries that waive that buffer, in which case validity through the stay is enough.5U.S. Customs and Border Protection. Six-Month Passport Validity Update
The expired visa stamp itself. The physical stamp is what the CBP officer uses to verify your prior classification. If it lives in an old passport, bring the old passport with you along with the current one.6U.S. Customs and Border Protection. Technical Requirements for Passports

Status-specific paperwork. F-1 students need a valid Form I-20 with a travel signature from a Designated School Official dated within the past year, or within six months if you are on OPT, and the program end date must still be in the future. J-1 exchange visitors need a valid DS-2019 with a Responsible Officer’s travel signature under a year old and current program dates. H-1B, L-1, O-1, and other petition-based travelers need the most recent Form I-797 approval notice, especially if you changed employers or extended status while inside the United States.
If your name has changed since any of these documents were issued, bring the marriage certificate or court order. Mismatches slow things down and sometimes stop them.
At the Port of Entry
The CBP officer will check your passport, the expired visa, your I-94, and your status documents, and will confirm the trip stayed under 30 days and touched only qualifying destinations. Most of this is verified electronically.9U.S. Customs and Border Protection. Automatic Revalidation for Certain Temporary Visitors A referral to secondary inspection is not unusual; officers there have fuller records and can clear flags the primary screening surfaces. Once you are admitted, your electronic I-94 is updated with a new admission date.
If you cross at a land border and CBP issues a new I-94, there is a $30 fee, payable through Pay.gov by credit card, debit card, or PayPal. This applies to both paper and electronic issuance and to provisional I-94 applications filed online or through the app.10U.S. Customs and Border Protection. I-94 – Payment Process
Airlines Are a Separate Problem
Gate agents check visas, and not all of them know automatic revalidation exists. Travelers have been refused boarding on expired stamps despite qualifying for the rule. Print the State Department and CBP guidance and carry it with your documents. If an airline still will not board you, a land crossing is the fallback when geography allows.
A Note on Pending Green Card Applications
Automatic revalidation is a nonimmigrant readmission rule. It does nothing for a pending Form I-485. If you leave the United States with an adjustment of status application on file and no advance parole, USCIS can treat that application as abandoned, and the revalidation rule will not save it. Talk to an immigration attorney before any international travel while an I-485 is pending, including a weekend in Toronto.
