The automatic EAD extension still exists, but only for renewals filed before October 30, 2025. On that date, the Department of Homeland Security eliminated automatic extensions of Employment Authorization Documents for any renewal filed on or after October 30, 2025.1Federal Register. Removal of the Automatic Extension of Employment Authorization Documents If your Form I-765 was already on file before that date and you hold a qualifying category, your work authorization can continue for up to 540 days past your card’s expiration while USCIS decides. File on or after October 30, 2025, and you get nothing automatic. When your card expires, so does your right to work, until a new card is issued.
What DHS Changed on October 30, 2025
DHS published an interim final rule (90 FR 48799) adding a new paragraph (e) to 8 CFR 274a.13. That paragraph removes the automatic extension for renewal applications filed on or after October 30, 2025.1Federal Register. Removal of the Automatic Extension of Employment Authorization Documents The prior rule at 8 CFR 274a.13(d) was preserved and retitled so it now covers only renewals filed before that cutoff.
Two carve-outs survive the change. Temporary Protected Status holders can still get their employment documentation extended through country-specific Federal Register notices, even for filings after October 30, 2025.2U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization And F-1 students filing STEM OPT extensions have a separate 180-day automatic extension that sits outside this framework (covered below).
If You Filed Before October 30, 2025
A timely-filed Form I-765 renewal that was pending on October 29, 2025, or earlier, can extend work authorization for up to 540 days beyond the “Card Expires” date on the face of the EAD.3U.S. Citizenship and Immigration Services. Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization The extension runs until whichever comes first: USCIS decides your case, or the 540 days elapse.
To find your outer date, add 540 days to the expiration printed on your card. Working past that date without a new EAD in hand can be treated as unauthorized employment, so track it carefully. The 540-day figure became permanent in a December 2024 final rule (89 FR 101208) that replaced the earlier 180-day default.4E-Verify. Which Eligibility Categories Qualify
Even for pre-October 30 filings, the automatic extension applies only if your EAD category code is on the qualifying list. Check the code printed on the front of your card. The qualifying codes are A03, A05, A07, A08, A10, A12, A17, A18, C08, C09, C10, C16, C19, C20, C22, C24, C26, and C31.5U.S. Citizenship and Immigration Services. Employment Authorization Document (EAD) Automatic Extension Calculator (Archived) These cover refugees (A03) and asylees (A05); pending asylum (C08), pending adjustment (C09), and pending cancellation or suspension (C10); TPS approved (A12) and pending (C19); E, L-2, and H-4 dependent spouses (A17, A18, C26); and other groups such as N-8/N-9 nonimmigrants (A07), citizens of Micronesia, the Marshall Islands, or Palau (A08), withholding of removal (A10), record of lawful permanent residence (C16), certain adjustment categories (C20, C22), CNMI residents (C24), and VAWA self-petitioners (C31).
The category on your expiring card must match the category on your Form I-797C receipt notice. The only mismatch USCIS accepts is between A12 and C19: an A12 card with a C19 receipt (or the reverse) still qualifies.4E-Verify. Extra Requirement for H-4, L-2, and E Dependent Spouses
If your category is C26 (H-4), A18 (L-2), or A17 (E), you need one more document: an unexpired Form I-94 reflecting your current derivative status, with a class of admission such as H-4, E-1S, E-2S, E-3S, or L-2S.6U.S. Citizenship and Immigration Services. Chapter 2 – Employment Authorization for Certain H-4, E, and L Nonimmigrant Dependent Spouses
The extension for these spouses ends on the earliest of three dates: the 540-day cap, USCIS’s decision on the renewal, or the expiration of the I-94.6U.S. Citizenship and Immigration Services. Chapter 2 – Employment Authorization for Certain H-4, E, and L Nonimmigrant Dependent Spouses If the principal spouse’s status lapses, so does yours. Watch the principal’s petition timeline as closely as your own.
What to Show Your Employer
For Form I-9 purposes, a worker relying on an active automatic extension presents two documents together: the expired EAD card and the Form I-797C receipt notice showing a timely-filed renewal in the same eligibility category.3U.S. Citizenship and Immigration Services. Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization H-4, L-2, and E spouses add the unexpired I-94.
Your employer records the extended expiration date on your I-9 and must accept the combination when the categories and dates line up. Asking for extra documents beyond what the I-9 rules require can amount to document abuse under 8 U.S.C. 1324b.7Office of the Law Revision Counsel. 8 USC 1324b – Unfair Immigration-Related Employment Practices
If You Filed on or After October 30, 2025
No automatic extension applies. When the expiration date on your current EAD passes, you are not authorized to work until USCIS issues a new card.2U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization USCIS processing times have often exceeded six months, so a gap is a real possibility.
USCIS suggests filing as early as 180 days before your card expires.2U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization Early filing helps but does not guarantee that the new card arrives in time. Plan for a possible unpaid period and talk with your employer well before your card expires. Once your EAD expires with no extension in place, your employer cannot keep you on payroll and must update your I-9, which usually means suspension or termination until the replacement card arrives.
STEM OPT Has Its Own Extension
F-1 students filing the 24-month STEM OPT extension operate under a different regulation. If you file Form I-765 on time and your current OPT expires while the application is pending, USCIS automatically extends work authorization for up to 180 days, ending as soon as USCIS decides the case.8U.S. Citizenship and Immigration Services. Optional Practical Training Extension for STEM Students File up to 90 days before your current OPT expires and within 60 days of your designated school official entering the recommendation in SEVIS. Because this extension sits in the F-1 STEM rules rather than 8 CFR 274a.13(d), the October 2025 change did not touch it.
If USCIS Denies the Renewal
An active automatic extension ends on the date USCIS denies the renewal. Any remaining days in the 540-day window disappear with the denial, and your employer must update the I-9 to reflect that your work authorization has ended.
A Request for Evidence is not a denial. While you are responding to an RFE, the application is still pending and the automatic extension generally continues. Ignore the RFE and the resulting denial ends the extension the same way any other denial would. If you receive a denial, an immigration attorney can help you weigh a motion to reopen against filing a new application.
