If you have an asylum case pending, you can apply for an asylum work permit by filing Form I-765 under eligibility category (c)(8), but USCIS cannot approve it until your asylum application has been on file for at least 180 days. You may submit the work permit application 30 days earlier, at the 150-day mark. As of December 2025, approved cards are valid for a maximum of 18 months rather than the five years USCIS previously granted, so renewals come around more often and timing matters more than it used to.
Who Qualifies
You are eligible if you have a complete Form I-589 asylum application pending with USCIS or the immigration court and no decision has been issued.1eCFR. 8 CFR 274a.12 – Classes of Aliens Authorized to Accept Employment That is what the (c)(8) category covers.
One conviction ends the analysis: anyone convicted of an aggravated felony is ineligible for an asylum-based work permit, no matter how long the case has been pending.2eCFR. 8 CFR 208.7 – Employment Authorization
How the 180-Day Clock Works
The 180-day clock starts when USCIS or the immigration court receives your complete Form I-589. You can file the I-765 after 150 days have passed, but USCIS will hold approval until the full 180 days are up.2eCFR. 8 CFR 208.7 – Employment Authorization
Anything you do that delays your case pauses the clock. Rescheduling an asylum interview, missing a fingerprint appointment, or sitting on a request for evidence all freeze the count. The clock stays frozen from the day USCIS issues a request for evidence until the day your response arrives.
Missing an interview or court hearing is different. If you fail to appear without exceptional circumstances, you lose EAD eligibility entirely — not paused, gone.2eCFR. 8 CFR 208.7 – Employment Authorization
Filing Form I-765
The application is Form I-765, Application for Employment Authorization, on the USCIS website.3U.S. Citizenship and Immigration Services. Along with the form, send:
- A copy of the receipt notice for your Form I-589, showing your asylum case is pending.
- Two identical passport-style color photos, 2 inches by 2 inches, on a white or off-white background, head bare unless religious practice requires a covering.5U.S. Citizenship and Immigration Services. Form I-765 Instructions for Application for Employment Authorization
- A copy of a government-issued photo ID such as your passport.

Make sure your name, address, and identifiers match on every page and every document. Mismatches and unreadable copies get applications rejected.
The initial (c)(8) application has no government filing fee.7Federal Register. Employment Authorization Reform for Asylum Applicants Renewals can carry a fee; check the current USCIS fee schedule for Form I-765 before filing a renewal, since fees were restructured in early 2026.

What Happens After You File
USCIS sends a receipt notice (Form I-797C) with your case number. Keep it. It is your proof that the application is pending.
USCIS may schedule a biometrics appointment at a local Application Support Center for fingerprints and a photograph.8U.S. Citizenship and Immigration Services. Skipping it without rescheduling in advance is grounds for USCIS to treat the application as abandoned and deny it.9U.S. Citizenship and Immigration Services. After biometrics, an officer confirms the 180 days have run and reviews the application. USCIS reported completing over 86 percent of initial (c)(8) applications within 30 days and over 98 percent within 60 days as of early 2025.7Federal Register. How Long the Card Lasts, and Renewals
Starting December 5, 2025, USCIS caps asylum-based EAD validity at 18 months. That applies to initial and renewal applications pending or filed on or after that date.10U.S. Citizenship and Immigration Services. USCIS Increases Screening, Vetting of Aliens Working in U.S. Asylum cases routinely stretch across years, so most applicants will renew more than once.
The old automatic extension is gone. Filing a timely renewal used to keep you working for up to 540 days while USCIS processed the new card. Anyone filing a renewal on or after October 30, 2025 does not get that extension; only renewals filed before that date may still qualify.11U.S. Citizenship and Immigration Services. File your renewal as early as the I-765 instructions allow, and build in current processing times. If the current card expires before the new one is approved, your work authorization stops on the expiration date and your employer must stop letting you work, regardless of tenure.
Getting a Social Security Number
The card alone is usually not enough to start a job; most employers also need a Social Security number. Once your EAD arrives, apply at a local Social Security Administration office. The application is free. Your EAD (Form I-766) can serve as both identity and work-authorization proof, but SSA requires a second document such as an unexpired foreign passport or a birth certificate.12Social Security Administration. Mistakes That Can Cost You the Permit
Report an Address Change Within 10 Days
If you move, tell USCIS within 10 days, either online through your USCIS account or by paper Form AR-11.13U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card An outdated address is how people miss biometrics notices, interview letters, requests for evidence, and even the physical card itself. Any of those can sink the application.
Do Not Work Before the Card Is Approved
Working without authorization, even one day before the EAD is issued, can permanently bar you from adjusting to lawful permanent resident status through most pathways.14U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7 Part B Chapter 6 – Unauthorized Employment Leaving the country and returning does not erase the bar. A few categories, such as immediate relatives of U.S. citizens, are exempt; most asylum seekers are not.
If Your Asylum Case Is Denied
A denial does not automatically end your work authorization the same day. What happens depends on who denied it and whether you appeal:
- Asylum officer denial: the EAD expires on the later of the date printed on the card or 60 days after the denial.
- Immigration judge or appellate court denial with no appeal filed: the EAD expires on the date printed on the card.
- Denial with a timely appeal to the Board of Immigration Appeals or federal court: work authorization runs through the card’s printed expiration date, and you can file a renewal when it expires.2eCFR. 8 CFR 208.7 – Employment Authorization
If you plan to appeal, file on time. Missing the appeal deadline lets your work authorization die with the card.
A Proposed Rule That Could Change the Wait
In February 2026, the Department of Homeland Security published a proposed rule, “Employment Authorization Reform for Asylum Applicants,” that would extend the waiting period from 180 to 365 days, add eligibility requirements, and let USCIS pause acceptance of initial asylum EAD applications entirely when average processing times for affirmative asylum cases exceed 180 days.7Federal Register. Nothing in the proposal is in effect yet, but if you have a pending or upcoming asylum case, watch whether it is finalized. It would sharply lengthen the wait for work authorization.
