There is no single deadline. Each trust sets its own filing window, typically one to four years from diagnosis or death. How Much You Can Actually Receive
Trusts don’t pay the full scheduled value of a claim. The overall direction has been downward as claims accumulate. Motors Liquidation Company (General Motors) dropped from 12.2% to 10.3% in March 2026. How the Claim Process Works
Trusts offer two review tracks. Under expedited review, the trust matches your claim against standard criteria and, if it qualifies, pays a predetermined amount based on the disease category. Trusts That Don’t Yet Exist
Some high-profile companies commonly associated with asbestos or asbestos-adjacent litigation have not established operational trusts, so filing against them is not currently an option.
Johnson & Johnson’s effort to resolve more than 100,000 talc-related lawsuits through a bankruptcy trust has repeatedly failed. A Houston bankruptcy judge rejected the company’s third proposed plan in 2025, citing voting irregularities and concerns over nonconsensual liability releases. As of mid-2026, no trust is in place, and J&J is defending individual lawsuits, with more than 68,000 cases pending in the federal multidistrict litigation alone.17Drugwatch. Georgia-Pacific, a Koch Industries subsidiary, created a shell company called Bestwall LLC in 2017 to absorb its asbestos liabilities and file for bankruptcy. CertainTeed used a similar approach in 2019 through a subsidiary called DBMP LLC, effectively pausing roughly 60,000 pending lawsuits. As of early 2026, the reorganization plan and trust remain under development.20Justia. Herlihy v.
