Are Spark Drivers Independent Contractors or Employees?

Walmart classifies Spark drivers as independent contractors, not employees. That answers the core question of whether Spark drivers are independent contractors or employees, but the label carries real weight: you handle your own taxes, pay for your own vehicle and insurance, and receive no health coverage, paid leave, or workers’ compensation. In exchange, you set your own hours and choose which delivery offers to accept.

Whether that classification would hold up under scrutiny is a separate question. Federal agencies and some states apply their own tests that look past the contract to the real working relationship.

What Contractor Status Changes for You

Operating as an independent contractor means you are running a one-person business, not working for Walmart. You get no guaranteed minimum wage, no employer-sponsored health insurance, no paid sick leave, and no retirement benefits. Walmart does not withhold income tax or payroll tax, so all tax obligations land on you.

You also cover the tools of the trade. That includes a personal vehicle, fuel, a smartphone and data plan, and your own auto insurance. Walmart does not reimburse those costs, and it does not provide workers’ compensation if you are injured on a delivery. The benefit on the other side of the ledger is control over your schedule: you decide when to log in, which offers to take, and which to skip.

The Agreement You Sign to Drive

Before accepting deliveries, you sign the Spark Driver App Terms of Use. Agreeing to it formally establishes your independent contractor status, confirms you are not eligible for company benefits, and acknowledges that you supply your own equipment and vehicle.

To qualify for the platform, you must meet several requirements:1Walmart. Spark Driver App Terms of Use

  • Be at least 18 years old.
  • Hold an unexpired, valid driver’s license issued by a U.S. state.
  • Show proof of auto insurance listing your name, an expiration date, and the vehicle.
  • Use a street-legal, registered car, van, or truck. Scooters, bicycles, and skateboards do not qualify. The vehicle must be clean, smoke-free, and large enough to keep orders separate and free from contamination.
  • Verify your identity with a selfie and your driver’s license.

Walmart runs a background check through a third-party screening service, and serious criminal offenses or significant driving violations can disqualify you. You are expected to keep your license and insurance current; if either expires, your account can be placed under review.

A signed contract matters, but it is only one piece of evidence. Courts and agencies can still look at how the work actually happens.

How Agencies Test Whether the Classification Is Real

Two federal frameworks and, in some states, a stricter state test evaluate whether a worker is genuinely an independent contractor. Each looks at the substance of the relationship rather than the label in the contract.

The Department of Labor Economic Reality Test

Under the Fair Labor Standards Act, the Department of Labor uses an economic reality test that asks whether a worker is economically dependent on the company or genuinely in business for themselves.2U.S. Department of Labor. Regardless of which version applies, the core factors are similar. The DOL weighs your opportunity for profit or loss based on your own decisions, such as which offers you accept and how you manage expenses. It considers whether your investment in a vehicle and tools looks entrepreneurial or is simply a cost the company shifted to you. It also looks at whether the relationship is ongoing and exclusive, which points toward employment, or project-based and sporadic, which points toward contractor status.3Federal Register. If the DOL finds a company misclassified employees as contractors, the company can owe back wages and overtime. FLSA-covered employees are entitled to at least $7.25 per hour and overtime at one and a half times their regular rate for hours beyond 40 in a workweek.2U.S. Department of Labor. The IRS Right-to-Control Test

The IRS uses a different test focused on control and independence, organized around three categories of evidence.4Internal Revenue Service. Independent Contractor (Self-Employed) or Employee

Behavioral control asks whether the company directs how, when, and where the work happens. Letting drivers pick their own routes and methods without detailed instructions supports contractor status. Requiring specific sequences or tools looks more like employment.

Financial control looks at the business side: how you are paid, whether expenses are reimbursed, and who supplies the tools. Independent contractors typically carry unreimbursed expenses and are free to work for competing platforms simultaneously.5Internal Revenue Service. The type of relationship covers written contracts and the absence of employee-type benefits like pensions or vacation pay. A written contract labeling you a contractor helps establish intent, but it will not override actual working conditions that look like traditional employment.6Internal Revenue Service. The State ABC Test

Roughly two dozen states apply an ABC test that presumes a worker is an employee unless the company proves all three of the following:

  • The worker is free from the company’s control over how the work is performed.
  • The work falls outside the company’s usual business activities.
  • The worker is independently established in that trade.

The second prong is the hardest for gig delivery platforms. Delivering goods to customers is arguably the core of what these companies do, which makes it difficult to argue drivers operate outside the company’s usual business. Penalties for misclassification vary by state, and some require companies to pay back benefits and contribute to state unemployment and disability insurance funds. Your rights as a Spark driver depend partly on where you drive.

Taxes You Owe as a Contractor

Because no taxes are withheld from your Spark earnings, you handle reporting and payment yourself. If you earn $600 or more in a calendar year, Walmart sends you a Form 1099-NEC by January 31 of the following year. You owe taxes on all net earnings whether or not you receive a 1099.

Self-Employment Tax

Your net Spark earnings are subject to a 15.3% self-employment tax, which funds Social Security (12.4%) and Medicare (2.9%).7Internal Revenue Service. Quarterly Estimated Payments

You are generally expected to make quarterly estimated tax payments to avoid an underpayment penalty. For the 2026 tax year:9Internal Revenue Service. Estimated Tax

  • April 15, 2026, for income earned January through March.
  • June 15, 2026, for income earned April through May.
  • September 15, 2026, for income earned June through August.
  • January 15, 2027, for income earned September through December.

Deductible Expenses

Careful expense tracking meaningfully reduces your taxable income. Common Schedule C deductions for Spark drivers include:

  • Mileage. For 2026, the IRS standard mileage rate is 72.5 cents per business mile. You can use this rate instead of tracking actual costs like gas, oil, and repairs. Parking and tolls are deductible on top of the mileage rate. Pick one method and keep a log of business miles either way.11Internal Revenue Service.   • Phone and data. Only the business-use portion of your smartphone and data plan is deductible.
  • Supplies. Insulated delivery bags, phone mounts, and car chargers bought for delivery work are deductible in the year of purchase.
  • Other ordinary and necessary costs directly tied to deliveries.

A simple log noting the date, destination, business purpose, and miles for each trip is enough if you claim the standard mileage rate. Keep receipts for the rest.

Separately from the 1099-NEC, payment processors file a Form 1099-K when your gross payments through a third-party network exceed $20,000 across more than 200 transactions in a year.12Internal Revenue Service. Insurance and Health Coverage Gaps

Most personal auto policies exclude claims that arise while you are using your vehicle for commercial delivery. If you get into an accident carrying a customer’s groceries and your insurer determines you were on a delivery, your claim may be denied.

A rideshare or delivery endorsement is an add-on to a personal auto policy that extends coverage to delivery periods. Endorsements are typically less expensive than a standalone commercial policy and cover the situations a standard personal policy would exclude.13NAIC. Because Walmart does not offer health coverage to Spark drivers, you can buy a plan through the Health Insurance Marketplace. Eligibility for premium tax credits is based on your estimated net self-employment income for the coverage year, not last year’s earnings.14HealthCare.gov. Health Coverage for Self-Employed Individuals If your income shifts through the year, update your Marketplace application so your subsidy stays accurate. A few states let independent contractors opt into voluntary disability and paid family leave programs for an added cost.

What the 2026 FTC Settlement Did and Did Not Change

In February 2026, Walmart agreed to a $100 million judgment to settle charges brought by the Federal Trade Commission and eleven states. The FTC alleged Walmart showed drivers inflated base pay and tip amounts in the Spark app, falsely told customers that 100% of tips would go to the driver, and reduced driver pay without adequate notice when it removed orders from batched deliveries. Drivers often learned about the reduced earnings only after completing the delivery. The FTC also alleged Walmart advertised incentive bonuses, such as referral rewards, while failing to disclose all the conditions a driver had to meet.15Federal Trade Commission. The settlement did not change Spark drivers’ independent contractor status. It is a signal to track your own earnings and compare the numbers shown in the app to what actually lands in your deposits.
