Are Saturday and Sunday Considered Business Days?

No. Saturday and Sunday are not considered business days under the definition used by federal agencies, banks, courts, and most private businesses. A business day runs Monday through Friday, and federal holidays are excluded from the count as well.1eCFR. 31 CFR 800.203 – Business Day A handful of specialized rules treat Saturday differently, and those are worth knowing before you rely on the standard count.

The Standard Definition

Federal law recognizes eleven public holidays that also drop out of the business day count: New Year’s Day, Martin Luther King Jr.’s Birthday, Washington’s Birthday, Memorial Day, Juneteenth National Independence Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day.2Office of the Law Revision Counsel. 5 USC 6103 – Holidays When one falls on a Saturday, the preceding Friday is treated as the observed holiday. When one falls on a Sunday, the following Monday is the observed date. Either way, an extra weekday drops off in holiday weeks.

What Happens When a Deadline Lands on a Weekend

Most legal and tax deadlines that fall on a Saturday or Sunday roll forward to the next business day.

For federal taxes, if the last day to file a return, make a payment, or take any other required action lands on a Saturday, Sunday, or legal holiday, you are on time if you complete the action by the next day that is not a Saturday, Sunday, or legal holiday.3Office of the Law Revision Counsel. 26 USC 7503 – Time for Performance of Acts Where Last Day Falls on Saturday, Sunday, or Legal Holiday The IRS treats holidays observed in the District of Columbia as legal holidays too, which occasionally adds a day beyond the standard federal list, such as D.C. Emancipation Day on April 16.4Internal Revenue Service. Publication 509 (2026), Tax Calendars Payroll tax deposits get the same weekend and holiday extension.5Internal Revenue Service. Employment Tax Due Dates One narrow exception exists for certain excise tax deposits, where a Saturday due date moves backward to the preceding Friday.

Federal courts work the same way for civil deadlines. Under Rule 6 of the Federal Rules of Civil Procedure, you count every day in a period, weekends and holidays included, but if the last day falls on a Saturday, Sunday, or legal holiday, the deadline extends to the end of the next day that is not one of those. The same extension applies if the clerk’s office is inaccessible on the final day.6Cornell Law School. Federal Rules of Civil Procedure Rule 6 – Computing and Extending Time; Time for Motion Papers If you have a 30-day window to respond to a complaint and day 30 is a Saturday, filing by the end of Monday is timely (as long as Monday is not a holiday). Miscounting weekend days on a court deadline can produce a default judgment, so the counting method deserves a careful look.

Banking Timing Costs Real Money

The gap between business days and calendar days is where weekend confusion turns expensive.

The Federal Reserve’s Fedwire Funds Service, which handles wire transfers between banks, treats every Saturday, Sunday, and Federal Reserve holiday as a non-business day.7Federal Reserve Financial Services. Fedwire Funds Service and National Settlement Service Operating Hours ACH transfers, the system behind direct deposits and most bill payments, run on the same schedule. A transfer submitted Friday evening sits in a queue until Monday.

Check deposits behave similarly under Regulation CC, which defines a business day as any calendar day other than a Saturday, Sunday, or federal holiday. Deposit a check at an ATM on Saturday and the bank treats it as received on the next banking day, usually Monday.8eCFR. 12 CFR Part 229 – Availability of Funds and Collection of Checks (Regulation CC) The funds availability clock does not start ticking until then.

If you have payments clearing over the weekend but your deposit does not register until Monday, you can trigger overdraft fees, often around $35 per transaction.9Consumer Financial Protection Bureau. Overdraft Fees Can Price People Out of Banking

One newer system breaks this pattern. The Federal Reserve’s FedNow Service, which launched in July 2023, operates as a 24-hour business day every day of the week, weekends and federal holidays included.10Federal Reserve. FedNow Service Participating banks and credit unions can send and receive instant payments at any time. Adoption is not universal yet, so whether you can use it depends on your institution.

The Mortgage Rescission Exception

This is the one place where the standard answer flips. When you refinance a mortgage or take out a home equity loan on your primary residence, federal law gives you a three-business-day right to cancel the transaction. For rescission purposes, the Truth in Lending Act defines “business day” as all calendar days except Sundays and the federal holidays listed in 5 U.S.C. ยง 6103.11Consumer Financial Protection Bureau. Section 1026.2 – Definitions and Rules of Construction Saturday counts as a business day.

The rescission period runs until midnight of the third business day after closing, delivery of required disclosures, or delivery of the rescission notice, whichever happens last. The official commentary gives this example: if your transaction closes on a Friday and disclosures were delivered beforehand, the three business days are Saturday, Monday, and Tuesday, and your right to cancel expires at midnight Tuesday.12Consumer Financial Protection Bureau. Section 1026.23 – Right of Rescission Assume a standard Monday-through-Friday count and you would think you had until Wednesday, and you would be a day late.

Shipping Estimates Run on Business Days

When a carrier advertises “two-day shipping,” the estimate almost always refers to two business days rather than two calendar days. An order placed on Friday afternoon typically will not arrive until Tuesday at the earliest.

USPS Priority Mail is a partial exception. It delivers six days a week, Saturdays included, with an estimated delivery of two to three business days, though USPS does not guarantee those dates. The first business day counted toward delivery is the day after the item is mailed, not the mailing date itself.13USPS. What Is Priority Mail Priority Mail Express offers one-to-three-day delivery with a money-back guarantee and runs nearly every day of the year.14USPS. Priority Mail Express Shipping

Private carriers like FedEx and UPS base standard timelines on business days while offering premium tiers that may include Saturday delivery. If you are paying for expedited service, confirm with the carrier whether Saturday counts toward the delivery commitment for that tier and destination.

When a Contract Just Says “Days”

Not every deadline you encounter will specify business days or calendar days. Leases, insurance policies, and vendor contracts sometimes refer simply to “days.” In most commercial contexts, unqualified “days” means calendar days, which includes Saturday and Sunday. When the stakes are meaningful, treat the shorter interpretation as your deadline and ask the other party or a lawyer to confirm the intended meaning before you rely on the longer one.
