Are Hallucinogens Legal? Federal Law and State Exceptions

Are hallucinogens legal in the United States? Under federal law, almost none of them are. LSD, psilocybin mushrooms, DMT, mescaline, and MDMA all sit in Schedule I, the most restrictive category the Controlled Substances Act uses. A few narrow pathways exist around that rule: Oregon runs a licensed psilocybin services program, Colorado has decriminalized personal use of several natural psychedelics and is licensing supervised-use centers, certain religious organizations have won exemptions, some plants happen to fall outside the federal schedules entirely, and ketamine is legally prescribed for medical use. Every one of those pathways carries limits, and using one does not shield you from federal law or from consequences at work, in housing, or with firearms.

What Federal Law Says

The Controlled Substances Act sorts regulated drugs into five schedules. Schedule I is reserved for substances the federal government considers to have a high potential for abuse, no accepted medical use, and no accepted safety even under medical supervision. The statute explicitly lists LSD, psilocybin, psilocyn, DMT, mescaline, and MDMA in that tier.1Office of the Law Revision Counsel. 21 USC 812 – Schedules of Controlled Substances Manufacturing, distributing, or simply possessing any of them is a federal crime, and that classification has stood largely unchanged since the early 1970s.

A first offense for simple possession carries up to one year in prison and a minimum $1,000 fine, with penalties escalating for repeat offenses.2Office of the Law Revision Counsel. 21 USC 844 – Penalties for Simple Possession Distribution is a separate world. The general penalty for distributing any Schedule I substance runs up to 20 years in prison and fines reaching $1 million for an individual, and a prior felony drug conviction raises the ceiling to 30 years.3Office of the Law Revision Counsel. 21 U.S. Code 841 – Prohibited Acts A At specific quantities, mandatory minimums kick in: 10 grams or more of LSD triggers a mandatory 10-year minimum without parole, and a death linked to the distributed substance pushes the range to 20 years to life.

States That Have Changed the Rules

A small number of states have built their own frameworks on top of the federal ban. Oregon and Colorado are the significant ones, and they did not take the same route.

Oregon: Licensed Psilocybin Services

Oregon voters approved Measure 109 in 2020, creating a licensed system for psilocybin services. Adults can receive psilocybin at licensed service centers under the supervision of a trained facilitator.4Oregon State Legislature. Oregon Revised Statutes Chapter 475A – Psilocybin Regulation Service centers began seeing clients in the summer of 2023.5Oregon Health Authority. Oregon Psilocybin Services You cannot buy psilocybin to take home, and the state does not regulate pricing.

Colorado: Decriminalization and Healing Centers

Colorado’s Proposition 122, passed in 2022, decriminalized personal possession, growing, and sharing of five natural psychedelic substances for adults 21 and older: psilocybin, psilocin, DMT, ibogaine, and mescaline (excluding peyote). The law does not authorize sales.6Colorado General Assembly. Proposition 122 – Access to Natural Psychedelic Substances Colorado also directed the creation of licensed “healing centers” for supervised use. The state issued its first healing center license in March 2025, though when centers actually open to clients depends on local approvals and licensing of cultivation and testing facilities.7Colorado Department of Revenue. The DOR’s Natural Medicine Division Issues Colorado’s First Healing Center License

Decriminalization and legalization are often confused. Decriminalization removes criminal penalties for personal conduct but does not create a marketplace. Legalization builds a state-sanctioned system where licensed businesses produce and sell a product. Oregon legalized psilocybin services. Colorado decriminalized personal use of several substances and is layering a supervised-use program on top.

Federal Law Still Reaches You

State legalization or decriminalization does not override federal law. The Supremacy Clause establishes that federal statutes take precedence when they conflict with state law.8Congress.gov. ArtVI.C2.1 Overview of Supremacy Clause Federal prosecutors have generally focused on large-scale trafficking rather than individual users in state-licensed programs, but “generally” is not a legal guarantee. Someone using psilocybin at an Oregon service center is still in technical violation of federal law.

Travel makes that exposure concrete. Carrying a hallucinogen across state lines creates federal jurisdiction even between two states where the substance is decriminalized, with penalties of up to five years in prison for interstate transportation in aid of controlled-substance offenses.9Office of the Law Revision Counsel. 18 U.S. Code 1952 – Interstate and Foreign Travel or Transportation in Aid of Racketeering Enterprises TSA officers screen for safety threats rather than drugs, but they can refer travelers to law enforcement if they find controlled substances. For international travel, Customs and Border Protection requires that any controlled substance be legally prescribed, carried in its original container, and declared at the border; if the prescription was not issued by a U.S.-licensed DEA-registered practitioner, you can import no more than 50 dosage units.10U.S. Customs and Border Protection. Traveling with Medication to the United States None of that offers a pathway for Schedule I hallucinogens.

Religious Exemptions

A small number of religious organizations have secured legal protection to use hallucinogens in ceremony. These rest on the Religious Freedom Restoration Act, which bars the federal government from substantially burdening religious practice unless it can show a compelling interest pursued by the least restrictive means.11Drug Enforcement Administration. Guidance Regarding Petitions for Religious Exemption from the Controlled Substances Act Pursuant to the Religious Freedom Restoration Act

Federal statute explicitly protects the use, possession, and transportation of peyote by Native Americans for traditional ceremonial purposes connected to the practice of a traditional Indian religion.12Office of the Law Revision Counsel. 42 U.S. Code 1996a – Traditional Indian Religious Use of Peyote Two ayahuasca churches have won judicial protection separately. In Gonzales v. O Centro Espírita Beneficente União do Vegetal, the Supreme Court unanimously held that the government failed to show a compelling interest sufficient to override the group’s religious use of the DMT-containing tea under RFRA.13Justia U.S. Supreme Court Center. Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal, 546 U.S. 418 (2006) A federal district court in Oregon later extended the same reasoning to the Santo Daime church.14GovInfo. Church of the Holy Light of the Queen v. Mukasey, District of Oregon

These exemptions are narrow. They apply to recognized religious organizations with established sacramental practices, not to individuals citing a personal spiritual interest. The DEA runs a formal petition process, and the bar is high.

Plants That Sit Outside the Schedules

A few plants with mind-altering properties fall outside the federal schedules entirely.

Salvia divinorum is the best-known. Neither the plant nor its active compound, salvinorin A, is controlled under the Controlled Substances Act.15Drug Enforcement Administration. Salvia Divinorum and Salvinorin A Blue lotus (Nymphaea caerulea) is likewise unlisted.

Amanita muscaria mushrooms sit in a stranger position. The mushroom is not a controlled substance, but in December 2024 the FDA determined that Amanita muscaria and its active constituents (muscimol, ibotenic acid, and muscarine) are not authorized for use in food products, classifying them as unapproved food additives and citing reported poisonings and emergency room visits linked to edible products.16U.S. Food and Drug Administration. FDA Alerts on Use of Amanita Muscaria or Its Constituents in Food Possessing the mushroom is legal at the federal level; selling it as food is not.

The absence of a federal ban does not mean these plants are legal everywhere. Several states and localities have passed their own prohibitions, so check local law before buying or possessing any of them.

The Analogue Trap

When a research chemical closely mimics a scheduled substance without being explicitly listed, the Federal Analogue Act treats it as Schedule I to the extent it is intended for human consumption.17Office of the Law Revision Counsel. 21 U.S. Code 813 – Treatment of Controlled Substance Analogues Sellers often label products “not for human consumption” or “incense” to try to sidestep the statute, but courts examine the totality of the circumstances: marketing, pricing, customer reviews, packaging, and the seller’s own statements. A “not for human consumption” label alone will not save a product sold to get people high, and when a court finds a substance qualifies as an analogue, the full weight of Schedule I penalties applies.

The Medical Route

The most clearly legal use of a hallucinogenic substance is in a medical setting. Ketamine is Schedule III, meaning it has accepted medical use and can be prescribed by physicians.18Drug Enforcement Administration. Drug Scheduling It has been used as an anesthetic for decades, and its dissociative properties have made it increasingly common for treating depression.

The FDA has approved esketamine (Spravato), a nasal spray, for treatment-resistant depression and major depressive disorder with acute suicidal ideation. Because of sedation and dissociation risks, Spravato is available only through a restricted REMS program, and patients must be monitored for at least two hours at a certified healthcare setting before leaving.19U.S. Food and Drug Administration. SPRAVATO (Esketamine) Nasal Spray, CIII Insurance coverage typically requires documentation of failed trials with at least two antidepressants, a formal diagnosis, and baseline scoring on a standardized depression assessment, with authorization usually limited to 12 months before reassessment.

Other hallucinogens are being studied through federally sanctioned clinical trials, where researchers can administer otherwise prohibited substances under an Investigational New Drug application.20U.S. Food and Drug Administration. Investigational New Drug (IND) Application Psilocybin is the furthest along; the FDA has issued national priority vouchers to companies studying it for treatment-resistant depression and major depressive disorder, and the agency has signaled it will prioritize therapies with Breakthrough Therapy designation for serious mental illness.21U.S. Food and Drug Administration. FDA Accelerates Action on Treatments for Serious Mental Illness Following Executive Order No approval date has been announced. MDMA-assisted therapy for PTSD hit a setback in August 2024 when the FDA issued a Complete Response Letter declining to approve the application.22U.S. Food and Drug Administration. Complete Response Letter – NDA 215455 (Midomafetamine) The Department of Veterans Affairs has separately launched its own clinical trial evaluating MDMA-assisted therapy for PTSD and alcohol use disorder in veterans, and the VA has emphasized that it strongly discourages self-medicating with psychedelics outside controlled research.23VA.gov. Consequences Beyond Criminal Prosecution

Even where a hallucinogen is state-legal or medically prescribed, using it can create trouble in other areas of your life. This is where most people get caught off guard.

Federal Employment

Executive Order 12564 established a drug-free federal workplace policy that applies to all federal employees, on duty and off. It defines illegal drugs by reference to federal schedules, not state law, and states that persons who use illegal drugs are not suitable for federal employment. An employee found using a Schedule I substance faces mandatory referral to an Employee Assistance Program and disciplinary action up to removal.24National Archives. Executive Order 12564 – Drug-Free Federal Workplace Participating in Oregon’s licensed psilocybin program on your own time offers no protection.

Safety-Sensitive Transportation Jobs

Anyone in a DOT-regulated safety-sensitive position (commercial truck drivers, airline pilots, train engineers, pipeline workers, and others) is subject to mandatory drug testing under a standard five-panel test that screens for marijuana, cocaine, amphetamines (which includes MDMA), opioids, and PCP.25U.S. Department of Transportation. DOT 5 Panel Notice Psilocybin is not on the standard panel, but a positive test for MDMA would end a career in the field. The FAA separately classifies hallucinogens as disqualifying substances for pilot medical certification; any reported use within the past two years triggers a detailed investigation that can result in denial.26Federal Aviation Administration. Guide for Aviation Medical Examiners – Applicant History Item 18.n.

Federally Assisted Housing

Residents of federally assisted housing face eviction risk for using any substance illegal under the Controlled Substances Act. Federal housing policy requires property owners to deny admission to applicants currently using controlled substances and gives owners discretion to terminate a tenancy on the same basis. The standard is federal law, so living in a decriminalized state does not protect your housing.

Firearms

Federal law makes it illegal for any person who is an unlawful user of or addicted to any controlled substance to possess a firearm or ammunition.27Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Because hallucinogens remain illegal at the federal level, regular use of psilocybin or any other Schedule I substance can disqualify you from gun ownership even in a state that has decriminalized it, and the prohibition applies whether or not you have been charged with or convicted of a drug offense.
