Personal FM transmitters are legal in the United States as long as they follow the FCC’s Part 15 rules, which keep the signal so weak that its effective range tops out around 200 feet.1Federal Communications Commission. What Part 15 Actually Requires
The FCC lets certain very low-powered devices operate on the FM broadcast band (88 to 108 MHz) without any license.1Federal Communications Commission. Low Power Radio – General Information Part 15 of the FCC’s rules governs those devices, along with baby monitors, garage door openers, and a long list of other unlicensed electronics. Meet the technical limits and you’re free to plug in and use it.
The rule doesn’t set a simple wattage cap. It limits field strength: the signal cannot exceed 250 microvolts per meter measured 3 meters from the antenna.3eCFR. 47 CFR 15.239 – Operation in the Band 88-108 MHz That works out to roughly 200 feet of usable range under normal conditions, and walls or trees can shrink it further.1Federal Communications Commission. The antenna rules are just as strict. A Part 15 transmitter has to be built so that only the manufacturer’s antenna will work with it, either permanently attached or connected through a proprietary coupling that won’t accept a standard plug. Standard antenna jacks are prohibited.4eCFR. 47 CFR 15.203 – Antenna Requirement The rule exists to stop people from swapping in a bigger antenna and boosting range. Open the case, solder on a better antenna, and the device is almost certainly out of compliance.
One more condition matters: Part 15 devices sit at the bottom of the radio priority ladder. Your transmitter cannot cause harmful interference to any licensed radio service, and it must accept whatever interference comes its way.5eCFR. 47 CFR 15.5 – General Conditions of Operation If a nearby licensed station overpowers your signal, you have no recourse. If your transmitter causes trouble for a licensed station, you’re the one who has to fix it or shut down.
How to Tell a Transmitter Is Compliant
The easiest way to stay legal is to buy a transmitter that already carries FCC certification. Certified devices show an FCC ID on the label, on the packaging, or through a built-in screen.6Federal Communications Commission. FCC ID Search The ID means the device was tested by an accredited lab and granted formal certification. Anyone can verify one through the FCC’s online search.
Certified Part 15 devices must also carry a specific compliance statement: “This device complies with part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) This device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.”7eCFR. 47 CFR 15.19 – Labeling Requirements If that language isn’t on the device or in the documentation, something’s off.
Be careful with cheap transmitters from overseas sellers. Federal law bars the manufacture, importation, or sale of any radio frequency device in the United States that doesn’t meet FCC authorization and labeling rules.8Federal Communications Commission. Equipment Authorization, Marketing, and Importation Some devices on international marketplaces carry fake FCC IDs or none at all. Using one puts you at risk even if the device happens to sit under the power limit, because the missing certification is itself a violation.
What Happens if You Exceed the Limits
Someone buys a higher-powered transmitter online, broadcasts across a neighborhood, and assumes nobody will notice. The FCC notices. Federal law prohibits radio broadcasts without FCC authorization, and enforcement can include equipment seizure, fines, and criminal penalties.9Federal Communications Commission. The PIRATE Act, signed into law in 2020, raised the financial stakes sharply. Knowingly engaging in pirate radio broadcasting can draw fines of up to $100,000 per day, capped at $2,000,000 total.2Office of the Law Revision Counsel. 47 USC 511 – Enhanced Penalties for Pirate Radio Broadcasting Violations that fall short of the PIRATE Act’s definition still trigger the general forfeiture provisions of the Communications Act, which reach $10,000 per violation or per day of a continuing violation, up to $75,000 for a single act.10Office of the Law Revision Counsel. 47 USC 503 – Forfeitures
When 200 Feet Isn’t Enough
Two hundred feet is a living room or a parking spot. It won’t serve a drive-in, a church campus, or a community event. For more range, you need a license. The most accessible option is Low Power FM (LPFM), which authorizes stations up to 100 watts with a coverage radius of roughly 3.5 miles. LPFM is limited to noncommercial educational entities and certain public safety or transportation organizations; individuals and commercial operators cannot apply, and the FCC is not currently accepting new applications.11Federal Communications Commission. Full broadcast licensing sits under Part 73 and involves a lengthy application process and real financial investment.12Federal Communications Commission. How to Apply for a Radio or Television Broadcast Station For most personal uses, the honest answer is that Part 15’s 200 feet is the legal ceiling.
Staying on the Right Side of the Rule
- Verify the FCC ID before buying. Look it up on the FCC’s Equipment Authorization Search.6Federal Communications Commission. FCC ID Search
- Don’t modify, replace, or add an external antenna. The manufacturer’s antenna is part of what keeps the device legal.4eCFR. 47 CFR 15.203 – Antenna Requirement
- Pick a frequency where no licensed station is broadcasting locally, so your signal is less likely to cause interference you’d be responsible for clearing.
- Accept the range limit. If 200 feet isn’t enough, the fix is a license, not a stronger transmitter.
- Shut down if someone reports interference. Part 15 operators have no right to interfere with licensed services under any circumstances.5eCFR. 47 CFR 15.5 – General Conditions of Operation
