Are Edward Jones Advisors Fiduciaries? Reg BI and Account Type

Edward Jones advisors are fiduciaries only when they manage a fee-based advisory account, such as the firm’s Advisory Solutions program. If you hold a commission-based brokerage account, which Edward Jones calls the Select Account, your advisor follows a different and weaker federal standard called Regulation Best Interest. Same firm, same person sitting across the desk, different legal duty. The account you signed for decides which one you get.

What Fiduciary Duty Actually Means

The fiduciary standard comes from the Investment Advisers Act of 1940 and applies to Registered Investment Advisers. A fiduciary must put your financial interests ahead of their own across the entire relationship, not just at the moment of a recommendation. That splits into two duties: a duty of care, meaning the advice must fit your goals, risk tolerance, and financial picture; and a duty of loyalty, meaning conflicts of interest must be eliminated or fully disclosed so you can give informed consent.1Securities and Exchange Commission. Commission Interpretation Regarding Standard of Conduct for Investment Advisers

One common misconception: a fiduciary is not required to recommend the cheapest option. Cost is one factor among several, including risk, liquidity, time horizon, and expected performance. A fiduciary can recommend a higher-cost product if they reasonably conclude it fits you better overall.1Securities and Exchange Commission. How Regulation Best Interest Differs

Regulation Best Interest governs broker-dealers. It requires a broker to act in your best interest when making a recommendation, but only at the time the recommendation is made. There is no ongoing obligation to monitor your account or revisit prior advice as your situation changes.2U.S. Securities and Exchange Commission. Regulation Best Interest and the Investment Adviser Fiduciary Duty

That single difference is where most of the real-world gap between the two standards shows up. Reg BI does require brokers to consider reasonably available alternatives, disclose material facts and conflicts in writing, and follow written policies to mitigate conflicts that could push them toward their own interests.3eCFR. 17 CFR 240.15l-1 – Regulation Best Interest It’s stronger than the old suitability rule. It is not the same as fiduciary duty. Once the transaction is done, the broker’s job on that recommendation is done.

Which Edward Jones Accounts Are Fiduciary

Edward Jones is registered with the SEC as both a broker-dealer and an investment adviser.4Investment Adviser Public Disclosure. Edward Jones – Brokerage/Investment Adviser Firm Summary The firm can act in either capacity, and your paperwork controls which one applies to you.

If you have a fee-based advisory account, the advisor is operating under the firm’s investment-adviser registration and owes you a fiduciary duty. That means ongoing monitoring of your portfolio, a legal obligation to act in your best interest at all times, and full disclosure of conflicts. Advisory Solutions Fund Models require a minimum investment of $25,000.5Edward Jones. If you have a Select Account, your advisor is acting as a registered representative of the broker-dealer. In that capacity, Reg BI applies, not fiduciary duty. You pay commissions on trades and sales loads on mutual funds instead of an ongoing advisory fee.7Edward Jones. Important Information About Our Brokerage Services Many clients sign the paperwork without focusing on the distinction, and only learn which side they’re on when a problem surfaces.

One title note: the SEC presumes a broker-dealer who is not also registered as an investment adviser violates Reg BI’s disclosure rule if they use the title “adviser” or “advisor.” Because Edward Jones is dually registered, its representatives can lawfully use the title regardless of which capacity they’re acting in on your account.8U.S. Securities and Exchange Commission. The Revenue-Sharing Conflict on the Brokerage Side

Edward Jones receives payments from mutual fund companies, 529 plan managers, and insurance carriers for selling their products. In 2025, revenue sharing payments totaled roughly $326.8 million from mutual fund and 529 partners, plus another $5.3 million from annuity partners.9Edward Jones. Revenue Sharing Disclosure

The firm designates many of these paying companies as “strategic product partners” and predominantly promotes their mutual funds. For variable annuities, Edward Jones advisors have limited access to products from carriers that don’t pay revenue sharing.9Edward Jones. Revenue Sharing Disclosure The menu your broker can pull from is partially shaped by which companies pay the firm.

Edward Jones discloses that it does not receive revenue sharing on assets held inside advisory accounts. The conflict is concentrated in the brokerage relationship, which is also where the weaker standard of care applies. Both facts sit on the same side of the line.

How to Confirm the Standard on Your Account

Two free tools let you verify what you actually have, without relying on your advisor’s description.

The first is Form CRS, the Client Relationship Summary. Any firm registered as both a broker-dealer and an investment adviser has to deliver one, and the SEC requires that brokerage and advisory services appear with equal prominence so you can compare them.10Securities and Exchange Commission. Form CRS Relationship Summary – Amendments to Form ADV The form includes SEC-mandated conversation starters, including: “Given my financial situation, should I choose an investment advisory service? Should I choose a brokerage service? Should I choose both types of services?” Those prompts are printed on the form. Ask them out loud at your next meeting.

The second is the SEC’s Investment Adviser Public Disclosure database, reachable through Investor.gov. You can look up Edward Jones or an individual representative, check registration status, and read the firm’s Form ADV and Form CRS.11Investor.gov. If You Believe the Standard Was Breached

Recourse depends on which account you had.

Brokerage account disputes almost always go to FINRA arbitration, not court, because Select Account agreements contain a pre-dispute arbitration clause. You file a Statement of Claim describing the dispute and the damages, along with a Submission Agreement and a filing fee. A case that goes to hearing typically takes around 16 months. Arbitration awards are legally binding, and a firm that fails to pay within 30 days risks suspension from FINRA.13FINRA.org. FINRA’s Arbitration Process

Advisory account disputes involving a fiduciary breach fall under Section 206 of the Investment Advisers Act, which the SEC enforces. Remedies can include disgorgement of profits, civil penalties, and orders requiring the firm to repay harmed clients.14U.S. Securities and Exchange Commission. Either way, your own records decide most cases: account statements, written recommendations, emails, and notes from meetings. Advisors move firms, retire, or leave the industry, and once they’re gone, your documentation is the only reliable account of what was recommended and why.
