Are Aflac Premiums Tax Deductible for You? Payer and Policy

Whether Aflac premiums are tax deductible depends on who pays them, how they’re paid, and what kind of policy they cover. Individually paid premiums for accident and critical illness coverage can qualify as a medical expense, but only if you itemize and your total medical costs clear the 7.5% AGI floor. Self-employed people get a far better path. And if your employer runs the premium pre-tax through a cafeteria plan, you’ve already received the tax break, so there’s nothing left to deduct.

One idea runs through all of this: the way the premium is taxed and the way the benefit is taxed are linked. Taking a deduction now usually means paying tax on the benefits later. Skipping the deduction usually means the benefits come to you tax-free.

If You Pay for Aflac Yourself

Buying a policy on your own and paying out of pocket means you’re paying with after-tax dollars. Those premiums can be included as a medical expense on Schedule A, but two conditions have to be met. You have to itemize instead of taking the standard deduction, and your total qualified medical expenses have to exceed 7.5% of your adjusted gross income.1Office of the Law Revision Counsel. 26 U.S.C. 213 – Medical, Dental, Etc., Expenses2Internal Revenue Service. Publication 502 (2025), Medical and Dental Expenses Only the portion above that floor is deductible.

That knocks most individual filers out. If you earn $80,000, you need more than $6,000 in qualifying medical expenses before the first dollar counts, and the Aflac premium only helps if you were already going to clear the line. Take the standard deduction and there’s no write-off at all for premiums you paid yourself.

The upside is on the back end. Because you paid with after-tax dollars, benefits you collect from the policy are excluded from your gross income.3Office of the Law Revision Counsel. 26 U.S.C. 104 – Compensation for Injuries or Sickness For most individual policyholders this is the real value: you give up a modest deduction and keep every dollar when a claim pays.

If You’re Self-Employed

Self-employed filers get a much better deal. Sole proprietors, partners, and S-corporation shareholders who own more than 2% can deduct health and supplemental insurance premiums above the line, which lowers AGI directly and does not require itemizing.4Office of the Law Revision Counsel. 26 U.S.C. 162 – Trade or Business Expenses You claim it on Form 7206 and carry the figure to Schedule 1 of Form 1040.5Internal Revenue Service. Instructions for Form 7206 (2025)

Two limits trip people up. The deduction can’t exceed the net earned income from the business that established the coverage. Pay $35,000 in premiums on $30,000 of net income and you deduct $30,000; the leftover can still be included on Schedule A, subject to the 7.5% floor.5Internal Revenue Service. Instructions for Form 7206 (2025)

The second limit is month-by-month. The deduction is unavailable for any month you were eligible to participate in a subsidized health plan maintained by any employer, including your spouse’s.5Internal Revenue Service. Instructions for Form 7206 (2025) If your spouse’s open enrollment opens mid-year, you lose the deduction from that month on even if you never actually joined the plan.

If Your Employer Pays or You Pay Pre-Tax at Work

Businesses that pay Aflac premiums for employees deduct the cost as an ordinary and necessary business expense.4Office of the Law Revision Counsel. 26 U.S.C. 162 – Trade or Business Expenses When the employer pays and excludes the cost from your wages, the premium isn’t taxable to you.6Office of the Law Revision Counsel. 26 U.S.C. 106 – Contributions by Employer to Accident and Health Plans

Many employers offer Aflac through a Section 125 cafeteria plan, where premiums come out of your paycheck before taxes. The IRS treats that as if the employer paid it.7Office of the Law Revision Counsel. 26 U.S.C. 125 – Cafeteria Plans You don’t get a separate deduction, because the tax benefit was already delivered through a smaller taxable wage. Nothing more to claim.

The catch arrives when you file a claim. Benefits from a plan paid with pre-tax dollars are generally included in your taxable income, because the premium itself was never taxed. For fixed indemnity policies like Aflac’s accident and critical illness coverage, the benefit is excludable only to the extent it reimburses actual unreimbursed medical expenses. Anything above those costs is taxable.8Office of the Law Revision Counsel. 26 U.S.C. 105 – Amounts Received Under Accident and Health Plans If Aflac pays $1,000 for a hospital stay and your out-of-pocket costs were $600, the extra $400 is income. Taxable benefits received through an employer plan are reported on your W-2.9Internal Revenue Service. Life Insurance and Disability Insurance Proceeds

Before you enroll pre-tax at work, it’s worth comparing the small payroll tax savings against the possibility of a taxable benefit later. For some workers, paying with after-tax dollars and keeping any future claim fully tax-free is the better outcome.

Policy Type Changes the Answer

The IRS doesn’t treat every Aflac product the same way. Whether the premium qualifies as a medical expense at all depends on what the policy covers.

Accident and Critical Illness

Premiums for accident and critical illness coverage that pays based on a medical event generally qualify as medical care, because they cover costs tied to diagnosis, treatment, or prevention of disease.1Office of the Law Revision Counsel. 26 U.S.C. 213 – Medical, Dental, Etc., Expenses These are the Aflac products most likely to be deductible for individuals (subject to the AGI floor) and eligible for the self-employed deduction.

Disability Income

Premiums for disability income coverage that replaces lost wages are not deductible as a medical expense. The IRS specifically excludes policies that pay for loss of earnings from the definition of deductible medical care.2Internal Revenue Service. Publication 502 (2025), Medical and Dental Expenses That sounds like a loss, but the benefits side flips in your favor: because you paid with after-tax dollars, the disability benefits you later collect are entirely tax-free.3Office of the Law Revision Counsel. 26 U.S.C. 104 – Compensation for Injuries or Sickness Keeping all of a $5,000 monthly check beats writing off $200 in premiums.

Long-Term Care

Qualified long-term care insurance premiums are deductible as a medical expense, but only up to age-based caps the IRS sets each year. For 2026:10Internal Revenue Service. Rev. Proc. 2025-32

  • Age 40 or younger: $500
  • Age 41 to 50: $930
  • Age 51 to 60: $1,860
  • Age 61 to 70: $4,960
  • Age 71 or older: $6,200

These caps limit what you can include as a medical expense. Pay $2,500 at age 48 and only $930 counts; the rest is non-deductible no matter how high your total medical spending runs. Individual filers still have to clear the 7.5% AGI floor on top of this cap. The self-employed can deduct up to the applicable limit above the line.

Coverage That Never Qualifies

Some pieces of a supplemental policy are never deductible as medical expenses, regardless of how you pay. The IRS excludes premiums for life insurance, policies paying for loss of life or limb, and policies guaranteeing a fixed weekly payment during hospitalization.2Internal Revenue Service. Publication 502 (2025), Medical and Dental Expenses If your Aflac policy bundles a return-of-premium rider or a life insurance component, the portion of the premium tied to those features stays out of your medical expense calculation.

What You Can’t Do: HSAs and FSAs

A common question: can you pay Aflac premiums with HSA or FSA money? Generally, no.

HSA funds can’t be used tax-free for insurance premiums, with four narrow exceptions: long-term care insurance, COBRA continuation coverage, health coverage while receiving unemployment compensation, and Medicare coverage at age 65 or older.11Internal Revenue Service. Publication 969 (2025), Health Savings Accounts and Other Tax-Favored Health Plans Aflac accident, critical illness, and disability premiums don’t fit. You can carry these supplemental policies alongside an HSA-eligible high-deductible plan without losing HSA eligibility; you just can’t pay the premium from the HSA.

Health FSAs follow similar rules and can’t reimburse accident or disability insurance premiums. Both accounts can still pay for qualifying out-of-pocket medical expenses the supplemental policy doesn’t cover.

What to Keep

If you plan to deduct Aflac premiums, hold onto records showing the amount paid, the dates, and the type of coverage.2Internal Revenue Service. Publication 502 (2025), Medical and Dental Expenses Premium statements, bank or card records, and your employer’s benefits summary all work. Don’t file them with your return, but keep them where you can find them. For the self-employed deduction, keep proof of your net business income too, since the write-off is capped at your earned income from the business.

If you’ve received benefits from a pre-tax plan and need to figure out how much exceeds your unreimbursed medical costs, save receipts for every out-of-pocket medical expense during the same period. Only the amount your Aflac benefit exceeds your actual costs is taxable, and you want documentation on both sides of that calculation.
