The Financial Liability Investigation of Property Loss, or FLIPL, is the formal process the Army uses under AR 735-5 to figure out what happened to missing, damaged, or destroyed government property and to decide whether someone should pay for it. If you are named as a respondent and found liable, the charge is ordinarily capped at one month of your base pay, though a handful of property categories carry no cap. The FLIPL procedures under AR 735-5 give you specific rights along the way, including notice, access to the file, legal assistance, and a chance to rebut before the finding becomes final.
What Triggers a FLIPL
The process starts the moment you discover government property is missing, damaged, or destroyed. Report it to your supervisor or Property Book Officer right away. There is no grace period, and a delayed report can weigh against you later.1JAG C Net. This early record is the foundation for whatever follows.
Within the first 15 days, the command does causative research to decide whether the loss can be cleared through a simple inventory adjustment or whether a formal investigation is needed.2Defense Health Agency. WACH Regulation No. 735-5 Financial Liability Investigation of Property Loss
Not every loss goes to a full FLIPL. If you know you’re responsible and don’t dispute the amount, you can sign a DD Form 362 (Statement of Charges) and pay directly. Signing that form is an admission of liability.3The United States Army. If you have any real doubt about your fault, don’t sign the Statement of Charges. Once you do, you’ve waived the investigation and appeal protections that come with a FLIPL.
How the Investigation Works
When the loss can’t be resolved informally, the formal process begins with DD Form 200, “Financial Liability Investigation of Property Loss.”4Department of Defense. The Property Book Officer verifies the data and assigns a document number, and the package moves to the appointing authority, who decides whether the facts are clear enough for a short-form resolution or whether a Financial Liability Officer needs to investigate.
The Financial Liability Officer (FLO) gathers evidence, interviews witnesses, reviews maintenance records and hand receipts, and reconstructs what happened to the property.1JAG C Net. AR 735-5 Property Accountability Policies and Procedures To recommend financial liability, the FLO has to establish three things by a preponderance of the evidence, meaning more likely than not:
- Responsibility. You were accountable for the property through a hand receipt, direct possession, or supervisory duty.
- Fault. You failed in that responsibility through simple negligence, gross negligence, or willful misconduct.
- Causation. Your failure was the direct cause of the loss, not just something that happened alongside it.
All three have to be there. If the FLO can show you had the property but can’t tie your conduct to its disappearance, the recommendation should go in your favor. The approving authority, typically an O-6 or civilian equivalent, then reviews the FLO’s findings, the legal review, and the supporting documentation and makes the final call. Relief from liability is granted when the evidence shows you exercised reasonable care and the loss happened anyway. Liability is assessed when negligence or willful misconduct was the proximate cause.
The 75-Day Timeline
AR 735-5 sets a cumulative 75-calendar-day deadline for the FLIPL, measured from the date the loss is discovered.2Defense Health Agency. Days 16 through 55 are for the FLO’s investigation itself: up to 30 working days for evidence gathering, interviews, and the JAG legal review. Days 56 through 75 belong to the approving authority for review, final determination, and notification. Once the decision is made, the file goes to finance for collection within one day.
Complex investigations, especially those involving deployed witnesses, often run long. The timeline still matters to you because the flag on your record stays active until the investigation closes.
How Much You Can Be Charged
Financial liability is ordinarily capped at one month of your base pay at the time of the loss.1JAG C Net. AR 735-5 Property Accountability Policies and Procedures The cap does real work. An E-4 found liable for a $50,000 vehicle owes roughly one month’s base pay rather than the full replacement cost.
The cap has exceptions. You can be held liable for the entire loss when the property is personal arms or equipment individually issued to you, or when the loss involves damage to government quarters.3The United States Army. The amount charged reflects the item’s depreciated value, not its original purchase price. A qualified technician assesses condition at the time of loss to determine fair market value, and for worn items that can bring the number down substantially.
When More Than One Person Was Involved
When several people contributed to a loss, AR 735-5 applies collective and individual liability, using a formula in Table 12-4 to calculate each person’s share based on degree of fault. The rule shifts when military personnel or DoD civilians share fault with someone outside federal employment. Then Table 12-4 doesn’t apply. The total dollar amount is divided equally among all respondents, and each military or civilian employee pays the lesser of the calculated share or one month’s base pay.1JAG C Net. How to Rebut a Liability Finding
If the approving authority finds you liable, you’ll get formal notice along with your right to rebut. The rebuttal deadlines are short and depend on how you were notified:5Arkansas Army National Guard. Soldier’s Guide to Financial Liability Investigation of Property Loss
- In person: 7 calendar days from the date of notification.
- Mail or email, same country: 15 calendar days from the date sent.
- Mail or email, different country: 30 calendar days from the date sent.
You have the right to inspect and copy all Army records related to the FLIPL, and you’re entitled to legal assistance from a Judge Advocate to prepare your rebuttal.5Arkansas Army National Guard. Aim your rebuttal at the three elements the FLO had to prove. If the investigation misidentified who actually had the property, failed to establish your negligence, or didn’t show a clear causal link between what you did (or didn’t do) and the loss, those are your strongest points. The appeal goes to the next level of command, whose decision is the final administrative action on the matter.
Other Consequences While a FLIPL Is Open
The charge isn’t the only thing that happens. When you become the subject of a FLIPL, your commander initiates a flag that suspends favorable personnel actions. While flagged you can’t receive promotions, awards, or other favorable actions, and FLIPL flags are nontransferable, so they can hold up a PCS to your next duty station until the investigation closes.7Fort Benning. A FLIPL finding doesn’t automatically show up on your OER or NCOER. But if the underlying conduct was serious, the appointing authority can direct a separate AR 15-6 investigation, which can lead to a letter of reprimand or, where criminal conduct is suspected, referral for UCMJ action.2Defense Health Agency. How the Army Collects the Debt
Once liability is finalized, the debt is collected by payroll deduction. Federal law caps involuntary withholding so your take-home pay cannot drop below one-third of your monthly pay after all deductions, including any court-martial forfeitures.8Office of the Law Revision Counsel. 37 USC 1007 Deductions From Pay You can consent to a faster repayment rate if you want the debt gone sooner.
Leaving the military does not erase a FLIPL debt. If it’s still outstanding at separation, the Army can collect from your final salary and lump-sum leave payment. Debts more than 180 days delinquent go to Treasury’s Financial Management Service for collection through the Treasury Offset Program, which can intercept federal payments including tax refunds, retirement benefits, and Social Security.9eCFR. 31 CFR Part 5 Treasury Debt Collection
The fallout goes beyond paycheck deductions. The government can report delinquent debts to credit bureaus and refer them to private collectors. A person delinquent on a federal debt is also barred from federal loans, loan guarantees, or loan insurance, with only disaster loans excepted.9eCFR. 31 CFR Part 5 Treasury Debt Collection If you’re transitioning and planning to use an FHA or VA loan, an unresolved FLIPL debt can block that path outright.
