ANDA Approval: Bioequivalence, GDUFA Fees, and Exclusivities

The ANDA approval process is how a generic drug manufacturer gets FDA clearance to sell a copy of an already-approved brand-name drug without repeating the original clinical trials. Instead of proving safety and effectiveness from scratch, the applicant shows that its product is bioequivalent to a Reference Listed Drug — the brand-name product it copies — and that it can be manufactured to the same standards. The pathway was created by the Hatch-Waxman Act of 1984 and codified at Section 505(j) of the Federal Food, Drug, and Cosmetic Act.1GovInfo. What the ANDA Pathway Skips and What It Doesn’t

A full New Drug Application under Section 505(b) requires preclinical animal work, phased human trials, and years of safety and efficacy data. An ANDA skips that clinical package. The FDA already reviewed the reference drug when the brand was approved, and repeating the trials would raise prices without adding safety.3U.S. Food and Drug Administration. What the ANDA does not skip: bioequivalence testing, chemistry and manufacturing data, facility inspections, labeling review, patent certifications, and post-approval surveillance. “Abbreviated” refers to the clinical trial shortcut, nothing else.

Proving Bioequivalence

Bioequivalence is the scientific core of every ANDA. It answers whether the generic delivers the same amount of active ingredient into the bloodstream, at the same rate, as the brand.

The standard test is a pharmacokinetic study in healthy volunteers using a crossover design: each subject takes the generic and the reference drug on different occasions, and researchers measure blood concentrations over time. Two values drive the analysis. AUC captures total drug absorbed. Cmax captures peak concentration. The 90% confidence interval for the ratio of the generic’s AUC and Cmax to the reference drug’s values must fall within 80.00% to 125.00%.4U.S. Food and Drug Administration. The FDA publishes product-specific guidances telling applicants exactly how to design the bioequivalence study for a given drug, including whether standard pharmacokinetic testing suffices or whether a clinical endpoint study is required. Narrow therapeutic index drugs — where the gap between an effective dose and a dangerous one is small, such as warfarin and certain anti-seizure medications — face tighter statistical standards. What the Application Must Contain

Beyond bioequivalence, the generic must match the reference drug on every clinically meaningful dimension. Same active ingredient. Same dosage form, strength, and route of administration. Same conditions of use.6U.S. Food and Drug Administration. Sameness Evaluations in an ANDA – Active Ingredients Labeling must mirror the reference drug’s labeling, with narrow carve-outs for the generic manufacturer’s identity or an indication still under patent.

The submission includes Chemistry, Manufacturing, and Controls (CMC) data covering formulation, the manufacturing process, and stability. Every facility involved must comply with Current Good Manufacturing Practice regulations, and the FDA verifies compliance through inspection before approval.

Inactive Ingredients

Excipients such as binders, fillers, and colorants can differ from the reference drug, but not freely. The Refuse-to-Receive Screen

Before scientific review begins, the FDA screens each ANDA against refuse-to-receive standards. An application that is not “sufficiently complete to permit a substantive review” gets sent back.8U.S. Food and Drug Administration. User Fees Under GDUFA

Filing an ANDA carries substantial fees that fund the FDA’s review program under the Generic Drug User Fee Amendments, currently authorized as GDUFA III through September 2027.9U.S. Food and Drug Administration. Generic Drug User Fee Amendments For fiscal year 2026:

  • ANDA application fee: $358,247
  • Drug Master File fee: $102,584
  • Domestic finished dosage form facility: $238,943 per year
  • Foreign finished dosage form facility: $253,943 per year
  • Domestic API facility: $43,549 per year
  • Foreign API facility: $58,549 per year

Annual program fees scale with company size, from $191,838 for small operations to $1,918,377 for large ones. Foreign facilities pay a $15,000 surcharge over their domestic counterparts. These are regulatory fees only; they do not include bioequivalence study costs, formulation development, or patent litigation.

Patents and Exclusivities That Gate Approval

Passing scientific review is not enough. The applicant must also clear the patent and exclusivity landscape surrounding the reference drug.

Orange Book Certifications

Brand-name manufacturers list patents covering the drug substance, formulation, or approved methods of use in the FDA’s Orange Book.10U.S. Food and Drug Administration.   • Paragraph I: no patent information has been filed.
  • Paragraph II: the listed patent has expired.
  • Paragraph III: the applicant will wait for expiration before marketing.
  • Paragraph IV: the patent is invalid, unenforceable, or will not be infringed.

Paragraphs I and II clear the way for approval on the patent side. Paragraph III delays approval until expiration. Paragraph IV triggers litigation.

The 30-Month Stay

A Paragraph IV certification is treated as an act of patent infringement under 35 U.S.C. § 271(e)(2), even though nothing has been sold.12Office of the Law Revision Counsel. 35 U.S. Code 271 – Infringement of Patent The applicant must notify the patent holder and the NDA holder. If either files an infringement suit within 45 days of that notice, the FDA generally cannot grant final approval for 30 months.13U.S. Food and Drug Administration. Patent Certifications and Suitability Petitions The stay ends early if a court finds the patent invalid or not infringed before 30 months run. If no suit is filed within the 45-day window, the stay never attaches.

Brand Exclusivities

  • New Chemical Entity exclusivity runs five years and bars the FDA from even accepting an ANDA. A Paragraph IV applicant can file after four years.
  • New clinical investigation exclusivity runs three years and blocks approval — not submission — of ANDAs targeting the specific change (new dosage form, new indication, new route) that the studies supported.
  • Orphan drug exclusivity runs seven years for drugs treating rare diseases affecting fewer than 200,000 people in the United States.
  • Pediatric exclusivity adds six months on top of every existing patent and exclusivity when the manufacturer conducts FDA-requested pediatric studies.

The 180-Day First-Filer Exclusivity

The first applicant to submit a substantially complete ANDA with a Paragraph IV certification earns 180 days of market exclusivity: during that window, the FDA will not approve any other generic for the drug.15Legal Information Institute. 21 U.S. Code 355 – New Drugs – 180-Day Exclusivity Period Multiple filers on the same first day share it.

The exclusivity is use-it-or-lose-it. A first applicant forfeits it by failing to launch within statutory deadlines, generally 75 days after final approval takes effect or 75 days after a court ruling resolves the patent dispute, whichever is later. One important limit: the 180-day period only blocks approval of other ANDAs. The brand company can launch its own authorized generic during the window under its existing NDA, which frequently cuts into the first-filer’s financial advantage.

Review, Complete Response Letters, and Inspections

Applications that pass the refuse-to-receive screen enter substantive review, where FDA staff evaluate the bioequivalence data, CMC package, and proposed labeling.

Under GDUFA, the target for a standard original ANDA is 10 months from submission. Priority ANDAs — those where the applicant pre-submits facility information at least 60 days before filing — get an 8-month target.16U.S. Food and Drug Administration. Most ANDAs don’t clear on the first cycle. The FDA typically issues a Complete Response Letter identifying deficiencies — bioequivalence study problems, manufacturing issues, labeling discrepancies — that the applicant must resolve before resubmitting.17U.S. Food and Drug Administration. Before approval, the FDA may inspect every facility involved in manufacturing, testing, and packaging. Pre-approval inspections verify that the facility can produce the drug at commercial scale under cGMP, that the process matches the application, and that the submitted data is authentic and complete.18U.S. Food and Drug Administration. Final Versus Tentative Approval

If the ANDA clears every scientific and regulatory hurdle and nothing blocks market entry, the FDA issues a final approval. If the product is scientifically ready but a patent or exclusivity period has not expired, the FDA issues a tentative approval — the drug has passed review but cannot be sold until the legal barrier lifts.2U.S. Food and Drug Administration. After Approval

Once approved, the generic gets a therapeutic equivalence code in the Orange Book. “A” codes such as AB, AA, and AP mean the FDA considers the products therapeutically equivalent and pharmacy-level substitution is appropriate. “B” codes mean the products are not considered therapeutically equivalent, usually because bioequivalence has not been adequately demonstrated for the dosage form. Approval also triggers ongoing surveillance duties. Generic manufacturers must report adverse events to the FDA electronically for as long as the product remains approved, even if the company has stopped marketing it.20U.S. Food and Drug Administration. The FDA conducts compliance inspections to verify that manufacturers, distributors, and contracted reporting entities meet these obligations, and enforcement can follow if problems are not corrected.
