Amazon Tax Exemption Program: How to Qualify, Enroll, and Renew

The Amazon Tax Exemption Program, known as ATEP, lets qualifying organizations and resellers remove sales tax from eligible Amazon purchases automatically at checkout. Enrollment is free. You’ll need a valid state-issued exemption or resale certificate for every state where you want tax-free shipping, and the paperwork has to match your Amazon account details exactly. Most rejections come down to small mismatches, so it pays to gather documents before starting.

Who Qualifies

Amazon’s help pages say “individuals or businesses may qualify,” but in practice ATEP is built for organizations with a recognized tax-exempt status or a valid resale certificate. A few groups make up almost all enrollees.

  • Nonprofits and charities recognized under Internal Revenue Code Section 501(c)(3), including religious, educational, charitable, and scientific organizations.   • Public schools, colleges, and universities. Many states extend exemptions to private nonprofit educational institutions as well.
  • Resellers buying goods to resell, using ATEP to avoid sales tax at the wholesale stage.

Each state sets its own rules on which entities qualify and what purchases are covered. An organization exempt in one state may not be exempt in another, and you need a separate certificate for every state where you want the exemption to apply.

Documents to Gather Before You Enroll

Start with your federal Employer Identification Number. The IRS assigns this nine-digit number to identify employers, nonprofits, government agencies, and other business entities.3Internal Revenue Service. The core document is your state-issued exemption or resale certificate. Most state Departments of Revenue publish the correct form. If you operate across state lines, check whether you can use a multistate form. Before uploading, confirm every certificate is signed (for paper submissions), dated, and includes a description of the items the exemption covers. Amazon specifically calls out missing dates, signatures, and item descriptions as grounds for denial.4Amazon. Documents Amazon Won’t Accept

Several document types get submitted often and rejected every time: sales tax permits, articles of incorporation, tax licenses, W-9 forms, certificates of registration, and IRS determination letters (unless state law specifically requires one).4Amazon. You need the state-issued form that certifies your right to purchase without paying sales tax.

A Boundary: Partial Exemptions

If your organization qualifies for a partial exemption — covering only certain product categories or a reduced rate — ATEP will not process your enrollment. The program does not support partial exemptions. How to Enroll Through the Tax Exemption Wizard

Amazon offers two enrollment paths. The guided wizard walks you through the process and activates your exemption within about 15 minutes. Manual document upload goes to Amazon’s review team and typically processes within 24 hours.8Amazon. Enroll in the Amazon Tax Exemption Program (ATEP)

Go to Business Settings, select Tax Exemption & Licenses, and click Tax Exemption. Select Add Tax Exemptions and choose either the quick wizard setup or manual document upload.8Amazon. Review everything for accuracy before submitting.

Organizations operating across multiple states need to submit one certificate per state. Only group administrators can upload documents for multiple legal entities within the same account.8Amazon. What ATEP Doesn’t Cover

An active exemption does not make every Amazon purchase tax-free. The biggest limitation is seller participation. ATEP covers Amazon, its affiliates, and participating independent third-party sellers. Not every marketplace seller participates. When you buy from one who doesn’t, tax gets charged regardless of your exemption status, and the checkout page will say the seller does not participate in ATEP.9Amazon. Certain product categories may also be ineligible. Amazon’s system flags these at checkout with a message that the item is “not eligible for tax exemption” or “not eligible for full tax exemption.” The second message can appear when local jurisdictions impose taxes your certificate doesn’t cover.9Amazon. There’s a certificate scope issue people miss. When you upload your certificate, if you restrict the seller of record to Amazon or one of its subsidiaries, the exemption applies only to purchases from those entities. To cover participating third-party sellers, leave the seller-of-record field open and make sure the certificate carries a date, signature, and item description.9Amazon. Tax Exemption Messages

Renewing and Keeping the Exemption Active

Once approved, your exemption appears in the tax settings dashboard organized by state. The system applies it automatically to qualifying items from participating sellers and deducts the tax from your order total. Exemption certificates expire, with dates that vary by state and certificate type. If yours expires and you don’t renew, Amazon calculates tax on all future orders shipped to that state.9Amazon. If your organization changes its name, address, or legal structure, update your Amazon account to match the new documentation before resubmitting.

Amazon also verifies state tax IDs directly with state authorities. If a state reports that your ID is expired, invalid, or incorrect, Amazon removes the exemption and notifies you by email.8Amazon. Enroll in the Amazon Tax Exemption Program (ATEP)

Why Tax Might Still Show at Checkout

Seeing tax on an order after enrolling almost always traces back to one of a handful of causes. Amazon’s checkout page usually shows a message telling you which one.9Amazon. Tax Exemption Messages

  • You’re shipping to a state where you haven’t uploaded a valid certificate.
  • The certificate for that state has expired.
  • The third-party seller isn’t in ATEP. Try buying the same item from Amazon directly or a different seller.
  • The item or its category isn’t covered by your exemption type.
  • You accidentally toggled the exemption off. During checkout, Amazon shows a “Tax Exemption Applied” or “Tax Exemption Available” link, and clicking it can turn the exemption off for that order.
  • Your certificate names only Amazon or a specific subsidiary as the seller of record, so purchases from other sellers aren’t covered.

If none of those fit, contact Amazon. The checkout page sometimes displays a generic “Tax was calculated on this item” message with no further detail, and customer service can investigate the specific transaction.

Getting a Refund on Past Orders

If you placed an order before your exemption was active, or if tax was charged on an order that should have been exempt, you can request a refund. Email tax-exempt@amazon.com from the address tied to the account that placed the order. Include the reason for the request, the 17-digit order number, and any required exemption documentation in PDF format. Amazon’s customer service team cannot open non-PDF files.11Amazon. One timing rule: you can only request a refund after the order has been delivered. Amazon will not process tax refunds on orders still in transit.11Amazon. Each partial-exemption order needs its own refund request with supporting documentation.

Don’t Misuse the Certificate

Using an exemption certificate for personal purchases or for items outside its scope is fraud. Every state treats this seriously, though specific penalties vary. Consequences typically include repayment of all evaded tax, substantial financial penalties on top of that amount, and in severe cases criminal charges. If your purchasing needs change or you’re unsure whether a specific purchase qualifies, pay the tax at checkout and request a refund later with documentation. Claiming an exemption you’re not entitled to creates liability that’s much harder to unwind.
