Amazon Prime Lawsuit: $2.5B FTC Settlement Refunds and Claims

Amazon agreed in September 2025 to pay $2.5 billion to settle the Federal Trade Commission’s Amazon Prime lawsuit, which accused the company of tricking people into Prime subscriptions and making cancellation unreasonably hard. The deal sets aside $1.5 billion in refunds for roughly 35 million U.S. consumers and imposes a $1 billion civil penalty, the largest the FTC has ever obtained for a rule violation.1FTC. Who Qualifies for a Refund

Three things have to be true for you to be eligible. You must be a U.S. Amazon Prime customer. You must have either signed up through one of the checkout pages the FTC challenged, or tried to cancel through the online cancellation path, between June 23, 2019 and June 23, 2025. And you must have used only a limited number of Prime benefits during the relevant period.2FTC. Amazon Refunds

The “challenged enrollment flows” are specific screens: any version of the Universal Prime Decision Page, the Shipping Option Select Page, the Prime Video enrollment flow, or the Single Page Checkout. These are the checkout pages where the FTC said Amazon steered people into subscribing.3Axios. The benefit-use limit is what separates the two refund waves. Customers who used three or fewer Prime benefits in any 12-month window during the eligibility period fall into the automatic-payment group. Customers who used 10 or fewer benefits, or who tried but failed to cancel, fall into the claims group.

How Refunds Are Being Paid

The payout is happening in two waves.

The first wave was automatic. Between November 12 and December 24, 2025, Amazon sent payments to consumers who enrolled through a challenged flow and used three or fewer Prime benefits in any 12-month period during the eligibility window. Recipients got an email offering payment through PayPal or Venmo. Anyone who didn’t respond to the email was mailed a check at the shipping address on their Prime account.4WBAL-TV. The second wave is the claims process. Starting in January 2026, Amazon began sending claim notices to eligible consumers who did not receive an automatic refund. That group includes people who used up to 10 Prime benefits and people who tried to cancel but couldn’t. The filing deadline is July 27, 2026. The July 27, 2026 deadline is the hard stop. If you think you qualify and haven’t received either an automatic payment or a claim notice, checking the official settlement site before the deadline is the practical step.

How to Avoid Refund Scams

Scammers are impersonating both the FTC and Amazon to exploit the size of the affected group. A few rules cut through most of it.

The FTC is not calling anyone by phone about these refunds. Any phone call claiming to be from the FTC about the Prime settlement is a scam. Neither the FTC nor Amazon will ask you to pay a fee to receive a refund, and neither will ask for sensitive personal or financial information as a condition of payment.7Snopes. Legitimate refund emails come from Amazon or from PayPal for the payment step. If an email looks off, don’t click the link. What Amazon Was Accused of Doing

The FTC’s complaint, filed in June 2023 in the U.S. District Court for the Western District of Washington, alleged that Amazon used manipulative website design, which the agency called “dark patterns,” to enroll shoppers in auto-renewing Prime memberships without informed consent. The checkout pages, the FTC said, buried the option to buy without Prime and used buttons that did not make clear a click meant agreeing to a $14.99 monthly charge.9FTC. The cancellation path drew equal criticism. The FTC described it as a four-page, six-click, fifteen-option journey that pushed users through discount offers, prompts to disable auto-renew instead of canceling, and reconsideration screens before letting them out.11NPR. The legal claims rested on Section 5 of the FTC Act, which bars unfair trade practices, and the Restore Online Shoppers’ Confidence Act, which sets rules for disclosure, consent, and cancellation in online subscriptions.9FTC. Amazon has maintained throughout that enrolling in Prime “always requires affirmative consent,” that there are “at least 40 ways to get to the cancellation page,” and that unsubscribing “takes a matter of seconds.”11NPR. The settlement came shortly after a September 17, 2025 ruling by Judge John H. Chun, who held that Amazon Prime is a “negative option feature” under ROSCA and that Amazon violated the statute by collecting billing information before disclosing the material terms of the subscription. Judge Chun wrote that “no reasonable jury could find in favor of Amazon” on that point. A jury trial had begun in Seattle days before the deal was announced.13Justia. FTC v. What Amazon Must Change Going Forward

The settlement doesn’t just move money. It changes how Prime sign-up and cancellation are supposed to work, and those changes apply to current subscribers too.

On sign-up, Amazon has to clearly disclose the price, how often you’ll be charged, the auto-renewal terms, and how to cancel before it collects your billing information. Sign-up pages have to include a clear button to decline Prime, without the guilt-inducing phrasing the FTC objected to, like “No, I don’t want Free Shipping.” The “double-stacked” sign-up buttons that made accidental enrollment easy are prohibited.15FTC. On cancellation, Amazon must provide a mechanism that is not “difficult, costly, confusing, or time-consuming,” available through at least the same medium you used to sign up. An independent, court-appointed supervisor is monitoring both the refund distribution and Amazon’s compliance with the conduct rules. Amazon has to file a formal compliance report within one year and report structural changes to the FTC for five years.15FTC.
