What the Claim Form Offered
The settlement resolved a class action over a 2020 ransomware attack on Gallagher’s internal network that exposed personal, financial, and medical information for more than three million people. Class members who submitted a timely claim could select any combination of the following benefits.
Three years of credit and identity monitoring. Enrollment in Cyex Identity Defense Total, which includes three-bureau credit monitoring and at least $1,000,000 in fraud and identity theft insurance. You had to select this on the claim form to activate it.2Arthur J. Gallagher Data Breach Litigation. Exhibit E – Claim Form
Reimbursement for documented losses, up to $6,000. Covered expenses included fraud and identity theft losses traceable to the breach, professional fees for attorneys, accountants, or credit repair, costs of freezing or unfreezing credit, self-purchased credit monitoring after the breach, and miscellaneous costs like notary fees, postage, copying, mileage, and long-distance phone charges. Receipts, bank statements, invoices, or credit card statements were required as proof. If total documented claims exceeded the available fund, payments would be reduced proportionally.2Arthur J. A pro rata cash payment. Class members without documented losses could instead claim a share of whatever remained in the $21 million fund after fees, administration costs, and documented-loss claims were paid. The per-person amount depends on how many people selected this option.2Arthur J. Gallagher Data Breach Litigation. Exhibit E – Claim Form
A California statutory payment of up to $100. California residents who lived in the state at any point between June 3, 2020, and the end of the claims period could claim this additional amount under the California Consumer Privacy Act, on top of any other benefit selected.2Arthur J.
