Advanced Annual Leave for Federal Employees: Limits and Repayment

Federal agencies can let you borrow annual leave you haven’t earned yet. Under 5 U.S.C. 6302(d), an agency head may grant advanced annual leave for federal employees up to the amount they would accrue during the rest of the current leave year.1Office of the Law Revision Counsel. 5 USC 6302 – General Provisions It’s discretionary, not an entitlement, so your agency can say no. When approved, it keeps you in paid status while you draw against future accruals.

How Much Leave You Can Borrow

The ceiling is simple in concept: no more than you would accrue between now and the end of the leave year. What that adds up to depends on your years of federal service.2Office of the Law Revision Counsel. 5 USC 6303 – Annual Leave Accrual

  • Under 3 years of service: 4 hours per biweekly pay period, roughly 13 days a year.
  • 3 to 14 years: 6 hours per pay period, with 10 hours in the final pay period of the leave year, roughly 20 days a year.
  • 15 or more years: 8 hours per pay period, or 26 days a year.

Because the cap is what you’d still earn, it shrinks as the year goes on. A request in February has many pay periods left to draw against; a request in October has few. The federal leave year is not the calendar year — it starts on the first day of the first complete biweekly pay period in January and ends the day before the first complete pay period the following January, so the exact dates shift slightly each year.3eCFR. 5 CFR Part 630 Subpart B – Definitions and General Provisions for Annual and Sick Leave Check your agency’s leave calendar for the current cutoff.

Whether Your Agency Will Approve It

Approval is entirely at the agency’s discretion. OPM recommends that approving officials weigh three things: whether the employee is expected to return to duty long enough to earn the leave back, whether the agency needs the employee’s services, and whether retaining the employee benefits the agency.4U.S. Office of Personnel Management. Fact Sheet: Advanced Annual Leave If there’s reason to believe you won’t be coming back, such as a pending disability retirement application, the agency generally should not approve the advance.

Because it isn’t an entitlement, grievance options after a denial are limited. Make the request easy to approve: state why you need the time, how many hours you’re asking for, and when you’ll return.

How to Request Advanced Annual Leave

The standard vehicle is OPM Form 71, the same form used for any leave request.5Office of Personnel Management. OPM Form 71 – Request for Leave or Approved Absence Most agencies use an electronic equivalent through their HR portal; a fillable PDF is available on OPM’s website if your agency accepts paper.

On the form, check the box for advanced annual leave (it’s separate from regular annual leave), enter the start and end dates of the absence, and list the total hours. Use the remarks section to explain why you need to borrow rather than use your current balance. A brief, specific explanation carries more weight than a vague reference to personal reasons. The form also includes a certification that falsifying information can result in disciplinary action.

Your supervisor reviews the request against staffing needs and the OPM factors above. If approved, the form moves to payroll for processing. Straightforward requests are usually decided within a few business days; longer absences or unusual circumstances may take longer if HR gets involved.

Paying Back the Negative Balance

Once payroll processes the advance, your leave balance goes negative. Each pay period’s accrual then applies to the deficit instead of adding to usable leave. Until the balance climbs back to zero, you have no annual leave available for anything else. A surprise need in that stretch means using sick leave if it qualifies, requesting leave without pay, or asking for another advance. Borrowers who take the maximum early in the leave year sometimes spend months without usable annual leave, so borrow what you actually need rather than what you could get.

OPM allows an employee to repay advanced leave in cash rather than waiting for accruals to erase the debt, if the agency agrees and it’s administratively feasible. The pay rate used for that calculation is the rate that was in effect when the advanced leave was taken, not your current rate.4U.S. Office of Personnel Management. Fact Sheet: Advanced Annual Leave

What Happens If You Leave Federal Service

Separating while you still owe advanced leave triggers a mandatory repayment under 5 CFR 630.209. The agency must either require you to refund the amount paid for the unearned leave or deduct it from your final pay.6eCFR. 5 CFR 630.209 – Refund for Unearned Leave The rate used is the hourly rate in effect when you took the leave, not your rate at separation.4U.S. Office of Personnel Management. Fact Sheet: Advanced Annual Leave If you took 40 hours when your hourly rate was $30, the debt is $1,200 regardless of raises since.

The repayment requirement does not apply in three situations:

  • Death of the employee. The debt is not pursued against the estate.
  • Disability retirement. The debt is forgiven.
  • Separation or resignation due to disability, if the agency determines on medical evidence that the disability is the basis for the separation.6eCFR. 5 CFR 630.209 – Refund for Unearned Leave

Outside those three, the government collects. Voluntary resignation, termination for cause, and reduction in force all trigger the refund. The regulations don’t provide a general hardship waiver or installment plan, though individual agencies may have internal procedures if the final paycheck doesn’t cover the debt.

Military Service

An employee who enters active military duty with restoration rights is not treated as having separated. The debt sits on the books until you return to federal service and work it off through accruals, or formally separate later.4U.S. Office of Personnel Management. Fact Sheet: Advanced Annual Leave

Transferring to Another Federal Agency

A move between federal agencies doesn’t erase a negative leave balance. The losing agency certifies your annual leave account, deficit included, to the gaining agency, which picks up where the old one left off. Agencies are specifically prohibited from requiring you to clear the debt before you transfer.7U.S. Office of Personnel Management. Fact Sheet: Leave Upon Transfer or Separation The debt follows you, but it won’t block the move or force a lump-sum payment.

Advanced Annual Leave With FMLA and Sick Leave

Federal employees covered by the Family and Medical Leave Act can use annual leave, including advanced annual leave, to stay in paid status during their 12 weeks of FMLA-protected absence. FMLA leave for federal workers is unpaid by default, so substituting annual leave keeps a paycheck coming while your job is protected. FMLA provides job protection; advanced annual leave provides pay. They solve different problems and can run at the same time.

For a medical situation, also consider advanced sick leave, which operates under separate rules. Agencies can advance up to 240 hours (30 days) of sick leave to a full-time employee for qualifying medical needs, a much higher flat cap than most employees’ annual leave advancement ceiling.8U.S. Office of Personnel Management. Fact Sheet: Advanced Sick Leave Advanced sick leave can only be used for purposes that qualify under sick leave rules: your own illness, medical appointments, caring for a family member with a serious health condition, and similar situations. Advanced annual leave is more flexible because annual leave can be used for any purpose, but the maximum is typically lower. For a serious medical event, many employees use a combination of both.
