Evidence to Assemble Before You Call

The request rises or falls on documentation. Have everything ready before you contact USCIS, because officers sometimes ask for materials on the spot.

For travel related to a death, gather a letter from the funeral home or hospital, a death certificate or obituary, and proof of your relationship to the deceased such as a birth or marriage certificate. If you need medical treatment abroad yourself, provide a doctor’s letter explaining why the treatment is pressing and why it must happen outside the United States. Professional commitments call for a letter on company letterhead, a meeting agenda, or a formal invitation showing why your presence is critical. Any document not in English needs a certified English translation. Include a cover letter that names your expedite category and ties each exhibit to it. Label the exhibits so the officer does not have to guess what they are looking at.

How to File the Request

Emergency Advance Parole for Travel Within 15 Days

Call the Contact Center at 800-375-5283 or request an appointment through the “My Appointment” portal on the USCIS website. If your situation qualifies, USCIS schedules you at a local field office. Bring:

  • A completed and signed new Form I-131 with any applicable filing fee. Even if you already have one pending, you file and pay for a fresh one at this appointment.
  • Evidence of your eligibility for the travel document, such as your I-485 receipt notice.
  • Evidence of the emergency itself, such as a death certificate, hospital records, or an employer letter with the imminent deadline.
  • Two passport-style photos.

What Happens After You Submit

USCIS reviews expedite requests case by case and communicates its decision through your online account, email, or physical mail. The agency has not published a guaranteed response time, so do not plan around a specific number of days. Three outcomes are possible: approval, denial of the expedite (your application stays in the normal queue), or a request for additional evidence. If more evidence is requested, respond through the specified channel immediately. Delay at that stage defeats the purpose of asking.

An approved expedite moves your Form I-131 to the front of the line for adjudication. When the travel document itself is approved, it is mailed to the address on file or held for pickup at a local office. Check the name, dates, and number of entries allowed before you book travel, because an error on the document can cause problems at the port of entry.

If Your Request Is Denied

There is no formal appeal. The decision is discretionary, not a legal ruling that triggers appeal rights. Your underlying Form I-131 keeps processing at normal speed, so a denial does not end your application; it just puts you back in the regular queue.

You can file a new expedite request when your circumstances change or you have stronger evidence. If you think the denial rested on a misunderstanding, such as an officer reviewing an earlier submission instead of your updated one, call the Contact Center and ask to have the case reviewed by a Tier 2 officer. Be specific about what new evidence you provided and how it differs from anything sent before.

The Risk That Overshadows Everything

The most costly mistake in this process is leaving the country before the advance parole document is approved and in your hands. If you already hold a valid advance parole document and have a second Form I-131 pending (a renewal, for instance), you can travel on the existing valid document without abandonment, but only if it covers the full duration of your trip.
