An advance designation of representative payee is a filing you make with the Social Security Administration that lists up to one, two, or three people, in order of preference, whom you’d want to manage your Social Security or SSI payments if the agency ever decides you can no longer manage them yourself.1Social Security Administration. Advance Designation of Representative Payee It’s voluntary, it’s forward-looking, and it doesn’t take effect unless and until the SSA formally finds you need a payee. Filing one now means the agency has your wishes on record instead of picking someone on your behalf later.
A Power of Attorney Does Not Cover Social Security
This is the misunderstanding worth clearing up first. A power of attorney, general or financial, does not give anyone authority over your Social Security or SSI benefits. The U.S. Treasury does not recognize power of attorney for negotiating federal payments.2Social Security Administration. Frequently Asked Questions for Representative Payees The only person who can legally receive and manage those payments for you is a representative payee appointed by the SSA. Advance designation is how you influence that appointment before you need it. Without one, the SSA works from its own preference list, and the person it lands on may not be the person you would have chosen.
Who Can File One
You can submit an advance designation if you’re 18 or older, or an emancipated minor, and you’re either already receiving benefits or have an application pending.3Social Security Administration. 20 CFR 404.2018 – Advance Designation of Representative Payees It covers Title II Social Security retirement and disability benefits, Title VIII Special Veterans Benefits, and Title XVI Supplemental Security Income.4Social Security Administration. GN 00502.085 – Advance Designation of Representative Payee
You have to be mentally capable of making the designation when you submit it. Filing doesn’t say anything about your current capacity. If you’re applying for benefits for the first time, you can include the designation with your application. If you already receive benefits, you can add one whenever you want.
Who You Can Name
You can name up to three individuals and rank them in the order you’d like the SSA to consider them.5Social Security Administration. Representative Payee Program Organizations cannot be advance designees. Only people.3Social Security Administration. 20 CFR 404.2018 – Advance Designation of Representative Payees The SSA generally favors family members, close friends, or others who have shown genuine concern for your well-being.
Your ranking is a preference, not a guarantee. When activation time comes, the SSA runs a suitability review on the person at the top of your list, including identity verification and a criminal background check.6Social Security Administration. GN 00502.130 – Factors to Consider in Evaluating Payee Applicants Some criminal history is disqualifying regardless of your wishes.
Who Can’t Serve
The SSA will not appoint someone convicted of violating the fraud provisions of the Social Security Act. Anyone convicted of a crime resulting in more than one year of imprisonment is also barred, though the SSA can make an exception if the conviction poses no risk to the beneficiary.7Social Security Administration. 20 CFR 404.2022 – Who May Not Serve as a Representative Payee On top of that, felony convictions for any of the following create an automatic bar:
- Human trafficking, kidnapping, or false imprisonment
- Rape or sexual assault
- First-degree homicide or robbery
- Fraud to obtain government assistance, fraud by scheme, or theft of government funds
- Abuse or neglect
- Forgery, identity theft, or identity fraud
Attempts and conspiracies to commit any of those disqualify a person too. There’s a narrow exception for a custodial parent, custodial spouse, custodial grandparent, or court-appointed guardian, who may still be considered despite one of these convictions, though the criminal history factors into the overall suitability decision.7Social Security Administration. 20 CFR 404.2022 – Who May Not Serve as a Representative Payee A presidential or gubernatorial pardon removes the automatic bar, but the SSA still weighs the history.
The SSA also looks skeptically at anyone the beneficiary owes money to. Creditors are generally disfavored because the financial conflict undercuts the point of having a disinterested person manage the funds.6Social Security Administration. GN 00502.130 – Factors to Consider in Evaluating Payee Applicants When picking your designees, pick people with no financial stake in your benefits.
How to File
Four channels are open to you:4Social Security Administration. GN 00502.085 – Advance Designation of Representative Payee
- Online, through your personal my Social Security account at ssa.gov
- By phone at 1-800-772-1213 (TTY 1-800-325-0778)
- In person at your local Social Security field office
- By mail, using Form SSA-4547, Advance Designation of Representative Payee
For each person you name, the SSA collects a full name and phone number. Their relationship to you is optional.1Social Security Administration. Advance Designation of Representative Payee If you list more than one, rank them, because the SSA will contact them in that order.
Once you’ve filed, the SSA sends you an annual notice listing your current designees so you can review and update them.1Social Security Administration. Advance Designation of Representative Payee The designation itself never expires.
What Happens When It Activates
Your designation stays dormant until the SSA formally determines you can no longer manage your own benefit payments. Nothing happens automatically. The agency must affirmatively find that representative payment is in your best interest before it contacts anyone on your list.8Social Security Administration. 20 CFR 416.601 – Introduction
The usual way the SSA reaches that finding is Form SSA-787, a questionnaire it sends to your doctor asking for a medical opinion on whether you can manage or direct the management of your funds.9Social Security Administration. GN 00502.040 – Developing Medical Evidence of Capability Other medical reports are also acceptable, so long as the doctor addresses your ability to handle finances, explains the basis, and dates the document. The medical evidence must be less than a year old, and the SSA needs a signed authorization (Form SSA-827) before contacting your doctor.
Once the SSA decides you need a payee, it reaches out to your first designee. That person then has to file Form SSA-11-BK, Request to be Selected as Payee, which starts the formal suitability investigation.10Social Security Administration. GN 00502.115 – The SSA-11-BK, Request to be Selected As Payee The investigation covers identity, criminal history, relationship to you, whether the applicant is a creditor, their living situation, and their ability to meet your current needs.6Social Security Administration. GN 00502.130 – Factors to Consider in Evaluating Payee Applicants
If the first person doesn’t work out (unsuitable, unwilling, or unable), the SSA moves to the second name, then the third. If none of your designees pan out, the SSA picks a payee through its standard process, which is the outcome the whole exercise is meant to avoid.
Changing or Revoking Your Designation
You keep full control as long as you’re capable of making changes. Update or withdraw at any time through the same four channels you used to file.1Social Security Administration. Advance Designation of Representative Payee Any new submission replaces what’s on file. Your authority to make changes ends only if the SSA determines you’ve become incapable of managing your benefits, which is the same finding that triggers activation. That’s a good reason to revisit your list periodically. The annual notice from the SSA is a built-in prompt.
What You’re Asking Your Designee to Take On
The person you name isn’t just holding money for you. If appointed, a representative payee has to spend your benefits in a strict order: food and shelter first (rent, mortgage, utilities, groceries), then medical and dental costs not covered by insurance, then personal needs like clothing and recreation, with anything left over saved, preferably in U.S. Savings Bonds or an interest-bearing account.11Social Security Administration. A Guide for Representative Payees If you’re in a nursing home or other institution, the payee pays facility fees and sets aside at least $30 a month for your personal needs.
Every year, the payee has to file an accounting report with the SSA documenting how the money was spent. Payees 18 or older can complete it online; younger payees use the paper form the SSA mails.12Social Security Administration. Internet Representative Payee Accounting Report A payee who converts benefits to their own use commits a federal crime punishable by fine, up to five years in prison, or both, and is permanently barred from serving again.13Office of the Law Revision Counsel. 42 USC 1383a – Penalties for Fraud
One practical note when you’re picking names: individual payees (family, friends, neighbors) cannot charge a fee for the work. Only SSA-authorized organizations can collect a fee.14Social Security Administration. Fee for Services Performed as a Representative Payee Naming a trusted individual means none of your benefit is siphoned off in fees, which is one more reason to make the choice while you still can.
