An address of record is the official mailing address a court, government agency, or organization keeps on file for sending you legal documents and formal notices. In most legal contexts, anything mailed to that address counts as delivered whether you actually receive it or not. That single rule is why keeping your address of record current matters far more than an ordinary change-of-address errand: a stale one can cost you a lawsuit, your right to challenge an IRS assessment, or, for non-citizens, your ability to stay in the country.
Where You Have an Address of Record
You probably have several, and they don’t sync with each other. Courts hold one for every case you’re a party to. The IRS holds one for your tax file. The Social Security Administration holds one for benefits and statements, and you can update it online, by phone, or at a local office.1Social Security Administration. If you own a business, the company has its own addresses of record. Every state requires a registered agent with a physical address where official legal documents can be delivered on the company’s behalf, separate from the principal office where the business actually operates.3U.S. Small Business Administration. Why Mail to That Address Legally Counts as Received
This is the part most people miss. The legal system generally treats a document mailed to your address of record as received the moment it leaves the sender, regardless of whether you open it, read it, or still live at that address.
Under the Federal Rules of Civil Procedure, serving a document by mailing it to a party’s last known address completes service when the envelope is mailed.4Legal Information Institute. Federal Rules of Civil Procedure Rule 5 – Serving and Filing Pleadings and Other Papers If no address is known at all, the papers can simply be left with the court clerk. The system assumes the burden of keeping the address current sits with you.
When a defendant never sees a summons because it went to an old address, the court can enter a default judgment and the plaintiff wins by forfeit. Reopening a default is possible but hard: you generally need both a legitimate reason for missing the deadline and a real defense to the underlying claim. “I moved” is rarely enough on its own.
The IRS Last Known Address Rule
The IRS operates under a statute that makes your address of record uniquely high-stakes. A notice of deficiency, sometimes called a 90-day letter, is legally sufficient if the IRS mails it to your last known address. That remains true if you’ve moved, if you never receive the notice, and even if you’re deceased or legally incapacitated.5Office of the Law Revision Counsel. 26 US Code 6212 – Notice of Deficiency
A notice of deficiency gives you 90 days to petition the Tax Court before the IRS can assess and collect the tax. If the letter goes to an address you left two years ago, the clock runs anyway. By the time you find out, your right to challenge the assessment in Tax Court may already be gone. The IRS puts it plainly: penalties and interest accrue on any deficiency whether or not you actually received the notice.6Internal Revenue Service. Form 8822 – Change of Address
A USPS Forwarding Order Does Not Update Your Address of Record
Filing a change of address with the U.S. Postal Service only tells the mail carrier to reroute your physical mail. It does not tell the IRS, the Social Security Administration, the courts, licensing boards, or voter registration anything.7USPS. Standard Forward Mail and Change of Address Each agency has to be told separately.
Forwarding also expires, typically after 12 months. Once it lapses, mail to your old address gets returned or discarded, and any legal deadlines running against you keep running silently.
Deadlines to Report an Address Change
The timelines vary by agency, and some carry real teeth.
- Non-citizens (USCIS): 10 days from the move, using Form AR-11. A and G visa holders and visa waiver visitors are exempt.8U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card

- Federal courts: Parties and attorneys are expected to file a notice of change of address in every active case before the next filing or hearing.
- Professional licensing boards: Varies by state and profession; 30 days is a common window.
How to Update Your Address of Record
No single form covers everything. Start by listing every place that holds one: courts with any active case, federal and state tax agencies, Social Security, the DMV, any professional licenses, voter registration, and any business entity filings you’re responsible for.

What Happens if You Don’t Update It
The consequences scale with the agency involved.
Default Judgments
A summons or hearing notice sent to an outdated address can produce a default judgment you don’t learn about until it hits your credit report or a creditor starts garnishing wages. Because service was technically valid, “I didn’t know” is rarely a sufficient basis to undo it.
Tax Assessments You Can’t Appeal
The IRS can assess tax, penalties, and interest based on a notice of deficiency you never saw, as long as it went to your last known address.5Office of the Law Revision Counsel. 26 US Code 6212 – Notice of Deficiency By the time you find out, the 90-day window to petition the Tax Court is often closed.6Internal Revenue Service. Immigration Penalties
Failing to report a change of address to USCIS within 10 days is a misdemeanor punishable by a fine of up to $200, up to 30 days in jail, or both. A non-citizen who fails to report can also be taken into custody and removed from the country, unless they can show the failure was reasonably excusable or not willful.11GovInfo. 8 US Code 1305 – Notices of Change of Address
Licensing and Business Standing
Licensed professionals who miss renewal notices can rack up late fees and, in some states, face investigations for lapsed compliance. A business whose registered agent address goes stale can lose good standing with the state, which may bar it from filing lawsuits, enforcing contracts, or completing other official filings until the deficiency is fixed.
