A C09 work permit is the Employment Authorization Document (EAD) issued to people who have a pending Form I-485, Application to Register Permanent Residence or Adjust Status. The “C09” comes from eligibility category (c)(9) on Form I-765, the form you file to request the card. As of December 2025, a newly issued C09 EAD is valid for up to 18 months, the filing fee is $260 for most applicants, and — this is the change that matters most in 2026 — there is no longer any automatic extension of your work authorization while a renewal is pending.
Who Qualifies
The only core requirement is a properly filed, still-pending Form I-485.1U.S. Citizenship and Immigration Services. You also have to be admissible to the United States. Certain health conditions, criminal history, and security concerns can make a person inadmissible under federal law, and vaccination requirements apply to anyone seeking a green card.3Office of the Law Revision Counsel. 8 USC 1182 – Inadmissible Aliens These issues surface during I-485 review and can affect the EAD too.
One trap: unauthorized employment before you filed your I-485. How to Apply
You apply by submitting Form I-765, Application for Employment Authorization. USCIS accepts it online or by mail. - A copy of your I-485 receipt notice (Form I-797C) showing the adjustment case is pending.
- Two passport-style photos meeting USCIS specifications (paper filing only; online filers upload a digital photo).
- A copy of your passport, visa, or other government-issued identification.
- Copies of any prior EADs.

Fees and Fee Waivers
Because every C09 applicant by definition has a pending I-485, USCIS charges the reduced Form I-765 fee of $260, whether you file online or on paper. Biometrics costs are built in; there is no separate biometrics fee. Processing Times and Expedite Requests
USCIS does not publish a guaranteed timeline for C09 applications. Wait times move with the workload at each service center. A clean application avoids Requests for Evidence, which can add weeks or months. If USCIS schedules a biometrics appointment, go. Missing it stalls the case.
Expedite requests require more than a need to work. USCIS looks for severe financial loss, an emergency, or other compelling circumstances — for example, that the delay will cost you your job, force your employer to lay off other workers, or cut off critical benefits.9U.S. Citizenship and Immigration Services. How Long a C09 Permit Lasts
On December 5, 2025, USCIS reduced the maximum validity period for newly issued C09 EADs from five years to 18 months.10U.S. Citizenship and Immigration Services. Any C09 EAD issued now, including a renewal, carries the shorter window, so most applicants will renew more often while the I-485 is pending.
When to File a Renewal
File the renewal no earlier than 180 days (six months) before your current EAD expires, and no later than 90 days before expiration.2U.S. Citizenship and Immigration Services. No More Automatic Extension
This is the single biggest change facing C09 applicants in 2026. Before, a timely-filed EAD renewal automatically extended your work authorization for up to 540 days while USCIS processed the case. That automatic extension ended on October 30, 2025.11U.S. Citizenship and Immigration Services. There is no grace period and no bridge authorization while you wait.
The practical result is stark. If USCIS takes months to process your renewal and your existing EAD expires in the gap, you cannot legally work, and your employer must remove you from the payroll until the new card arrives. Filing early within the 180-day window is now much more urgent than it used to be. If your renewal is already pending and your EAD is nearly out, an expedite request based on imminent job loss may be your only real lever.

Lost, Stolen, or Damaged Cards
To replace a lost, stolen, or defective EAD, file a new Form I-765 with documentation of the problem, such as a police report for a stolen card. The $260 fee applies unless you qualify for a waiver.
The C09 Does Not Authorize Travel
A C09 work permit is not a travel document. If you leave the United States while your I-485 is pending without first getting advance parole, USCIS will generally treat your adjustment case as abandoned, and you may not be allowed back in.13U.S. Citizenship and Immigration Services. Using the EAD at Work
The C09 EAD (Form I-766) is a List A document for Form I-9 purposes. It establishes both identity and work authorization on its own, so your employer cannot demand additional documents.15U.S. Citizenship and Immigration Services. Form I-9 Acceptable Documents
There is also a protective rule worth understanding. Federal regulations provide that while your I-485 is pending, you are not considered an “unauthorized alien” for purposes of the INA 245(c)(8) employment bar, as long as you have a valid EAD or had employment authorization that hasn’t expired during the pendency of your case.16eCFR. 8 CFR Part 274a – Control of Employment of Aliens Working legally on your C09 will not sink your green card case. Common Reasons for Denial
Most C09 denials fall into a handful of predictable categories:
- No pending I-485. The C09 depends entirely on an active adjustment case. If your I-485 was never properly filed, was rejected for insufficient fees, or has already been decided, the C09 has nothing to attach to.
- Unauthorized employment before filing the I-485, other than for immediate relatives of U.S. citizens.17U.S. Citizenship and Immigration Services. USCIS Policy Manual, Volume 7, Part B, Chapter 6 – Unauthorized Employment
- Unresolved inadmissibility issues such as criminal charges, security flags, or missing vaccinations.3Office of the Law Revision Counsel. 8 USC 1182 – Inadmissible Aliens
- Incomplete application: missing signatures, wrong eligibility category, missing receipt notice, or insufficient photos.
A denial notice will state the reason. Some problems can be cured by refiling. Others, especially inadmissibility grounds, may require a waiver or legal representation.
If Your I-485 Is Denied
Your C09 exists only because your I-485 is pending. If USCIS denies the adjustment application, your work authorization can be terminated before the date printed on your EAD.18U.S. Citizenship and Immigration Services.
