Firefighters who worked at the September 11, 2001, crash sites can access two federal benefits: free medical care through the World Trade Center Health Program and cash compensation through the September 11th Victim Compensation Fund. Both were created by the James Zadroga 9/11 Health and Compensation Act of 2010 and cover responders at the World Trade Center in New York City, the Pentagon, and the Shanksville site in Pennsylvania.1Centers for Disease Control and Prevention. The two programs run separately. A firefighter has to qualify for each one on its own terms, and the health program certification is what unlocks a compensation claim.
Qualifying for the WTC Health Program
The WTC Health Program covers medical monitoring and treatment at no cost. To enroll as a responder, a firefighter has to have worked at an eligible location for a minimum number of hours. Eligible locations include Lower Manhattan south of Canal Street, the Staten Island Landfill, and certain barge loading piers used for debris removal.2World Trade Center Health Program. The hour thresholds get looser the earlier you arrived:
- September 11–14, 2001: at least 4 hours at an eligible location.
- September 11–30, 2001: at least 24 hours at an eligible location.
- September 11, 2001 through July 31, 2002: at least 80 hours at an eligible location.

What the Health Program Pays For
Enrolled firefighters get annual medical monitoring to catch problems early, plus specialized treatment for any certified condition. The pharmacy benefit is administered by Express Scripts and covers prescriptions for certified conditions at no cost, filled at in-network retail pharmacies or through home delivery. Which Illnesses Are Covered
The federal list of WTC-related conditions falls into a few broad categories.4eCFR. 42 CFR 88.15 – List of WTC-Related Health Conditions
Aerodigestive disorders are the most common, reflecting the dust cloud of pulverized concrete, asbestos, and chemical debris. Covered conditions include asthma, chronic cough syndrome, chronic obstructive pulmonary disease, interstitial lung diseases, and gastroesophageal reflux disease.
Cancers on the list are broad: lung, prostate, and blood and lymphoid tissue cancers such as lymphoma, leukemia, and myeloma. The program also covers rare cancers (fewer than 15 cases per 100,000 people per year) and childhood cancers diagnosed in anyone who was under 20 while present at the sites.
Mental health conditions covered include post-traumatic stress disorder, major depressive disorder, panic disorder, generalized anxiety disorder, substance abuse, and acute stress disorder.
Secondary conditions that develop from a certified illness or its treatment can also be covered. Sleep apnea arising from a certified airway disorder is one example.5World Trade Center Health Program. Qualifying for the Victim Compensation Fund
The VCF pays money. Its geographic and time requirements are its own, separate from the health program’s. For the New York City site, the VCF exposure zone covers Manhattan south of a line running along Canal Street from the Hudson River to East Broadway, north on East Broadway to Clinton Street, and east on Clinton Street to the East River, plus debris removal routes such as barges and the Fresh Kills Landfill.6VCF. A VCF claim also requires a certified health condition from the WTC Health Program. That certification is the official medical link between the illness and the disaster site, and without it a compensation claim cannot proceed.
Registration and Filing Deadlines
The VCF has two deadlines, and they work differently. This is where firefighters get tripped up.
Registration preserves the right to file later. It is not the same as filing a claim. The registration deadline is individual: a responder generally must register within two years of the date they knew, or reasonably should have known, that they had a 9/11-related physical harm and were eligible.8VCF.gov. Eligibility Criteria and Deadlines The clock can start before any formal diagnosis, so registering early, even without a diagnosis, protects the option.
The claim filing deadline is October 1, 2090, and it is the same for everyone.8VCF.gov. Eligibility Criteria and Deadlines But 2090 only helps if registration happened on time. Missing the registration window can forfeit the right to file at all.
Documentation
What you have to submit depends on who you were on 9/11. For FDNY uniformed firefighters deployed to the NYC exposure zone as part of official duties, the VCF pulls presence information directly from the FDNY. Those firefighters should not submit their own proof-of-presence documents; sending extra material the VCF did not request actually slows processing.9September 11th Victim Compensation Fund. Retired FDNY members, volunteers, and firefighters from other departments have to prove they were at a crash site or in the exposure zone during the eligible timeframe themselves. The VCF works with employers, unions, and other organizations to help locate records. Acceptable proof varies, and third-party letters on official letterhead can sometimes substitute when direct employer records are not available.7September 11th Victim Compensation Fund. Every claimant also needs their WTC Health Program certification documents and standard personal identification. Claims are filed through the online portal at vcf.gov, with documents uploaded as PDFs.
How the Award Is Calculated
The VCF uses a set formula: non-economic loss plus economic loss, minus collateral offsets.10VCF. Section 2 – Calculation of Loss (Compensation) Non-economic loss compensates for pain and suffering. Economic loss covers lost earnings and other financial harm caused by the illness.
Offsets catch a lot of firefighters off guard. The VCF subtracts payments the responder received, or became entitled to receive, from other sources because of the same 9/11-related injury. Common offsets include:
- Pension fund payments tied to the disability
- Life insurance proceeds
- Social Security disability or survivor benefits
- Workers’ compensation payments
- Settlements from 9/11-related lawsuits
The VCF verifies offsets directly with agencies like the Social Security Administration, the FDNY, and the New York State Workers’ Compensation Board. Failing to disclose offset information can get a claim deactivated entirely.10VCF. Section 2 – Calculation of Loss (Compensation)
Firefighters who are terminally ill or facing significant financial hardship can request an expedited review. It requires a written request with supporting documentation and is evaluated case by case. Many responders hire an attorney for the process; attorney fees on VCF claims are legally capped to protect claimants.
Taxes on VCF Awards
VCF payments for physical injuries or death resulting from the September 11 attacks are not included in income for federal tax purposes. That applies to lump-sum and periodic payments, and to payments made to survivors of firefighters who died. A decedent’s estate also does not have to report VCF award funds as gross income. Appeals
If the VCF denies eligibility or issues an award amount a firefighter believes is wrong, an appeal must be filed within 30 days of the decision letter. Appeals are only available when the eligibility denial or award letter includes an Appeal Request Form; not every determination is appealable.12September 11th Victim Compensation Fund.
