9/11 Cancer Claims: Eligibility, Filing, and Awards

You can file a 9/11 cancer claim with the September 11th Victim Compensation Fund if you were physically present at one of the three crash sites during its covered exposure window and have since been diagnosed with a cancer certified as 9/11-related. In almost every case, filing means first enrolling in the World Trade Center Health Program, getting your cancer certified there, and then submitting a completed VCF claim with proof of your presence. The fund is authorized to accept claims through October 1, 2090.1September 11th Victim Compensation Fund. Permanent Authorization of the September 11th Victim Compensation Fund

Who Qualifies

Two things have to be true. You were at a covered location during its window, and you have a cancer the program recognizes as linked to 9/11 exposure.

The three locations and their exposure windows are:2September 11th Victim Compensation Fund. September 11th Victim Compensation Fund

  • New York City: September 11, 2001 through May 30, 2002
  • The Pentagon: September 11, 2001 through November 19, 2001
  • Shanksville, Pennsylvania: September 11, 2001 through October 3, 2001

The New York City Exposure Zone covers Manhattan south of Canal Street, extending along East Broadway to Clinton Street and east to the East River. It also reaches the debris-removal routes, the barges, and the Fresh Kills Landfill, but only for people who actually loaded, unloaded, drove debris trucks, worked the barges, or worked at the landfill.3September 11th Victim Compensation Fund. Eligible people fall into two groups. Responders are firefighters, police officers, EMTs, and cleanup workers who assisted at a crash site. Survivors are residents, workers, and students who lived, worked, or attended school in the NYC Exposure Zone, along with people who were routinely present for reasons like commuting or medical appointments.4World Trade Center Health Program. Cancers the Program Covers

The World Trade Center Health Program recognizes a broad list of cancers, including melanoma and non-melanoma skin cancers, digestive cancers such as colon and rectal, respiratory cancers including lung and bronchus, and blood and lymphoid cancers such as leukemia, lymphoma, and myeloma. Rare cancers and cancers diagnosed in people who were children in the Exposure Zone can also qualify.5World Trade Center Health Program. Covered Conditions

Each cancer type has a minimum latency period: enough time has to have passed between September 11, 2001, and diagnosis for the cancer to plausibly be linked to exposure.6Centers for Disease Control and Prevention. Minimum Latency and Types or Categories of Cancer

  • Blood and lymphoid cancers (leukemia, lymphoma): 0.4 years, about 146 days
  • Childhood cancers other than blood or lymphoid, in people under 20: 1 year
  • Thyroid cancer: 2.5 years
  • Most solid cancers, including lung, colon, and skin: 4 years
  • Mesothelioma: 11 years

More than two decades on, latency rarely blocks a new diagnosis.

Get Your Cancer Certified First

Before you file with the VCF, you almost always need the World Trade Center Health Program to certify that your cancer is related to 9/11 exposure. That certification is what unlocks the compensation claim, and the program itself provides monitoring and treatment at no cost to members.7World Trade Center Health Program. Frequently Asked Questions

Enrollment has three steps. Identify which group applies to you: FDNY responders, general responders, NYC survivors, or Pentagon and Shanksville responders. Each group has different documentation requirements. Gather records showing your activity, location, time period, and hours at the site. Then submit your application online through the CDC’s OASIS portal, or by mailing a paper application.8Centers for Disease Control and Prevention. Apply – World Trade Center Health Program

Once you are enrolled, a program provider evaluates your cancer. If the provider finds your condition is substantially likely to be related to your 9/11 exposure, the program certifies it. That certification letter is what you carry into your VCF claim.7World Trade Center Health Program. Frequently Asked Questions

The Narrow Private Physician Exception

A small number of claimants can skip WTC Health Program certification and use the VCF’s Private Physician process instead. It is limited to specific situations: you are filing on behalf of a deceased person who was never certified, you live outside the continental United States, you do not meet the program’s enrollment criteria, or traveling to a program center would cause significant hardship. Everyone else should go through the standard route.9September 11th Victim Compensation Fund. Private Physician Process – Forms and Resources

Documents You Need to File

Assembling paperwork is the slowest part of the process. Before your claim enters substantive review, the VCF requires:10September 11th Victim Compensation Fund. Personal Injury Claim Document Checklist

  • A completed claim form and the signature page with an original ink signature. Electronic signatures are not accepted on the signature page.
  • The Authorization for Release of Medical Records (Claim Form Exhibit A), which lets the VCF pull your certification from the WTC Health Program.
  • Payment information: either a VCF ACH Payment Information Form for direct deposit to your bank account, or a Client Authorization Form routing payment through your attorney.
  • Proof of physical presence at a crash site. Employment records, pay stubs, rent receipts, school transcripts, and sworn witness statements all count. The VCF’s interactive Presence Guide walks you through what your specific situation requires.

If the WTC Health Program certified your cancer after July 1, 2011, you generally do not have to submit separate medical proof. The VCF gets that directly from the program. If you have received prior 9/11-related lawsuit settlement money or insurance payouts, include the settlement documents, releases, and policy payment records.

Two additions are optional but worthwhile: recent medical records showing the severity of your cancer, and a personal impact statement describing how the illness has affected your life. Neither is required to start review, but both can influence your non-economic loss award.

How to File

The VCF’s online Claims Management System is the primary filing channel. You complete the claim form there, upload your documents, and track status as your claim moves through review.11September 11th Victim Compensation Fund. Claims Management System A paper claim form is available if you cannot file online.

After submission, staff run a preliminary review for completeness: required signatures, needed documents, and jurisdictional eligibility. Anything missing generates a portal notification telling you what to add. Claims that clear preliminary review move to substantive review, where the VCF weighs your presence documentation, confirms your medical certification, and calculates your award. You then receive a formal award determination letter.

Expedited Review in Hardship Cases

The VCF can fast-track a claim in two narrow situations: the claimant is terminally ill, or the claimant faces imminent financial hardship, defined as active foreclosure, active eviction, or homelessness. Your claim must already be complete before you request expedited treatment; the VCF cannot expedite something that is still missing documents.12September 11th Victim Compensation Fund. What Your Award Will Include

A VCF award has up to two pieces. Non-economic loss pays for pain, suffering, and reduced quality of life. Economic loss pays for financial harm like lost income. Collateral offsets are then subtracted for certain payments you have already received from other 9/11-related sources.

Non-Economic Loss

Every claimant with a certified cancer receives a non-economic award. For a single cancer, awards generally range from $90,000 to $250,000, depending on cancer type and evidence of severity, metastasis, recurrence, or long-term complications. Non-melanoma skin cancers at the less severe end typically land around $90,000. Prostate cancer carries a presumptive $200,000 award, which can rise to $250,000 with evidence of recurrence, metastasis, or complications lasting more than two years after the last treatment.13September 11th Victim Compensation Fund. Non-Economic Loss Awards and Certified Conditions Fact Sheet

If you have multiple cancers, or cancer plus severe non-cancer conditions, the Special Master can raise the award above $250,000, up to a current maximum of $340,000. The $250,000 ceiling for a single cancer will not be exceeded.14September 11th Victim Compensation Fund. Section 2 – Calculation of Loss (Compensation)

Economic Loss

If your cancer forced you to stop working, cut hours, or retire early, you can claim lost earnings and benefits on top of the non-economic award. The VCF generally looks at your three highest-earning calendar years before your income declined, and projects future loss from that baseline. Federal law caps the annual economic loss calculation at $255,610 per year of loss.14September 11th Victim Compensation Fund. Section 2 – Calculation of Loss (Compensation) Economic loss also covers out-of-pocket medical expenses and the cost of replacing household services you can no longer perform. Claiming economic loss is optional; many claimants file only for non-economic loss.

Collateral Offsets

By law, the VCF subtracts certain payments you have already received for a 9/11-related condition. Offsets against a personal injury award include Social Security disability, workers’ compensation, disability pensions, private disability insurance, and prior 9/11 lawsuit settlement payments. Life insurance payouts and Social Security survivor benefits offset only wrongful death claims. Charitable donations, tax benefits under the Victims of Terrorism Tax Relief Act, and retirement compensation you would have received regardless are not offsets.14September 11th Victim Compensation Fund. Section 2 – Calculation of Loss (Compensation)

Attorney Fees

You do not have to hire an attorney, though many claimants do when economic loss calculations get complicated. Federal law caps attorney fees at 10% of your VCF award, and that cap covers both the fee and routine expenses. Fees come out of your award; the VCF does not reimburse them separately. If your attorney also represented you in a related 9/11 lawsuit, the combined charge for both matters cannot exceed 10% of that other award.15September 11th Victim Compensation Fund. When You Get Paid

Payment processing begins the business day after your award determination letter issues. The Special Master has up to 20 days to authorize payment, and the Department of Justice and Treasury take up to about three more weeks. Expect payment within roughly two months of your award letter. Awards are paid in full as a single lump sum.16September 11th Victim Compensation Fund. When Can I Expect to Receive Payment and Will the Payment Be Pro-Rated

The Deadlines That Actually Matter

The VCF separates registration from filing. Registration puts you on record as someone who may seek compensation later. You do not have to be sick to register, and it waives no legal rights.

For personal injury claims, you must register within two years of the date a federal, state, or local government entity notifies you that your condition is 9/11-related. For most people that means two years from the WTC Health Program’s certification of your cancer. If you receive a later certification for a new condition, the two-year clock restarts from that most recent certification.17September 11th Victim Compensation Fund. Registration and Claim Filing Deadlines

If you have a 9/11-related determination from the New York Workers’ Compensation Board or a NYC employer pension fund instead of a program certification, the two years run from that determination. If you qualify for the Private Physician process and the VCF verifies your condition, your registration deadline is treated as met. If no government determination exists yet, you may register at any time.17September 11th Victim Compensation Fund. Registration and Claim Filing Deadlines

The final date to file a completed claim is October 1, 2090, set by the 2019 permanent authorization legislation.1September 11th Victim Compensation Fund. Permanent Authorization of the September 11th Victim Compensation Fund Do not let that distant date mislead you. Missing the two-year registration window can lock you out even though filing itself remains open for decades.

Filing for a Family Member Who Has Died

If someone who would have qualified has died, a personal representative can file on their behalf. You need a formal appointment as personal representative, a complete claim form, and the additional Appendix A form.18September 11th Victim Compensation Fund. Section 6 – Deceased Victims

If the victim died after already filing a personal injury claim, what you do next depends on the cause of death. When the death was unrelated to 9/11, submit a Personal Representative amendment to the existing personal injury claim. When the death was caused by or possibly related to an eligible 9/11 condition, register a new deceased claim instead. The VCF warns that you must take one action or the other, not both.18September 11th Victim Compensation Fund. Section 6 – Deceased Victims

The two-year registration rule and the October 1, 2090 filing deadline apply to deceased claims as well. Getting appointed personal representative typically requires a probate court proceeding, with court costs that vary by jurisdiction.
