The Section 45V clean hydrogen production tax credit pays producers up to $3.00 per kilogram of qualified clean hydrogen, in 2022 dollars adjusted annually for inflation, over a ten-year period beginning when the facility is placed in service. To reach that top rate, a facility must produce hydrogen with lifecycle greenhouse gas emissions under 0.45 kilograms of CO2 equivalent per kilogram of hydrogen and meet federal prevailing wage and apprenticeship standards. Construction must begin before January 1, 2028, a deadline Congress moved forward by five years in 2025 through Pub. L. 119–21.1Office of the Law Revision Counsel. 26 U.S. Code 45V – Credit for Production of Clean Hydrogen
Who Qualifies
Three conditions define a qualified clean hydrogen production facility under the statute: the taxpayer must own it, it must produce qualified clean hydrogen, and construction must have begun before January 1, 2028.1Office of the Law Revision Counsel. 26 U.S. Code 45V – Credit for Production of Clean Hydrogen The original deadline was January 1, 2033, so producers with projects still on the drawing board face a compressed timeline.
Qualified clean hydrogen means hydrogen produced through a process with lifecycle greenhouse gas emissions of no more than four kilograms of CO2 equivalent per kilogram of hydrogen. Production must take place in the United States or its territories, and the credit period runs for ten years starting on the date the facility is originally placed in service.2Office of the Law Revision Counsel. 26 USC 45V – Credit for Production of Clean Hydrogen
Older hydrogen plants are not automatically excluded. A facility already operating before January 1, 2023 can qualify if it did not previously produce qualified clean hydrogen and is then modified to do so, provided the modification costs are capitalized. In that case, the facility is treated as placed in service on the date the modification is complete.3Federal Register. How Much the Credit Pays
Two variables set the credit amount: how clean the hydrogen is, and whether the producer meets federal labor standards. The base credit rate is $0.60 per kilogram in 2022 dollars, adjusted for inflation each year, and a facility receives a percentage of that rate based on its emissions tier.2Office of the Law Revision Counsel. 26 USC 45V – Credit for Production of Clean Hydrogen
The four tiers are:
- Tier 1, 2.5 to 4 kg CO2e per kg of hydrogen: 20 percent of the applicable rate
- Tier 2, 1.5 to less than 2.5 kg CO2e: 25 percent
- Tier 3, 0.45 to less than 1.5 kg CO2e: 33.4 percent
- Tier 4, less than 0.45 kg CO2e: 100 percent
At the base rate, a Tier 4 producer earns $0.60 per kilogram before inflation adjustment, and a Tier 1 producer earns roughly $0.12. Meeting prevailing wage and apprenticeship requirements multiplies the entire credit by five.2Office of the Law Revision Counsel. 26 USC 45V – Credit for Production of Clean Hydrogen With the multiplier, Tier 4 reaches $3.00 per kilogram and Tier 1 reaches $0.60, both in 2022 dollars. Miss the labor standards and the credit stays at the unmultiplied base rate regardless of emissions performance.
Prevailing Wage and Apprenticeship Rules
The five-times multiplier is the difference between a modest incentive and a decisive one, so the labor requirements do most of the financial work. Facilities must pay prevailing wages, set by the Department of Labor for each locality and job classification, to workers performing construction, alteration, and repair. That obligation runs during construction and for the full ten-year credit period.
The apprenticeship requirement calls for a set percentage of total construction labor hours to be performed by qualified apprentices in registered programs. If enough apprentices are not available, the producer must document good-faith efforts to request them from registered programs. Missing either standard eliminates the bonus. A correction mechanism exists for inadvertent failures, but it requires paying affected workers back wages plus a penalty, so getting compliance right up front costs far less than fixing it later.
Measuring Emissions With 45VH2-GREET
Emissions tier assignments are not producer estimates. Facilities must use the 45VH2-GREET model, developed by Argonne National Laboratory and adopted by Treasury for 45V purposes, which measures well-to-gate emissions from feedstock extraction through the point of hydrogen production.4U.S. Department of Energy. Guidelines to Determine Well-to-Gate Greenhouse Gas Emissions of Hydrogen Production Pathways Using 45VH2-GREET5Department of Energy. Clean Hydrogen Production Tax Credit 45V Resources A beginning-of-construction safe harbor lets producers lock in the version of the model available when they start construction or when the facility is placed in service, whichever they prefer, so mid-project updates to the model do not shift their tier.
The Three Pillars for Electricity-Based Production
Producers using electrolysis, or claiming a lower electricity carbon intensity than the regional grid average, must also meet three additional requirements, demonstrated through energy attribute certificates. The rules exist to prevent paper-only green claims backed by fossil-fuel power on the grid.
Incrementality requires the electricity to come from new clean generation. The generator must have begun commercial operations no more than 36 months before the hydrogen facility was placed in service, or must have added capacity within that window.6U.S. Department of the Treasury. U.S. Department of the Treasury Releases Final Rules for Clean Hydrogen
Temporal matching requires the clean electricity to be generated during the same period as the hydrogen production. Through 2029, annual matching is sufficient. Starting in 2030, matching must be hourly, meaning the clean generation and the hydrogen production have to fall in the same clock hour.
Deliverability requires the electricity source and the hydrogen facility to be in the same regional power grid, as defined by the Department of Energy’s National Transmission Needs Study.6U.S. Department of the Treasury. U.S. Department of the Treasury Releases Final Rules for Clean Hydrogen The final rules also include a pathway to demonstrate electricity transfers between regions for producers near grid boundaries.
When GREET Does Not Cover the Pathway
Some production technologies and feedstocks are not built into 45VH2-GREET. In those cases, a producer can petition the Secretary of the Treasury for a provisional emissions rate, but only after first obtaining an emissions value from the Department of Energy through its 45V Emissions Value Request Process.7Department of Energy. 45V Emissions Value Request DOE reviews applications only from projects that have completed a front-end engineering and design study based on an AACE Class 3 cost estimate, and it will not review requests for technologies already covered by the model.
Third-Party Verification
Producers cannot self-certify their emissions or production volumes. The final regulations require a third-party verification report attached to Form 7210, including a production attestation, a sale-or-use attestation, a conflict-of-interest attestation, a qualified verifier statement, general facility information, and supporting documentation.8Federal Register. Credit for Production of Clean Hydrogen and Energy Credit Lining up the verifier early and keeping clean records through the year is much easier than reconstructing production data at filing time.
How to Claim the Credit
The credit is claimed on IRS Form 7210, which reports the qualified clean hydrogen produced at each facility, the facility’s emissions tier, and the calculated credit amount. A separate Form 7210 is required for each facility, attached to the producer’s federal income tax return.9Internal Revenue Service. Instructions for Form 7210
Before claiming the credit, or before electing direct pay or transferability, the producer must complete a pre-filing registration through the IRS electronic portal. The portal issues a unique identification number that must appear on Form 7210 and related tax documents.10Internal Revenue Service. Form 7210 – Clean Hydrogen Production Credit Skipping registration blocks the claim, so complete it well before the filing deadline.
Turning the Credit Into Cash
Producers who cannot fully use the credit against their own tax liability have two options.
Direct pay under Section 6417 lets certain entities receive the credit value as a refund from Treasury even if they owe no federal income tax. Tax-exempt organizations, state and local governments, tribal governments, rural electric cooperatives, and the Tennessee Valley Authority automatically qualify as applicable entities.11Office of the Law Revision Counsel. 26 U.S. Code 6417 – Elective Payment of Applicable Credits Taxable businesses can also elect direct pay for the 45V credit, but only for five consecutive tax years per facility. After that, any unused credit must be applied against tax liability or transferred.12Internal Revenue Service. Elective Pay and Transferability Frequently Asked Questions
Credit transfers under Section 6418 let any eligible taxpayer sell all or part of the credit to an unrelated buyer for cash. The buyer then claims the credit on its own return. The sale is one-time only; the buyer cannot resell.13Office of the Law Revision Counsel. 26 USC 6418 – Transfer of Certain Credits Cash received by the seller is not gross income, and the buyer cannot deduct the payment. If the transferred amount later exceeds the credit actually allowable, the buyer owes a recapture tax plus a 20 percent penalty on the excess.
45V Production Credit vs. Section 48 Investment Credit
Producers can skip the annual 45V production credit entirely and instead make an irrevocable election under Section 48(a)(15) to claim a one-time investment tax credit on the cost of the facility’s qualified property.3Federal Register. Section 45V Credit for Production of Clean Hydrogen Section 48a15 Election To Treat Clean Hydrogen The investment credit is calculated from the facility’s capital cost and expected emissions profile rather than actual production volume.
The production credit rewards ongoing output and favors facilities that run at high capacity for many years. The investment credit front-loads the benefit and reduces exposure when future production volumes are uncertain. Once made, the Section 48 election is irrevocable and binding on every party with an ownership interest in the facility, and a facility that elects Section 48 cannot also claim 45V or the Section 45Q carbon capture credit.3Federal Register. Section 45V Credit for Production of Clean Hydrogen Section 48a15 Election To Treat Clean Hydrogen
Anti-Stacking With Other Clean Energy Credits
A producer that claims 45V for a facility and tax year cannot also claim the Section 45Q carbon capture credit or the Section 48 investment credit for that same facility. Separately, the Section 45Z clean fuel production credit, which took effect in 2025, contains its own anti-stacking provision: a facility that has claimed 45V, 45Q, or the Section 48(a)(15) investment credit in any tax year is ineligible for 45Z in that year. These rules run facility-by-facility and year-by-year, so a company operating multiple sites could claim different credits at different sites, but cannot combine them at a single location.
