The federal excise tax rates on tobacco products are set by Section 5701 of the Internal Revenue Code and range from roughly a penny per small cigarette to $24.78 per pound of roll-your-own tobacco. The tax applies to cigars, cigarettes, smokeless tobacco, pipe tobacco, roll-your-own tobacco, cigarette papers, and cigarette tubes. Manufacturers and importers owe the tax, and the Alcohol and Tobacco Tax and Trade Bureau (TTB) collects it.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
Cigar Rates
Federal law splits cigars by weight, and the two categories are taxed very differently.
Small cigars, weighing no more than three pounds per thousand, are taxed at a flat $50.33 per thousand. That comes out to just over five cents per cigar.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
Large cigars, weighing more than three pounds per thousand, are taxed at 52.75 percent of the manufacturer’s or importer’s sale price, capped at 40.26 cents per cigar. Even a premium cigar selling for several dollars at wholesale never generates federal excise above that ceiling.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
The “price” behind the 52.75 percent calculation is not the retail shelf price. It includes charges necessary to prepare the cigar for use, but excludes the federal excise tax itself and any separately stated state or local retail sales tax.2Office of the Law Revision Counsel. 26 USC 5702 – Definitions
Cigarette Rates
Cigarettes are also split by weight, with a length rule bolted on to prevent gaming.
Small cigarettes, at no more than three pounds per thousand, are taxed at $50.33 per thousand. That equals roughly $1.01 in federal tax on a standard 20-cigarette pack. State excise taxes stack on top of the federal rate and vary widely.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
Large cigarettes, over three pounds per thousand, are taxed at $105.69 per thousand. If a large cigarette runs longer than 6½ inches, each 2¾-inch segment (or fraction of one) counts as a separate cigarette taxed at the small-cigarette rate of $50.33 per thousand. That length rule stops a manufacturer from packing extra tobacco into one oversized stick to dodge the per-unit tax on what is really several cigarettes’ worth.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
Smokeless and Pipe Tobacco Rates
Smokeless and pipe tobacco are taxed by weight, and the rates apply proportionally to any fractional part of a pound.
- Snuff: $1.51 per pound.
- Chewing tobacco: $0.5033 per pound, covering loose-leaf, plug, and twist varieties.
- Pipe tobacco: $2.8311 per pound.
All three rates are set by Section 5701.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
The gap between pipe tobacco at $2.83 per pound and roll-your-own tobacco at $24.78 per pound has drawn regulatory attention. Because both are loose tobacco, some manufacturers have tried relabeling roll-your-own blends as pipe tobacco to reach the lower rate. The TTB watches for that, and misclassification can bring penalties and back taxes.
Roll-Your-Own Tobacco, Papers, and Tubes
Roll-your-own tobacco is taxed at $24.78 per pound, the highest rate on any loose tobacco product. The rate is set high to keep rough parity with factory-made cigarettes; without it, consumers could sidestep most of the cigarette tax by buying loose tobacco and papers.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
The materials used to hand-roll a cigarette carry their own taxes. Cigarette papers are taxed at 3.15 cents per 50 papers, or any fraction of 50. Papers longer than 6½ inches are taxed in 2¾-inch increments, with each increment counted as a separate paper. Cigarette tubes are taxed at roughly double the paper rate per 50 tubes, following the same fractional-quantity rule.1Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax
Products Not Covered by Section 5701
The Internal Revenue Code defines “tobacco products” for excise tax purposes as cigars, cigarettes, smokeless tobacco, pipe tobacco, and roll-your-own tobacco.2Office of the Law Revision Counsel. 26 USC 5702 – Definitions The list has not been updated for newer product categories.
Oral nicotine pouches such as Zyn contain nicotine but no tobacco leaf, and they fall outside the statutory definition. They are not subject to any federal excise tax under Chapter 52. The FDA’s authority over “tobacco products” was expanded in 2022 to reach products containing nicotine from any source, but that change did not touch the narrower Internal Revenue Code definition for tax purposes.3U.S. Government Accountability Office. Tobacco Taxes: Federal Revenue Implications of Tax Rate Differences and Drawback Refunds E-cigarettes and vaping liquids are also not among the taxable categories in Section 5701, though proposals to add them come up in Congress from time to time.
When the Tax Is Owed and How It Is Paid
The manufacturer or importer of a tobacco product is legally responsible for the excise tax.4Office of the Law Revision Counsel. 26 USC 5703 – Liability for Tax and Method of Payment Liability attaches at “removal,” meaning when the product leaves a bonded factory, exits an internal revenue bond, or clears customs.5Alcohol and Tobacco Tax and Trade Bureau. T.D. ATF-421 – Implementation of Public Law 105-33 Whether or when the product reaches a consumer does not matter. The obligation locks in at removal.
Tobacco products manufactured outside a permitted, bonded facility owe tax immediately upon manufacture. There is no deferred-payment option in that case.4Office of the Law Revision Counsel. 26 USC 5703 – Liability for Tax and Method of Payment
Manufacturers operating under bond file semi-monthly excise tax returns covering the 1st through the 15th of each month and the 16th through the end. Payment for each period is due by the 14th day after the period closes.4Office of the Law Revision Counsel. 26 USC 5703 – Liability for Tax and Method of Payment When a due date lands on a weekend or federal holiday, the deadline moves to the preceding business day.6Alcohol and Tobacco Tax and Trade Bureau. Due Dates for Tax Returns
Any taxpayer whose gross tobacco tax liability, before adjustments, reaches $5 million or more in a calendar year must pay by electronic funds transfer during the following year. The $5 million threshold combines liability on tobacco products with liability on cigarette papers and tubes rather than testing each separately.7Alcohol and Tobacco Tax and Trade Bureau. Removals That Are Not Taxed
Section 5704 lets certain removals from a bonded facility or customs custody happen without tax. Export shipments to a foreign country, Puerto Rico, the Virgin Islands, or a U.S. possession can move in bond without tax, provided the required marks and labels are in place. Transfers between bonded facilities are permitted without tax as well; the receiving manufacturer or export warehouse proprietor picks up the tax liability, and the shipper is released from it.4Office of the Law Revision Counsel. 26 USC 5703 – Liability for Tax and Method of Payment Small quantities furnished to employees for personal use or used for experimental purposes are exempt in amounts prescribed by the Secretary of the Treasury. Products removed for use by the U.S. government are exempt. Imported products can be released from customs to an export warehouse or to a manufacturer’s bonded premises without immediate tax payment, provided they are not already in retail packaging.8Office of the Law Revision Counsel. 26 USC 5704 – Exemption From Tax
Every one of these exemptions depends on strict labeling, marking, and record-keeping compliance.
Penalties for Underpayment or Noncompliance
Willfully failing to comply with any duty imposed by Chapter 52, including record-keeping, filing returns, or following labeling rules, triggers a civil penalty of $1,000 per violation. Failure to pay the excise tax on time adds a separate penalty of 5 percent of the unpaid amount.9Office of the Law Revision Counsel. 26 USC 5761 – Civil Penalties
Selling or receiving tobacco products within the United States that were labeled or shipped for export carries an especially harsh civil penalty: the greater of $1,000 or five times the excise tax that should have been paid, plus forfeiture of the products and any vehicles used to transport them.9Office of the Law Revision Counsel. 26 USC 5761 – Civil Penalties
Criminal exposure sits on top of that. Operating as a manufacturer or importer without a permit, filing false records or returns, evading or refusing to pay the tax, or unlawfully removing products from bond, all done with intent to defraud the United States, are punishable by up to five years in prison, a fine of up to $10,000, or both, per offense. Non-fraudulent violations of Chapter 52 still carry up to one year in prison and a fine of up to $1,000 per offense. The distinction between the two tiers is intent to defraud.10Office of the Law Revision Counsel. 26 USC 5762 – Criminal Penalties
Floor Stocks Tax on Rate Increases
When Congress raises federal tobacco excise rates, a floor stocks tax can hit products that were already tax-paid at the old rate but still sit on shelves or in warehouses awaiting sale. The floor stocks tax equals the difference between the new and old rates, and it falls on the dealer holding the inventory rather than the manufacturer.
The most recent floor stocks tax came from the Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA), which raised excise rates effective April 1, 2009. Dealers holding tax-paid tobacco products for sale on that date had to inventory their stock, calculate the additional tax owed, file a return, and pay the difference. A credit of up to $500 was available against the total floor stocks tax; controlled groups shared a single credit across all members.11Federal Register. Increase in Tax Rates on Tobacco Products and Cigarette Papers and Tubes; Floor Stocks Tax on Certain Tobacco Products and Cigarette Papers and Tubes No floor stocks tax has been imposed since then, but any future rate increase could bring one.
