26 CFR 601.602: Valid Returns, Substitute Forms, and E-Filing

26 CFR 601.602 is a short procedural regulation that directs the IRS to develop tax forms and instructions, distribute them to people who filed the year before, and make copies available on request to anyone else. It contains three subsections, sets no penalties, and lists no specific forms. Its practical importance is that it sits alongside the statutes that turn “using the right form, filled out correctly” into the legal definition of filing a return.1eCFR. 26 CFR 601.602 – Tax Forms and Instructions

What the Regulation Says

The text, last revised in 1981, breaks into three parts. Subsection (a) says the IRS develops forms and instructions that explain the requirements of the Internal Revenue Code and distributes them so taxpayers can comply voluntarily. Subsection (b) extends that to filings beyond tax returns, including information returns and employer filings, and notes that the instructions walk taxpayers step by step through the data the law requires. Subsection (c) covers distribution: the IRS mails forms to people who filed the previous year, and anyone else can request copies from IRS offices.2eCFR. 26 CFR 601.602 – Tax Forms and Instructions

That is the whole regulation. It creates an agency obligation to produce and distribute forms. It does not, by itself, require you to file anything.

Where the Filing Requirement Actually Comes From

The obligation to file on prescribed forms is in 26 U.S.C. 6011, not in 601.602. That statute says any person liable for a tax “shall make a return or statement according to the forms and regulations prescribed by the Secretary” and must include all information those forms require.3Office of the Law Revision Counsel. 26 USC 6011 – General Requirement of Return, Statement, or List You cannot send the IRS a letter summarizing your income and treat it as a return. The format is part of the requirement.

What Counts as a Valid Return

Using an official form is not automatically enough. Courts apply the Beard test, from the 1984 Tax Court case Beard v. Commissioner, to decide whether a document qualifies as a return. Four things must be true:

  • The document contains enough information for the IRS to calculate your tax liability.
  • It purports to be a return, rather than a protest letter or a blank form.
  • It represents an honest and reasonable attempt to comply with the tax law.
  • It is signed under penalty of perjury.

This is where filings built around constitutional objections tend to fail. A Form 1040 filled with zeros, or one with “Fifth Amendment” written across every line, does not satisfy the test even though the correct form was used.4Internal Revenue Service. Validity of Tax Returns Filed With Stolen Social Security Numbers

The perjury requirement itself comes from 26 U.S.C. 6065, which says any return or statement required under the tax code “shall contain or be verified by a written declaration that it is made under the penalties of perjury.”5Office of the Law Revision Counsel. 26 USC 6065 – Verification of Returns The jurat line at the bottom of your 1040 is doing legal work. Knowingly providing false information on a signed return is a felony under 26 U.S.C. 7206, punishable by a fine of up to $100,000 (up to $500,000 for a corporation) or up to three years in prison.6Office of the Law Revision Counsel. 26 USC 7206 – Fraud and False Statements

What Happens When a Filing Doesn’t Qualify

If your submission fails the Beard test, the IRS can treat it as if you never filed. Under 26 U.S.C. 6651, failure to file by the deadline triggers a penalty of 5% of the unpaid tax for each month or partial month the return is late, capped at 25%. A separate failure-to-pay penalty runs at half a percent per month, also capped at 25%.7Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax

The connection to 601.602 is direct. The regulation exists so that taxpayers have access to the prescribed forms; the penalties exist for people who either ignore those forms or submit something the law does not recognize as a return.

OMB Control Numbers on IRS Forms

The small numbers in the upper-right corner of an IRS form, formatted as 1545-XXXX, come from the Office of Management and Budget under the Paperwork Reduction Act, enacted in 1980 and amended significantly in 1995. Each number confirms that the form went through an OMB review evaluating its necessity and the burden it places on the public.8US EPA. Summary of the Paperwork Reduction Act

Which numbers apply to which regulations is handled by 26 CFR 602.101, a separate regulation that maintains a crosswalk table. Section 601.602 itself is associated with OMB numbers 1545-0295, 1545-0387, and 1545-0957.9eCFR. 26 CFR 602.101 – OMB Control Numbers

These numbers carry real weight because of 44 U.S.C. 3512, the public protection provision of the Paperwork Reduction Act. That statute says no one can be penalized for failing to respond to an information collection that lacks a valid OMB control number, or where the agency fails to inform the respondent that compliance is voluntary in the absence of one. It can be raised as a complete defense in an administrative proceeding or in court.10Office of the Law Revision Counsel. 44 USC 3512 – Public Protection OMB approvals generally last three years before renewal, and IRS forms virtually always carry current approvals in practice.

Using Substitute Forms

You are not required to use a form printed by the IRS. Substitute forms produced by software companies, employers, or financial institutions are legally acceptable if they meet the design and printing specifications in Publication 1167, which covers paper weight, font size, field positioning, and barcode requirements. Approval is granted only after the IRS confirms the form will process correctly through its scanning and intake systems.11Internal Revenue Service. About Publication 1167 – General Rules and Specifications for Substitute Forms and Schedules

Commercial tax preparation software handles this automatically. The risk is on organizations that print their own W-2s, 1099s, or similar filings in-house without going through the Publication 1167 review. Rejected filings trigger the same failure-to-file penalties as not filing at all.12Internal Revenue Service. Topic No. 253 – Substitute Tax Forms

Electronic Filing Thresholds

Electronic filing has changed how the distribution function in 601.602(c) works in practice. Under 26 U.S.C. 6011(e), any filer submitting 10 or more information returns in a calendar year must file them electronically. The threshold dropped from 250 before 2021, to 100 in 2021, to 10 for years after 2021, and it is calculated across all return types combined rather than per form.3Office of the Law Revision Counsel. 26 USC 6011 – General Requirement of Return, Statement, or List

For the 2026 tax year (filing season 2027), the IRS is retiring the Filing Information Returns Electronically (FIRE) system entirely. The Information Returns Intake System (IRIS) becomes the sole electronic intake system for information returns, and organizations still using FIRE need to transition before that cutoff.13Internal Revenue Service. Filing Information Returns Electronically (FIRE)

Forms in the 1099 series also change for 2026. The IRS has separated address fields into individual entry boxes and added fields on Forms 1099-MISC, 1099-NEC, and 1099-K for reporting cash tips, Treasury Tipped Occupation Codes, and overtime compensation.14Internal Revenue Service. How to Actually Get the Forms

The most direct route is IRS.gov, which hosts current-year and prior-year forms, instructions, and publications as downloadable PDFs.

For paper copies, the IRS runs the Tax Forms Outlet Program, which ships tax products to participating libraries and other locations starting each January. Availability varies by location and tends to be limited to the most commonly filed returns.15Internal Revenue Service. Tax Forms Outlet Program (TFOP)

You can also order paper copies directly from the IRS, but quantities are limited: generally 10 copies per information return, 20 per employer return, and 5 per publication or instruction booklet. Businesses needing large volumes will need approved substitute forms or electronic filing instead.16Internal Revenue Service. Order Paper Information Returns and Employer Returns

If your adjusted gross income is $89,000 or less, IRS Free File offers guided tax preparation software at no cost for your federal return. Above that threshold, Free File Fillable Forms provides a basic electronic version of IRS forms at any income level, without the step-by-step guidance.17Internal Revenue Service.
