14 CFR Part 139 sets the airport certification requirements the FAA enforces against any U.S. airport that serves scheduled passenger flights on aircraft configured for more than nine seats, or unscheduled passenger flights on aircraft configured for at least 31 seats. Under 49 U.S.C. § 44706, an airport in that category cannot legally handle those operations without an Airport Operating Certificate.1Office of the Law Revision Counsel. 49 USC 44706 – Airport Operating Certificates The certificate comes with continuing obligations that cover pavement, firefighting capability, inspections, staff training, wildlife control, and reporting, all measured against a written manual the FAA approves in advance.
Which Airports Need a Certificate
Part 139 applies to airports in the United States, its territories, and the District of Columbia that serve either type of qualifying passenger operation.2eCFR. 14 CFR 139.1 – Applicability Once an airport falls within scope, it is sorted into one of four classes based on the mix of scheduled and unscheduled service it offers:3eCFR. 14 CFR 139.5 – Definitions
- Class I airports serve scheduled large air carrier operations and may also handle unscheduled large and scheduled small operations. Most major commercial airports sit here.
- Class II airports serve scheduled small air carrier operations and unscheduled large operations, but no scheduled large flights.
- Class III airports serve only scheduled small air carrier operations.
- Class IV airports serve only unscheduled large air carrier operations, with no scheduled service.
The class determines the depth of the airport’s obligations. Class I facilities meet the most extensive requirements because they handle the widest range of traffic; Class III and IV airports have a narrower set, but the core safety standards still apply.
The Airport Certification Manual
Every certified airport must adopt an Airport Certification Manual (ACM) explaining exactly how it meets each Part 139 obligation. The FAA has to approve the manual before operations begin, and the certificate holder must keep it current and available for inspection at all times.4eCFR. 14 CFR 139.201 – General Requirements
Required contents are laid out in 14 CFR 139.203 and include a line of succession for operational responsibility, grid maps for emergency response, snow and ice control procedures, wildlife hazard management procedures, fuel and hazardous materials handling, a system for reporting field conditions to air carriers, and measures to keep unauthorized people out of operational areas.5eCFR. 14 CFR 139.203 – Contents of Airport Certification Manual
The manual functions as the airport’s operating playbook. FAA inspectors measure compliance against what it says, so vague or outdated entries create enforcement risk even when day-to-day practice is sound. Changes proposed by the airport must be submitted in writing at least 30 days before the intended effective date; the FAA can also initiate amendments for safety reasons, and in an emergency it can impose one immediately.6eCFR. 14 CFR 139.205 – Amendment of Airport Certification Manual
Pavement and Safety Area Standards
Runways, taxiways, loading ramps, and parking areas have to meet precise physical standards. Elevation differences between adjoining pavement sections cannot exceed three inches. Holes deeper than three inches, or with steep slopes, must be repaired unless small enough to fit under a five-inch circle. Cracks that could throw debris or affect steering must be fixed, contaminants such as mud, rubber buildup, and foreign objects must be removed promptly, and drainage must prevent water from pooling deep enough to obscure markings.7eCFR. 14 CFR 139.305 – Paved Areas
Safety areas around runways and taxiways must be graded smooth, free of hazardous ruts or depressions, and drained to prevent standing water. Under dry conditions, the ground must support firefighting vehicles and be able to handle an aircraft that runs off the pavement without causing catastrophic structural damage. Any object that has to sit in a safety area for operational reasons must be mounted on a breakaway structure no taller than three inches above grade.8eCFR. 14 CFR 139.309 – Safety Areas
Aircraft Rescue and Firefighting
The ARFF rules are the most detailed operational provisions in Part 139. Every certified airport is assigned an ARFF Index from A through E, based on the length of the longest aircraft with five or more average daily departures:9eCFR. 14 CFR 139.315 – Aircraft Rescue and Firefighting Index Determination
- Index A: aircraft under 90 feet
- Index B: 90 to under 126 feet
- Index C: 126 to under 159 feet
- Index D: 159 to under 200 feet
- Index E: 200 feet or longer
If the longest aircraft averages fewer than five daily departures, the airport drops one Index level.
Equipment requirements scale with the Index. An Index A airport needs at least one vehicle carrying a minimum of 500 pounds of dry chemical or equivalent agent. Index B requires 1,500 gallons of water capacity; Index C, 3,000; Index D, 4,000. An Index E airport must have three vehicles collectively carrying at least 6,000 gallons of water plus the corresponding foam concentrate, along with dry chemical capability.10eCFR. 14 CFR 139.317 – Aircraft Rescue and Firefighting Equipment and Agents
Response time is unforgiving. At least one ARFF vehicle must reach the midpoint of the farthest runway and begin applying extinguishing agent within three minutes of the alarm, and all remaining required vehicles must arrive and begin application within four. Every crew member has to complete a live-fire drill before performing rescue duties and again at least once every 12 months.11eCFR. 14 CFR 139.319 – Aircraft Rescue and Firefighting Operational Requirements
Daily Self-Inspections and Condition Reporting
Certificate holders cannot wait for FAA inspectors to catch problems. The airfield must be inspected at least once daily during air carrier operations, with additional inspections whenever unusual conditions arise, such as active construction or severe weather, and immediately after any accident or incident.12eCFR. 14 CFR 139.327 – Self-Inspection Program Inspections cover pavement, lighting, signage, safety areas, and the presence of wildlife or foreign objects.
When something is found that could affect flight safety, the airport must report it to air carriers through the NOTAM system or another FAA-authorized method. Reportable conditions include construction on movement areas, surface irregularities, snow or water accumulation, lighting malfunctions, unresolved wildlife hazards, and any reduction in ARFF capability. Records of each condition report must be retained for at least 12 consecutive months.13eCFR. 14 CFR 139.339 – Airport Condition Reporting
Personnel Training
Anyone who accesses movement or safety areas and performs duties under the ACM must complete training before starting those duties and again at least once every 12 months.14eCFR. 14 CFR 139.303 – Personnel The baseline curriculum covers airport familiarization (markings, lighting, signs), movement area access procedures, radio communications with air traffic control, and every ACM-assigned duty. Specialized roles in ARFF, wildlife management, and self-inspection carry additional subject-area training on top of the baseline.
Documentation matters as much as the instruction itself. If training logs are incomplete or the curriculum leaves out a required topic, inspectors treat it as a deficiency even when the airport can prove the training happened.
Wildlife Hazard Management
A formal wildlife hazard assessment becomes mandatory when any of several events occurs: an air carrier aircraft suffers multiple wildlife strikes, sustains damage from a wildlife collision, experiences a wildlife-related emergency, or when wildlife large enough or numerous enough to cause such events is observed with access to flight movement areas or approach and departure airspace.15eCFR. 14 CFR 139.337 – Wildlife Hazard Management
If the assessment identifies ongoing hazards, the airport must develop and implement a wildlife hazard management plan. Specifics vary by location. An airport near wetlands faces different challenges than one surrounded by farmland, but both need a documented, proactive strategy, and the resulting procedures form part of the ACM.
Getting Certified
An airport applies by submitting its application along with two copies of its proposed Airport Certification Manual to the FAA’s Regional Airports Division Manager.16Government Publishing Office. 14 CFR Part 139 Subpart B – Certification No one may operate a Part 139 airport without a certificate, or in violation of the certificate or the approved ACM.17eCFR. 14 CFR 139.101 – General Requirements
After reviewing the manual for regulatory compliance, the FAA schedules an on-site inspection to confirm the airport’s infrastructure, equipment, and staffing match what the manual describes. An ARFF response time that looks achievable on a diagram has to actually work with the vehicles and personnel on hand. Once the FAA is satisfied, the Regional Airports Division Manager issues the certificate, and it stays in effect until the airport surrenders it or the FAA revokes it.
Ongoing FAA Oversight and Penalties
Holding a certificate means agreeing to FAA oversight for as long as the airport operates. Certificate holders must allow inspections and tests the FAA considers necessary, including unannounced visits.18eCFR. 14 CFR 139.105 – Inspection Authority Inspectors walk the airfield, review training records, test ARFF response times, examine pavement, and audit condition-reporting logs.
Deficiencies must be corrected within the timeframe the FAA specifies. Violations of Part 139 or the underlying statute can draw civil penalties of up to $1,200,000 per violation for airports and organizations, or up to $100,000 per violation for individuals, under the penalty structure updated by the FAA Reauthorization Act of 2024.19Office of the Law Revision Counsel. 49 USC 46301 – Civil Penalties The FAA can also suspend or revoke the certificate, which shuts down commercial passenger operations at the airport until the issues are resolved.
Limited Relief for Small Airports
Under 49 U.S.C. § 44706(c), the FAA may exempt an airport that boards fewer than 0.25 percent of total annual passenger enplanements at all certified airports from some or all ARFF equipment requirements, if compliance would be unreasonably costly or impractical.1Office of the Law Revision Counsel. 49 USC 44706 – Airport Operating Certificates Petitioning requires detailed financial documentation, staffing data, enplanement figures, and a history of air carrier service.20eCFR. 14 CFR 139.111 – Exemptions The relief is narrow by design: it reaches only ARFF obligations, not the broader certification requirements, and the airport has to demonstrate genuine financial hardship rather than inconvenience.
