Real estate businesses have four 1099 forms to worry about in most years: Form 1099-NEC for service payments of $600 or more, Form 1099-MISC for rent and certain attorney proceeds, Form 1099-S for property sale proceeds, and Form 1099-INT for interest received on seller financing. The 1099 real estate forms filing requirements and deadlines below cover who gets which form, what thresholds apply, and when each copy is due.
Which Form Covers Which Payment
The form you file depends entirely on what you paid for.
Form 1099-NEC: Services
Form 1099-NEC handles nonemployee compensation and covers most 1099 filings in real estate. File it when you pay $600 or more during the calendar year to any individual or non-corporate entity for services.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025) The threshold is cumulative for the year, not per payment: five checks of $150 to the same handyman add up to $750, which is reportable.
Typical payments include commissions to independent agents, property management fees, and payments to electricians, roofers, landscapers, painters, and other tradespeople working on rental or investment properties. Attorney fees for services (closings, lease reviews, evictions, business counsel) also go on the 1099-NEC in Box 1, even when the law firm is incorporated.1Internal Revenue Service. Form 1099-MISC: Rent, Royalties, and Attorney Proceeds
Rent paid as part of your business goes in Box 1 of Form 1099-MISC when it reaches $600 or more for the year.2Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information Office space, warehouse leases, equipment rentals, and storage rent all qualify. Rent for your personal apartment does not, and your own tenants do not owe you a 1099 when they pay rent.
Royalty payments tied to mineral rights, oil and gas leases, or similar interests in real property go in Box 2. The threshold is $10, not $600.2Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information
Box 10 captures gross proceeds paid to an attorney, which is different from attorney fees for services. Settlement funds routed through a law firm are the common example. The $600 threshold applies, and the corporate exemption does not.3IRS.gov. Form 1099-MISC (Rev. April 2025) Miscellaneous Information
Form 1099-S: Sale Proceeds
Form 1099-S reports the gross proceeds from a sale or exchange of real estate. If you’re a seller, this one usually isn’t yours to file. The closing agent (title company, settlement attorney, or escrow officer) files it.4IRS.gov. Instructions for Form 1099-S (Rev. April 2025)
Box 2 shows the full sale price before commissions or selling expenses and includes the face value of any promissory note the buyer gives. The form gets filed whether the seller had a gain or a loss.4IRS.gov. Instructions for Form 1099-S (Rev. April 2025)
Principal residence sales carry one exception. If the seller certifies in writing that the home qualifies as their main residence and the gross proceeds are $250,000 or less ($500,000 or less for a married seller), the closing agent can skip the 1099-S.4IRS.gov. Instructions for Form 1099-S (Rev. April 2025) Without that certification, the form gets filed even when the seller owes no tax.
Form 1099-INT: Seller-Financed Interest
Carry back a mortgage and the interest the buyer pays you is interest income. If you receive $10 or more in interest during the year, provide the buyer with a Form 1099-INT.5Internal Revenue Service. About Form 1099-INT, Interest Income This one gets overlooked often, and the threshold is low.
A Note on Form 1099-K
If you collect rent through Venmo, PayPal, or a payment app, the platform (not you) files a 1099-K when gross payments to you exceed $20,000 and there are more than 200 transactions during the year. The One, Big, Beautiful Bill reverted the threshold to that pre-2022 level.6Internal Revenue Service. IRS Issues FAQs on Form 1099-K Threshold Under the One, Big, Beautiful Bill – Dollar Limit Reverts to $20,000 Watch for overlap: amounts on a 1099-K can duplicate amounts you would otherwise report on a 1099-NEC or 1099-MISC.
Who Counts as a Reportable Recipient
Payments to corporations, including LLCs that have elected C or S corporation taxation, generally don’t get a 1099. Payments to sole proprietors, partnerships, and single-member LLCs (disregarded entities) do, once they hit the dollar threshold.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025) Most contractors, agents, and property managers in real estate fall into the reportable categories.
Two exceptions cut against the corporate rule. Payments for legal services must be reported regardless of the firm’s entity type. Medical and health care payments to corporations are also reportable, though that comes up less often in real estate.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
Collect a completed Form W-9 from every contractor, vendor, and service provider before you make the first payment. The W-9 captures the recipient’s legal name, address, taxpayer identification number, and entity type, which is the information that tells you whether a 1099 is required.7IRS. Form W-9 Request for Taxpayer Identification Number and Certification The IRS also runs a free TIN Matching service that verifies name-and-TIN combinations before you file, which catches mismatches while they are still easy to fix.8Internal Revenue Service. Paper filers must include Form 1096 as a transmittal cover sheet, with a separate 1096 for each type of 1099.10Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns
Electronic Filing Is Required at 10 Returns
File 10 or more information returns of any type during the calendar year and you must file electronically. The count is aggregated across all form types, W-2s included, so even a small real estate operation can cross the line quickly.11Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically
The IRS is moving filers off the older FIRE system and onto IRIS (Information Returns Intake System). FIRE is scheduled for retirement after the 2026 tax year filing season, leaving IRIS as the only intake platform.12Internal Revenue Service. Filing Information Returns Electronically (FIRE) IRIS is a free web portal that accepts up to 100 manually entered returns at a time or CSV uploads, handles corrections, and issues recipient copies. You need an IRIS Transmitter Control Code to use it.13Internal Revenue Service. E-file Information Returns With IRIS
Penalties for Missing the Deadlines
The IRS assesses separate penalties for the IRS copy and the recipient copy. For returns due in 2026, per-return amounts are:14Internal Revenue Service. Information Return Penalties
- Up to 30 days late: $60 per return
- 31 days late through August 1: $130 per return
- After August 1 or not filed: $340 per return
- Intentional disregard: $680 per return, with no maximum cap
A real estate business that pays 20 contractors and misses the deadline entirely faces potential penalties of $6,800 on the IRS filing side, plus a separate set of penalties for late recipient statements. Small businesses have lower maximum penalty caps for the non-intentional tiers, but the per-return amounts are the same.
Corrections and Extensions
Discover an error after filing and you file a corrected return promptly. On paper, check the “CORRECTED” box, complete all information fields (not just the ones you’re changing), and submit with a new Form 1096. Furnish a corrected copy to the recipient as well.15Internal Revenue Service. General Instructions for Certain Information Returns Electronic corrections go through IRIS. Review the error charts in the General Instructions for Information Returns before filing, because the IRS treats different error types differently.
Form 8809 requests additional time to file. For most 1099 forms, including 1099-MISC and 1099-S, the initial 30-day extension is automatic and needs no written justification. Request it through IRIS or on paper.16IRS. Form 8809 Application for Extension of Time to File Information Returns (Rev. December 2025)
Form 1099-NEC is different. Because its January 31 deadline is already tight, extensions are not automatic. You must submit a paper Form 8809 with a written explanation, and the IRS can deny it.16IRS. Form 8809 Application for Extension of Time to File Information Returns (Rev. December 2025) Any extension request has to reach the IRS by the original filing deadline.
If penalties do hit, you can request relief by showing reasonable cause. The IRS weighs whether you acted responsibly before and after the failure, tried to prevent the problem, requested extensions when possible, and corrected the issue promptly.17Internal Revenue Service. 18Internal Revenue Service. Topic No. 307, Backup Withholding You report the withheld amounts on Form 945, the annual return for nonpayroll federal income tax withholding, and deposit through EFTPS, IRS Direct Pay, or your IRS business tax account.19IRS. 2025 Instructions for Form 945 Backup withholding is not optional once triggered, which is another reason to collect W-9s at the start of the relationship.
State Filings
Many states want their own copy of the 1099s you file federally. The IRS Combined Federal/State Filing program automatically forwards federal data to participating state agencies, which can eliminate a separate filing.20Internal Revenue Service. Combined Federal/State Filing (CFSF) Program State Coordinator Information FAQs Not every state participates, and some that do still require additional filings or apply different thresholds. Confirm with your state’s tax authority whether the federal filing covers you.
