Copy A of Form 1099 is the version that goes to the IRS, and getting it there means either transmitting it electronically through an IRS system or mailing an official red-ink paper form by the deadline that applies to your form type. If you file 10 or more information returns of any kind during the year, electronic filing is mandatory.1Internal Revenue Service. E-File Information Returns Miss the deadline or file with bad data and the penalty runs from $60 to $680 per return.
What Copy A Is
Every 1099 comes in several copies routed to different recipients. Copy A is the IRS’s copy, and it’s the one the agency matches against the income your payees report on their own returns. Copy B goes to the payee, Copy 1 goes to the state where required, and Copy C stays in your files. Copy A has its own formatting rules that the other copies don’t share, which is where most filers get tripped up.
Paper or Electronic: Which One Applies to You
The 10-return threshold decides this for most businesses. If you file 10 or more information returns of any type in a year, all of them must be filed electronically. The count aggregates across form types and includes W-2s sent to the Social Security Administration, so six 1099-NECs plus four W-2s puts you over the line and everything has to go in electronically.1Internal Revenue Service. E-File Information Returns The old 250-return threshold was replaced starting with returns filed on or after January 1, 2024.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
If the threshold applies but you can’t reasonably e-file, Form 8508 requests a waiver. Valid grounds include financial hardship, lack of internet access in rural areas, a federally declared disaster, or a first year of operations. A hardship claim requires current cost estimates from two service bureaus; prior-year estimates or fewer than two estimates result in automatic denial.3Internal Revenue Service. The Red-Ink Rule for Paper Copy A
Filers under the threshold who choose paper have to use official forms printed in a specific red ink that IRS scanners can read. You cannot print Copy A from the IRS website, photocopy an existing form, or generate one from your accounting software.4Internal Revenue Service. General Instructions for Certain Information Returns (2025) – Section: E. Filing Returns With the IRS Anything printed in standard black ink gets rejected by the optical character recognition equipment, and rejection counts as a filing failure that can trigger penalties.
Two sources supply usable forms. The IRS ships pre-printed forms free through its online ordering page or by phone at 800-829-3676.5Internal Revenue Service. Forms and Publications by U.S. Mail Commercial vendors also sell IRS-approved substitute forms that meet the specifications in Publication 1179.
Every paper batch needs a Form 1096 cover sheet summarizing the count and dollar totals, and you need a separate 1096 for each type of return. Filing both 1099-NEC and 1099-MISC means two 1096s in two separate envelopes.6Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns The processing center you mail to depends on your state; the IRS lists the three center addresses on its “Where to File Form 1096” page.7Internal Revenue Service. Where to File Form 1096 Use certified mail or a tracked delivery service. A delivery confirmation is your only defense if the IRS later says the filing was late.
Filing Electronically Through IRIS or FIRE
The IRS runs two electronic intake systems. The newer one is the Information Returns Intake System (IRIS), a free web portal where you can key in data, upload a CSV, or connect through an application-to-application channel for higher volumes. The Taxpayer Portal handles up to 100 returns at a time, lets you download payee copies, and keeps a submission record. IRIS accepts returns for tax year 2022 and later.8Internal Revenue Service. E-File Information Returns With IRIS
The older system, Filing Information Returns Electronically (FIRE), still works but is scheduled for shutdown after the 2026 tax year. IRIS will be the only electronic intake system starting in filing season 2027.9Internal Revenue Service. Filing Information Returns Electronically (FIRE) Anyone still on FIRE should start moving over. Both systems require a Transmitter Control Code obtained through an online application.
Payroll services and accounting software commonly handle the transmission for you. If you use one, confirm which system they submit through and whether they’ve obtained a TCC in your name.
Deadlines by Form
The date depends on which 1099 you’re filing and, for some forms, whether you go paper or electronic.
- 1099-NEC: January 31, whether paper or electronic. This is also the date Copy B is due to the payee.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
- 1099-MISC and most other 1099 forms: February 28 on paper, March 31 electronically. In 2026, February 28 is a Saturday, so the paper deadline moves to March 2, 2026.10Internal Revenue Service. General Instructions for Certain Information Returns (2025)
Extensions When You Can’t Make the Date
Form 8809, filed before the due date, requests an automatic 30-day extension. For most 1099 forms other than the 1099-NEC, the extension is granted automatically with no explanation needed. You can submit it through IRIS, FIRE, or on paper.11Internal Revenue Service. Form 8809 – Application for Extension of Time to File Information Returns
The 1099-NEC is treated differently. Extensions for it are not automatic. You have to file Form 8809 on paper, include a written explanation of why you need more time, and have it signed by an authorized person. Only one 30-day extension is available, and the IRS made the process harder on purpose because the January 31 date exists to get contractor data in early and curb refund fraud.
Check TINs Before You File
The most common trigger for a 1099 penalty isn’t lateness, it’s an incorrect or missing Taxpayer Identification Number. Match every payee’s name and TIN against the Form W-9 they gave you before you submit anything.
The IRS runs a free TIN Matching tool through its e-Services portal that verifies name-and-TIN combinations against IRS records. The interactive version handles up to 25 lookups at a time with immediate results; the bulk version processes up to 100,000 combinations within 24 hours.12Internal Revenue Service. Taxpayer Identification Number (TIN) Matching Tools Running this check first is the cheapest way to avoid penalties on Copy A.
If a payee refuses to provide a valid TIN, filing with a blank TIN field isn’t an option. You have to withhold 24% of the payment as backup withholding and remit it on Form 945.13Internal Revenue Service. Withholding and Reporting Obligations Failing to withhold when required makes you liable for the tax yourself.
Correcting a Copy A You’ve Already Filed
Mistakes happen and the IRS expects you to fix them promptly. How you correct depends on what’s wrong.10Internal Revenue Service. General Instructions for Certain Information Returns (2025)
For a wrong dollar amount, code, or checkbox, or a return that shouldn’t have been filed at all, prepare a new 1099 with the “CORRECTED” box checked, enter the right information, attach a new Form 1096, and send it to the same processing center. That’s a single corrected return.
For a wrong payee name or TIN, the fix takes two returns. First, file a corrected return that zeros out the dollar amounts on the original with the “CORRECTED” box checked. Then file a new original return with the correct payee information and the actual amounts. This lets the IRS remove the bad record and post the right one.
If the original went in electronically, corrections must also go in electronically. Paper corrections apply only when the original was paper. For large-scale errors or duplicate filings, call the IRS Information Reporting line at 866-455-7438 before submitting a flood of corrections.
What Late or Incorrect Filing Costs
Section 6721 penalties are per return and escalate the longer the problem sits. For returns due in 2026:14Internal Revenue Service. Information Return Penalties
- Corrected within 30 days of the deadline: $60 per return.
- Corrected after 30 days but on or before August 1: $130 per return.
- Filed after August 1 or not at all: $340 per return.
- Intentional disregard: $680 per return, with no annual cap.15Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns
Small businesses with average annual gross receipts of $5 million or less get annual caps of $239,000 at the 30-day tier, $683,000 at the August 1 tier, and $1,366,000 at the after-August-1 tier.16Internal Revenue Service. IRM 20.1.7 Information Return Penalties Larger businesses face higher caps. Intentional disregard has no cap at any size, and the penalty can rise to 10% of the amount that should have been reported if that number exceeds $680 per return.
Because the penalty is per return, volume adds up fast. Two hundred late 1099-NECs filed after August 1 expose the filer to $68,000 before any cap applies. Fixing a TIN error in February versus ignoring it until September is a six-fold difference in the per-return penalty.
State Copies Are a Separate Question
Many states want their own 1099 data for state income tax enforcement. If your state participates in the IRS Combined Federal/State Filing program, the IRS forwards your electronically filed data to the state after you submit Copy A, which can eliminate a separate state filing. The program pulls from both FIRE and IRIS and distributes to participating states roughly nine times per year.17Internal Revenue Service. Combined Federal/State Filing (CFSF) Program State Coordinator Information FAQs Paper returns aren’t covered, and not every state participates. Check with your state tax agency to confirm whether the program applies and whether you owe any additional state filing.
